NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA,DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of ballots cast in the precincts except absent voter ballots and provisional ballots was 40,162. That the whole number of absent voter ballots cast in the city was 14,622, making a total of 54,784 ballots cast in the city. SECTION 2. The City Council does declare and determine that Cathy Green was elected as Member of the City Council for the full term of four years; Jill Hardy was elected as Member of the City Council for the full term of four years; Dave Sullivan was elected as Member of the City Council for the full term of four years; Gil Coerper was elected as Member of the City Council for the full term of four years; Jennifer McGrath was elected as City Attorney for the full term of four years; SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) The measures voted upon; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each person, and for and against each measure; (6) The total number of votes given to each person. SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, ADOPTED AND APPROVED ON DECEMBER 2, 2002. (Election of four members of the City Council and a City Attorney.) Funding Source: Election Account Recommended Action: Motion to adopt: Resolution No. 2002-60 — "A Resolution Calling and Giving Notice of the General Municipal Election to be held November 5, 2002." Resolution No. 2002-61 — "A Resolution Requesting the County Board of Supervisors to consolidate the General Municipal Election with the Statewide General Election— November 5, 2002." Alternative Action(s): These resolutions are required in order to conduct the General Municipal Election every two years as required by the City Charter. The only alternative action available to Council is relative to regulations for Candidates' Statements. The City currently has a perpetual resolution which sets forth a 200 word limit for Candidates' Statements. The City Council may direct that a new resolution be prepared setting forth a 400 word limit, however the cost to the candidate would be greater. Further, historically the 200 word limit for Candidates' Statements has always been in effect. REQUEST FOR CITY COUNCIL ACTION MEETING DATE: June 17, 2002 DEPARTMENT ID NUMBER: Ck2002-5 Analysis: The City Charter provides for city elections to be held pursuant to the State Elections Code. These resolutions comply with City Charter and State Code and must be adopted to implement the November 5, 2002 election for four City Council Members and one City Attorney. Perpetual Resolution No. 98-40 adopted on June 1, 1998 sets forth regulations for candidates' statements and is attached for informational purposes.
