STATEMENT OF ISSUE:
Resolution No. recites the facts of the General Municipal Election held in said city on the 8th day of
November, 1994, declaring the results thereof and such other matters as provided by provisions of the City
Charter and the Elections Code of the State of California.
RECOMMENDATION:
Adopt Resolution No. 6(o
ANALYSIS:
The 1994 November Consolidated Election showed a 65.834% overall turnout. The total number of
registered voters was 103,363.

STATEMENT OF ISSUE:
Resolution No. recites the facts of the General Municipal Election held in said city on the 8th day of
November, 1994, declaring the results thereof and such other matters as provided by provisions of the City
Charter and the Elections Code of the State of California.
RECOMMENDATION:
Adopt Resolution No. 6 G 5,? .
ANALYSIS:
The 1994 November Consolidated Election showed a 65.834% overall turnout. The total number of
registered voters was 103,363.

RESOLUTION NO. 6658
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH RECITING THE FACT OF THE GENERAL
MUNICIPAL ELECTION HELD ON NOVEMBER 8, 1994,
CONSOLIDATED WITH THE COUNTY OF ORANGE, AND
DECLARING THE RESULTS THEREOF
WHEREAS, a General Municipal Election was held and conducted in the City of Huntington Beach on
Tuesday,November 8, 1994, as required by the Charter; and
WHEREAS,Notice of the election was given in time, form and manner as provided by Law;that voting
precincts were properly established;that election officers were appointed and that in all respects the election
was held and conducted and the votes were cast, received and canvassed and the returns made and declared
in time, form and manner as required by the provisions of the.State of California Elections Code for the
holding of elections in charter cities; and
WHEREAS pursuant to Resolution No. 6602, adopted June 21, 1994 by the City Council of the City of
Huntington Beach,the Registrar of Voters of the County of Orange canvassed the returns of the election and
has certified the results to this Council, and such results have been received, and are attached and made a
part hereof as Exhibit A,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DOES
RESOLVE, DECLARE, DETERMINE AND ORDER as follows:
SECTION 1. That the whole number of votes cast in the city except absent voter ballots was 55,139.
That the whole number of absent voter ballots cast in the city was 12,909,making a total of 68,048 ballots
cast in the city.
SECTION 2. That the names of persons voted for at the election for member of the City Council are as
follows:

That the name of the persons voted for at the election for City Attorney is as follows:

SECTION 3. That the number of votes given at each precinct and the number of votes given in the city
to each of such persons above named for the respective offices for which the persons were candidates were as
listed in Exhibit A attached.
SECTION 4. The City Council does declare and determine that:
Ralph.Bauer was elected as member of the City Council for the full term of four years;
Shirley Dettloff was elected as member of the City Council for the full term of four years;
Dave Garofalo was elected as member of the City Council for the full term of four years;
Peter Green was elected as member of the City Council for the full term of four years;
Gail Hutton was elected as City Attorney for the full term of four years.
SECTION 5. The City Clerk shall enter on the records of the city a statement of the result of the
election showing:
(1) The whole number of votes (ballots) cast in the city;
(2) The names of the persons voted for;
(3) For what office each person was voted;
(4) The number of votes given at each precinct to each person.
SECTION 6. That the City Clerk shall immediately make and deliver to each of such persons so elected
a Certificate of Election signed by the City Clerk, and authenticated;that the City Clerk shall also administer
to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall
have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected
shall then be inducted into the respective office to which they have been elected.
SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution, and enter it
into the book of original resolutions.
PASSES AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting
thereof held on the 5th day of December , 1994.

The following is a brief explanation of the City Council/Redevelopment Agency Agenda
Structure.
AWARDS & PRESENTATIONS A limited number (two or three per month) of awards,
presentations, and proclamations will be made by the Mayor. The Public Information
Office will coordinate the arrangements with the Mayor and City Clerk. Persons wishing
to participate should contact the Public Information Office at 536-5511.
COUNCIL/COMMITTEE LIAISON REPORTS Informational updates and reports made by
Councilmembers who serve as Council liaisons to various committees.
PUBLIC COMMENTS (FILL OUT ATTACHED PINK PUBLIC COMMENTS FORM)
Anyone wishing to address the City Council/Redevelopment Agency on any matter not
listed on the agenda should speak at this time. Please fill out a pink form, available both
at the lower entrance to the Council Chamber and attached to this agenda. Give the form
to the Sergeant-at-Arms stationed near the speakers podium. The City Clerk will call all
speakers by name. There is a three-minute time limit per speaker. Time may not be
donated to another. All proceedings are . recorded. The policy of the City
Council/Redevelopment Agency is not to render any decision based on information

ORDINANCES - RESOLUTIONS

law thirty days after adoption. However, an urgency ordinance may be adopted
immediately upon introduction, and is effective immediately. Resolutions set policy and
become effective upon adoption.

RECOMMENDED ACTION:
1. Move that the City Council hereby directs staff to schedule for future City
Council action a proposal to create an Economic Development Commission for
the purpose of assisting staff in the retention, expansion and recruitment of
businesses to the City of Huntington Beach. Working closely with Economic
Development staff, the Commission members would meet with existing or new
businesses to foster expansion and recruitment efforts and serve as a liaison
between city officials and the business community.
The proposed Economic Development Commission would consist of members
from the following organizations as appointed by the Mayor: Mayor, two City
Councilmembers, Chairman of the Chamber of Commerce, President of the
Huntington Beach/Fountain Valley Association of Realtors, three Chief
Executive Officers from companies within Huntington Beach.

Council/Agency are handled in a routine manner, however the members traditionally study all items carefully
before meetings.

PUBLIC HEARING PROCEDURES
This statement has been prepared to provide a better understanding of the procedures for
public hearings before the City Council/Redevelopment Agency.
Regular meetings of the City Council/Redevelopment Agency are held on the first and
third Mondays of each month at 5:00 P.M. (6:30 P.M. for televised portion) in the Council
Chambers. Adjourned meetings and special meetings may be scheduled at other times.
City Council/Redevelopment Agency proceedings are governed by Robert's Rules of Order
and the Brown Act. The following is the typical sequence of events on public hearing
items:
A. The staff report is presented.
B. Questions by the City Council/Redevelopment Agency concerning the staff report
may be answered at this time.
C. The public hearing is opened by the Mayor/Chairman.
D. The applicant or appellant is given an opportunity to address Council/Agency. Time
is not limited but left to the Mayor's/Chairman's discretion.
E. The City Clerk will call all speakers by name. Please proceed to the podium.
Individuals favoring and opposing the proposal are given an opportunity to address
the Council/Agency if the pink form attached to this agenda is filled out and given
to the Sergeant—at—Arms stationed near the podium.** Please state your name
before addressing Council.
F. Council/Agency may ask questions of speakers addressing the Council/Agency.
G. The public hearing is closed.
H. The Council/Agency may discuss the matter at this time.
I. The Council/Agency then acts on the matter by either continuing, approving,
conditionally approving, or denying the petition.

STATEMENT OF ISSUE:
The attached three resolutions call the November 8, 1994, General Municipal Election and request the Board of
Supervisors of the County of Orange to consolidate the city's election with that of the Statewide Election
pursuant to Section 23302 of the Election Code.
If the charter amendment petition currently circulating is filed and qualifies for the ballot, a resolution placing the
measure before the voters will be presented to the Council at a later date.
RECOMMENDATION:

ANALYSIS:
The City Charter provides for city elections to be held pursuant to the State Elections Code. These resolutions
comply with State Code and must be adopted to implement the November 8, 1994, election for four(4) City
Councilmembers and one (1) City Attorney. Resolution No. -Regulations for Candidates' Statements
(200) words will become a perpetual resolution for all ensuing elections.
ALTERNATIVE ACTIONS:
The resolution regarding Regulations for Candidates' Statements sets a 200 word limit rather than 400 words.
Council may select a 400 word limit; however, the cost to the candidate would be much greater- $2,600.00.

ADOPTING REGULATIONS FOR CANDIDATES FOR
ELECTIVE OFFICE PERTAINING TO CANDIDATES'
STATEMENTS SUBMITTED TO THE VOTERS AS AN
ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 1994
WHEREAS, Section 10012 of the Elections Code of the State of California provides
that the governing body of any local agency adopt regulations pertaining to materials prepared
by any candidate for a municipal election, including costs of the candidates statement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH,
CALIFORNIA DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
Section 1. General Provisions. That pursuant to Section 10012 of the Elections
Code of the State of California, each candidate for elective office to be voted for at an election
to be held in the City of Huntington Beach on November 8, 1994, may prepare a candidate's
statement on an appropriate form provided by the City Clerk. The statement may include the
name, age and occupation of the candidate and a brief description of no more than 200 words
of the candidate's education and qualifications expressed by the candidate himself or herself.
The statement shall not include party affiliation of the candidate, nor membership or activity in
partisan political organizations. The statement shall be filed in the Office of the City Clerk at
the time the candidate's nomination papers are filed. The statement may be withdrawn, but
not changed, during the period for filing nomination papers and until 5:00 P.M. of the next
working day after the close of the nomination period.
Section 2. Foreign Language Policy
a. Pursuant to state law, the candidate's statement must be translated and printed
in Spanish at the candidate's request.
b. Pursuant to the Voting Rights Act, the city is required to translate the
candidate's statements into the following languages in addition to English: Spanish and
Vietnamese.
C. The City Clerk shall:
1. Have all candidates' statements translated into the languages specified
in (b) above.
2. Print Spanish and/or Vietnamese translations of candidates who request
printing in all of the voters' pamphlets.
Section 3. Payment.
a. The candidate shall be required to pay for the cost of printing the
candidate's statement in English.
b. The candidate shall be required to pay for the cost of translating the
candidate's statement into any foreign language as specified in (b) above pursuant to state
and/or federal law.

C. The candidate shall be required to pay for the cost of printing the
candidate's statements in a foreign language.
The City Clerk shall estimate the total cost of printing, handling, translating, and mailing
the candidate's statements filed pursuant to this section, including costs incurred as a result of
complying with the Voting Rights Act of 1965 (as amended), and require each candidate filing
a statement to pay in advance to the local agency his or her estimated pro rata share as a
condition of having his or her statement included in the voter's pamphlet. In the event the
estimated payment is required, the estimate is just an approximation of the actual cost that
varies from one election to another election and may be significantly more or less than the
estimate, depending on the actual number of candidates filing statements. Accordingly, the
clerk is not bound by the estimate and may, on a pro rata basis, bill the candidate for additional
actual expense or refund any excess paid depending on the final actual cost. In the event of
underpayment, the clerk may require the candidate to pay the balance of the cost incurred. In
the event of overpayment, the clerk shall prorate the excess amount among the candidates
and refund the excess amount paid within 30 days of the election.
Section 4. Additional Materials. No candidate will be permitted to include additional
materials in the sample ballot package.
Section 5. That the City Clerk shall provide each candidate or the candidate's
representative a copy of this resolution at the time nominating petitions are issued.
Section 6. That all previous resolutions establishing council policy on payment for
candidates statements are repealed.
Section 7. That this resolution shall apply at the next ensuing municipal election
and at each municipal election after that time.
Section 8. That the City Clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

WHEREAS, the City Council of the City of Huntington Beach called a General

members of the City Council and a City Attorney for the term of office which ends November,
1998; and
It is desirable that the General Municipal Election be consolidated with the Statewide
general election to be held on the same date and that within the city the precincts;polling

WHEREAS, under the provisions of the City Charter, a General Municipal Election shall
be held on November 8, 1994, for the election of municipal officers; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH,
CALIFORNIA, DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That pursuant to the requirements of the City Charter, there is called and
ordered to be held in the City of Huntington Beach, California on Tuesday, November 8, 1994,
a General Municipal Election for the purpose of electing four members of the City Council for
