TRANSPARENCY ORDINANCE
STATEMENT OF ISSUE:
Move forward on proposed Huntington Beach Transparency Ordinance with the text that
received consensus by City Council on 8/3/2015
RECOMMENDED ACTION:
Direct the City Attorney to draft a Transparency Ordinance that incorporates the following five
(5) components
1 Independent Negotiator—The City will hire an independent negotiator (when desired)
who is not impacted by any outcome in the negotiation process
2 Cost of Contracts—The City will cost contracts and/or changes to contracts This
ensures an equal playing ground for both labor organizations and the City, as both will
be given the ability to comment about the analysis
3 Offers and Counteroffers—This ordinance would require that all offers and
counteroffers (after the first submitted offer and counteroffer) be disclosed to the public
within 24 hours after they have been acted on
4 Council Disclosure—Each Member of the City Council will be required to disclose any
and all verbal, written, or electronic communications they have had with an official
representative of a recognized employee organization, City staff, or members of the
public in regards to labor contract negotiations
5 Contract Approval—This ordinance will require that before the final proposed contract
is placed on the City Council Agenda, the Memorandum of Understanding will be posted
to the City's website by Agenda Review Monday Additionally, the proposed contract will
be placed on the City Council Agenda as an administrative item on two (2) consecutive
City Council Meetings to insure the City Council, the bargaining units, and the public
have ample time and ability to supply comment

Dear Miss Flynn
Am not sure if my emails to the council and you have reached you or them. I will restate my
question and add another.
I am in support of transparency in collective bargaining and in contract for services.
Recent focus by the council appears to be limited to transparency in collective bargaining.
In listening to council meetings, Council members Posey and Peterson, are championing this
issue and if I understood correctly the City Manager was directed to meet and confer with the
city's various bargaining units to discuss the proposed transparency concept/proposal. The
surf pipeline responder to my email to the council indicated that the city attorney has been
directed to draft an ordinance as the city manager is continuing to meet and confer. Please
clarify the current status and who has been charged to do what and when this will be publicly
discussed.
Also, I noticed that the city website has a transparency section. There are charts on
salaries, benefits, pers contributions, employer contribution, employee contribution. The
charts are helpful but in the spirit of transparency they need some text to explain the pers
portion (what the city is charged, what the city pays, what the employee pays. Is the
formula (2.5% at 55, 3%at 50) negotiated? If so is the formula on the table in current
negotiations?
Lastly, the agenda for the next meeting mentions a workers comp contract. It appears that the
city pays for all we assoicated costs plus an adminstrative fee for claims administration.
The agenda also lists a contract for medical bill review services. Who is the current workers
comp third party administrator? What firms competed for the contract(s) the council is now
reviewing. Who handles workers comp litigation for the city? Another firm? How has the
city fared in workers comp audits by the state? When was the city last audited?

As a 50 years resident of SEHB, I am writing you in support of Agenda item 23:
Transparency Ordinance. SEHB is basically disenfranchised from the political
manifestations of the HBCC. We have no representation and just end up as the
dumping grounds and the failures of City government to solve the problems that
need to be resolved.
Full transparency will enable us the taxpaying residents to see what is really
happening and lessen the back room deals that have happened over the past
50 years.
9 Although we lack a formal voice, we the citizens of SEHB will now be able
to challenge and question the interworking of city government and how it
affects SEHB.
9 We want full disclosure in all negotiations to allow us to weigh the merits of
the decision.
Ethics and Public Service do go together and we the citizens should be
informed
Disqualification based upon financial interests will be exposed and needs to
be
Best Practices should be followed
9 Transparency rules when business is conducted in the open and all meeting
published.
9 Allow the taxpaying public to participate
Allow the taxpaying public to inspect the records

The City Council rightly decided that the builders of the high density housing had overbuilt And
they rightly halved the plan from 4,000 more units to 2000 more units. Then the builders sued to
force the City to accept the 2000 extra units in spite of the fact that the extra traffic and other
factors were definitely against city welfare The builders' priority was for profit, not the health
and welfare of the people of Huntington Beach It has been revealed several times during Public
Comments at City Council meetings that the builders have created housing too dense for even
one human being in the typical apartment. It's space is adequate only for several rats The
research literature amply documents that inadequate living space causes slum behavior and stress
fatalities in the occupants
Why isn't the City countersumg the builders of these hazards to health and welfare9

There is no reason to have issue with full Transparency as it applies to the City of Huntington Beach

Any other methodology is quite frankly nothing more than proof that agenda's do exist at this level
There would be no reason for a City Council Member to vote against Agenda Item 23 (full transparency)
as I believe you, as public officials,would want that on your record as being open and honest

I ask that you too support adding transparency to the process of spending our taxpayer money by voting in favor of the 5
components as stated in the proposed ordinance
1 Independent Negotiator—The City will hire an independent negotiator(when desired)who is not impacted by
any outcome in the negotiation process
2 Cost of Contracts—The City will cost contracts and/or changes to contracts This ensures an equal playing
ground for both labor organizations and the City, as both will be given the ability to comment about the analysis
3 Offers and Counteroffers—This ordinance would require that all offers and counteroffers(after the first
submitted offer and counteroffer)be disclosed to the public within 24 hours after they have been acted on
4 Council Disclosure—Each Member of the City Council will be required to disclose any and all verbal,written, or
electronic communications they have had with an official representative of a recognized employee organization,
City staff, or members of the public in regards to labor contract negotiations
5 Contract Approval—This ordinance will require that before the final proposed contract is placed on the City
Council Agenda,the Memorandum of Understanding will be posted to the City's web site by Agenda Review
Monday Additionally,the proposed contract will be placed on the City Council Agenda as an administrative item
on two(2)consecutive City Council Meetings to insure the City Council,the bargaining units, and the public have
ample time and ability to supply comment
Please do not water down any of the components listed in the proposed ordinance Give us real transparency not just an
illusion

I understand there is an issue regarding transparency within contract negotiations with the city of
Huntington Beach that is currently being addressed by the city council. As a 40+year voting
resident of Huntington Beach, I would like to add my voice to those who are demanding such
transparency I further understand that you promised to vote for Erik Peterson's transparency
ordinance and I expect you to keep that promise
I am not a politically savvy person, and as such, am shocked that this request even needs to be
made Why would transparency in all issues not be a given? Quite unbelievable!
If you uphold your promise, as is expected of elected officials, you can count on my support in
the future I believe there is a growing body of voters in Huntington Beach that are on the verge
of becoming more politically connected Future elections in this city will be much more closely
monitored by the electorate than have been in the past. Please carefully consider your duty to do

employee costs in our city represent 72%of every dollar the city receives When we factor in the 15%
mandated by the voters for infrastructure,that leaves only 13 %of the revenue for everything else I
realize I am not telling you anything you do not already know But that 72% is enormous and
unsustainable It is for this reason that I urge your vote in favor of Agenda Item 23 It is imperative that
the citizens become part of the discussion regarding the public union contracts The contract negotiation
process must become fully transparent to the citizens of our city
In order for transparency to be fully realized all five components of Agenda Item 23 must be fully
implemented In addition, this must become an ordinance, not simply a policy Implementation of

This ordinance would require: 1 an Independent Negotiator during negotiations with City

2. Agenda Item 22, Huntington Beach Manner's Fuel Dock
This items seeks to direct the City Manager to investigate purchase of the Dock, followed by
Request for Proposals for an owner or operator for the dock The owners of the Manner's Fuel
Dock plan to close the dock which is the only local fuel source for Huntington Beach boaters. Its
loss to the approximately 6000 boats it services would have a huge detrimental impact on the
area. The dock is also used by emergency personnel and is an important safety resource for our
City

I have been very concerned about Transparency in salary/benefit and pension negotiations\\
I know that many people with me share that same concern With 70% + of the budget dedicated to
payroll, we are the Titanic and sinking slowly but steady
Therefore item Nr 23 on the agenda for Monday is major important to me I understand that Mr Peterson,
Mr Connell and Mr Sullivan are in favor for Transparency/COIN but in fact all of you should be in favor of
that because sooner or later, you will be a regular member of the HB society and paying the price for
actions you take now
1)we need an independent negotiator whom will not be influenced by Unions or whomever to make a
backroom deal
2) Cost of contracts under city control this way we can make sure that Unions and we the tax payer can
communicate on equal level and therefore can comment about the analysis
3) Negotiations fact this ordinance would require that all offers and counteroffers will be made public
within 24 hours to the public
4)Members of city council have to disclose all verbal and written or electronic communications they had or
will have with and official representative of any employee organization, city staff, public in regards to the
labor contract negotiations

The issue of transparency in negotiations has been a long, long time coming and now
has reached a fever pitch in this community.
Every year, every new council claims they will tackle the issue of unfunded liabilities -
and every year they fail miserably in making any significant improvements. Because
there has been no transparency in negotiating union employee contracts, there has not
been as much pressure on any council (except by those very few in the know) to squash
this problem before it squashes us. In my opinion, it is the single biggest issue in this
city -and the one with the most devastating consequences, if it continues unchecked.
Councilman O'Connell railed against dealing with the employee contracts without
"transparency across the board." We would all like complete transparency in all
negotiations, however, the employee contracts are the ones that are creating the
problems, not others. I can not think of a single contract we negotiate - outside of
employees - where we continue to pay the contractor for 30 or so years after their
service to us is completed. That's the BIG difference. Yes, we'd all like transparency
across the board (an issue that Mr. O'Connell NEVER brought up in his 9 months on the
council, until now), but first things, first. We have to take care of this outrageous and
out of control unfunded liabilities monster before it destroys this city.
I cannot imagine there is a single resident in this city who spends 71% of their personal
budget on ONE item. That would be insane and destructive. Yet, that's what we spend
on employee salaries and benefits and, especially, ridiculously expensive retirement
packages. We have clerical people making more than managers in the public sector and
all employees getting benefits packages that almost no one in the public sector could
ever hope to get. It's not a slight on employees, it's a case of very, very bad financial
planning and management - and that rests directly at the feet of you, the council.
Each and every one of you will be held accountable for this situation and this vote. It will
not be forgotten in the next election cycle and any attempts to water it down or votes
against it will follow you through November. There are too many people who now have
the vehicle to discuss and disseminate what you do and how you vote, and this issue is
an extremely hot topic that will not go away after tonight. If it does not pass, as is,
tonight, the voters of this city will make sure there is a new council to pass it in 2016.
Do your job for all the citizens of Huntington Beach and approve this item.

I would also encourage Councilmember Billy O'Connell to put into action his plan for
complete transparency across the board that he spoke about at the prior council

concerned and against high density housing in Huntington Beach. I have been a resident of
Huntington Beach since 1987, except for about 12 years in Los Alamitos and Seal Beach. My
husband and I own two residences in Surf City at this time. We will be renting our condo out
at 18713 Racquet Ln. And residing at 16901 Saybrook, Huntington Beach Ca. 92649. We think the
apartments on Beach and Ellis are completely ridiculous) That will surely create a traffic
nightmare as those apartments get rented. I urge you, Do not continue on this path that

I believe that the passage of this 'transparency ordinance' is a critical first step in tackling what I
believe is by far our city's most troubling issue, runaway unfunded pension liabilities. These
pensions have grown to such an extent that no one can honestly defend their existence They
were given to us as a result of locked-out public, closed-door, non-transparent negotiations It is
time for this tactic to change
Please put the fiscal health of our city above all else as you consider this Agenda. I ask you to

The unfunded pension liability issue is growing exponentially It seems to impact every decision
this and previous councils make as the council grabs for 'free' money to keep up with this ever-
increasing outflow of our funds. HD Development and the HUD money grab no matter the
consequences are the latest examples of bad policy decisions fueled by this shortage of funds.
