I will restate my question and add another. I am in support of transparency in collective bargaining and in contract for services. Recent focus by the council appears to be limited to transparency in collective bargaining. In listening to council meetings, Council members Posey and Peterson, are championing this issue and if I understood correctly the City Manager was directed to meet and confer with the city's various bargaining units to discuss the proposed transparency concept/proposal. The surf pipeline responder to my email to the council indicated that the city attorney has been directed to draft an ordinance as the city manager is continuing to meet and confer. Please clarify the current status and who has been charged to do what and when this will be publicly discussed. Also, I noticed that the city website has a transparency section. There are charts on salaries, benefits, pers contributions, employer contribution, employee contribution. The charts are helpful but in the spirit of transparency they need some text to explain the pers portion (what the city is charged, what the city pays, what the employee pays. Is the formula (2.5% at 55, 3%at 50) negotiated? If so is the formula on the table in current negotiations? Lastly, the agenda for the next meeting mentions a workers comp contract. It appears that the city pays for all we assoicated costs plus an adminstrative fee for claims administration. The agenda also lists a contract for medical bill review services. Who is the current workers comp third party administrator? What firms competed for the contract(s) the council is now reviewing. Who handles workers comp litigation for the city? Another firm? How has the city fared in workers comp audits by the state? When was the city last audited? Thank you in advance for your response and please forward this email to the entirety of the council. 1 Esparza, Patty From, Dombo, Johanna Sent: Friday, September 18, 2015 11 51 AM To: Agenda Alerts Subject: FW Agenda 23 From:Sylvia Calhoun [mailto skc347@vahoo com] Sent: Friday, September 18, 2015 1122 AM To: CITY COUNCIL Subject:Agenda 23 PLEASE support agenda item 23 and all five listed components Thank you, Sylvia.Calhoun HB resident since 1982 SUPPLEMENTAL COMMUNICATION eeting Agenda Item OVA, Esparza, Patty From: Flynn, Joan Sent: Friday, September 18, 2015 1 37 PM To: Esparza, Patty Subject: Fwd AGENDA ITEM 23 and all components there of SUPPLEMENTAL Joan Flynn, City Clerk COMMUNICATION Huntington Beach M-,-etir:g Date: 2L 020/ Begin forwarded message - zz Agenda Item No. O From: Milt Dardis <mdardis(awerizon net> Date: September 18, 2015 at 11 55 05 AM PDT To: <city.council(asurfcit -h.org>, <jflynnksurfci -hb org>, <cfikes e surfcrty-hb.org> Cc: 'Milt Dardis' <mdardis(2verizon net> Subject: RE: AGENDA ITEM 23 and all components there of Highly Honorable Mayor Hardy and Distinguished Members of the HB City Council: As a 50 years resident of SEHB, I am writing you in support of Agenda item 23: Transparency Ordinance. Then the builders sued to force the City to accept the 2000 extra units in spite of the fact that the extra traffic and other factors were definitely against city welfare The builders' priority was for profit, not the health and welfare of the people of Huntington Beach It has been revealed several times during Public Comments at City Council meetings that the builders have created housing too dense for even one human being in the typical apartment. Every year, every new council claims they will tackle the issue of unfunded liabilities - and every year they fail miserably in making any significant improvements. Because there has been no transparency in negotiating union employee contracts, there has not been as much pressure on any council (except by those very few in the know) to squash this problem before it squashes us. In my opinion, it is the single biggest issue in this city -and the one with the most devastating consequences, if it continues unchecked. Councilman O'Connell railed against dealing with the employee contracts without "transparency across the board." We would all like complete transparency in all negotiations, however, the employee contracts are the ones that are creating the problems, not others. I can not think of a single contract we negotiate - outside of employees - where we continue to pay the contractor for 30 or so years after their service to us is completed. That's the BIG difference. Yes, we'd all like transparency across the board (an issue that Mr. O'Connell NEVER brought up in his 9 months on the council, until now), but first things, first. We have to take care of this outrageous and out of control unfunded liabilities monster before it destroys this city. I cannot imagine there is a single resident in this city who spends 71% of their personal budget on ONE item. That would be insane and destructive. Yet, that's what we spend on employee salaries and benefits and, especially, ridiculously expensive retirement packages. We have clerical people making more than managers in the public sector and all employees getting benefits packages that almost no one in the public sector could ever hope to get. It's not a slight on employees, it's a case of very, very bad financial planning and management - and that rests directly at the feet of you, the council. Each and every one of you will be held accountable for this situation and this vote. It will not be forgotten in the next election cycle and any attempts to water it down or votes against it will follow you through November. There are too many people who now have the vehicle to discuss and disseminate what you do and how you vote, and this issue is an extremely hot topic that will not go away after tonight. If it does not pass, as is, tonight, the voters of this city will make sure there is a new council to pass it in 2016. Do your job for all the citizens of Huntington Beach and approve this item. I Agenda Item 23 —Transparancy Ordinance Recently, you as the sitting Council have moved toward greater transparency and I applaud your efforts I believe each of you has at one time or another pledged your support for transparency in our City government. Failure to adopt this Ordinance would send a message that those pledges are not sincere, making adoption vital I agree with those who have said that we should open up more City contracts to the transparency envisioned by this ordinance, but urge you not to delay as the timing is critical for contract negotiations. Instead, I am hopeful one of you will introduce an item expanding the Transparency Ordinance in the near future I am especially pleased this is being presented as an Ordinance and not a just an policy with no teeth 2. Agenda Item 22—Manner's Fuel Dock I have spoken with dozens of people in the Huntington Harbour Community who are grateful that the City has stepped forward and is working to assure a fuel dock remains as a vital resource in Huntington Beach. These pensions have grown to such an extent that no one can honestly defend their existence They were given to us as a result of locked-out public, closed-door, non-transparent negotiations It is time for this tactic to change Please put the fiscal health of our city above all else as you consider this Agenda. I ask you to support Agenda Item 23,the 'Transparency Ordinance' with the five listed components 1) The City will hire an Independent Negotiator (when necessary) who is not impacted by any outcome in the process 2) Cost of Contracts . the City will cost contracts and/or changes to contracts thereby ensuring an equal playing field for both labor and the City as both will be given ample opportunity to comment about the analysis. 3) Offer and Counteroffers. require all offers and counters be disclosed to the public within 24 hours after they have been acted on 4) Council Disclosure each member of the CC will be required to disclose any and all communications they have had with an official representative of a recognized employee organization, City staff or members of the public in regards to labor contract negotiations 5) Contract Approval.. . requires that before the final proposed contract is placed on the City Council Agenda, the Memorandum of Understanding will be posted to the City's website Also, the proposed contract will be placed on the City Council Agenda as an administrative item on two consecutive CC Meetings to insure the City Council, the bargaining units and the public have plenty of time to offer comment The unfunded pension liability issue is growing exponentially It seems to impact every decision this and previous councils make as the council grabs for 'free' money to keep up with this ever- increasing outflow of our funds. HD Development and the HUD money grab no matter the consequences are the latest examples of bad policy decisions fueled by this shortage of funds. 1 Please stop the madnessf Summon up the courage to Contract Approval—This ordinance will require that before the final proposed contract is placed on the City Council Agenda, the Memorandum of Understanding will be posted to the City's web site by Agenda Review Monday Additionally, the proposed contract will be placed on the City Council Agenda as an administrative item on two (2) consecutive City Council Meetings to insure the City Council, the bargaining units, and the public have ample time and ability to supply comment. This issue is, perhaps, the most critical step in correcting a downward spiral that has been slowly and painfully destroying Huntington Beach, along with nearly every city, county and, frankly, the entire state of California as well as many other states Full, unencumbered TRANSPARENCY is the only path to correcting the 10,000 lb gorilla in the room...unfunded liabilities Lack of transparency has created a never-ending cycle of bad decisions, lack of accountability and a completely unsustainable future, not only for the taxpayers, but also for the folks who stand to lose their future pensions. I urge you to lead boldly on this issue Please support Full Transparency and the five components listed above and help save the future of our great cityl 1 Respectfully, Terry&Arlene Ferguson Expected Close Date: September 24, 2015 Click here to access the request Note This message is for notification purposes only Please do not reply to this email Email replies are not monitored and will be ignored. 2 Esparza, Patty From, Flynn, Joan Sent.
