Statement of Issue: Should the city appropriate $80,000 to test for hazardous soil, clean
up the piles of dirt caused by illegal dumping, and secure the undeveloped portion of
Huntington Central Park?
Funding Source: Unappropriated General Fund Balance
Recommended Action:
1. Approve an amendment to the current year budget by appropriating $80,000 for the
cleanup and securing of the undeveloped portion of HCP to prevent illegal dumping;
2. Authorize the City Administrator to approve a purchase order for L.T. Excavating, Inc. in
the amount of$38,308 as a contract for this work by an affirmative vote of at least five
Council members;
3. Authorize staff to post signs prohibiting illegal dumping, install barricades as
necessary to prohibit access to the former landfill site, and repair drainage systems as
necessary to comply with the California Regional Water Quality Control Board
regulations; and
4. Direct staff to review and recommend to Council a change in the city ordinance that
would require greater penalties for illegal dumping on public property.
Alternative Action(s): Do not proceed with proposed cleanup and securing of an
undeveloped portion of HCP. City will be at risk of a $1,000 per day fine from the California
Regional Water Quality Control Board.
Analysis: In October, 1996, the city received notice from the California Regional Water
Quality Control Board (CRWQCB) that the city was in violation of state law regarding
illegally dumped material in the undeveloped portion of HCP formerly known as the

Huntington landfill. Approximately four years ago, the city complied with state regulations for
water quality control by importing and compacting soil in this undeveloped portion of HCP to
maintain the required slopes to insure runoff and uncontamination of ground water. Since
that time, the city has experienced an increasing degree of illegal dumping on this site.
Even though the site has been fenced, swimming pool contractors, landscape contractors,
and developers have continued to use the site as a dump instead of hauling their material to
an authorized landfill site. Since some of the illegally dumped material is asphalt and
concrete, it can't be spread on-site. The state requires the city to test the material and
dispose of all nonhazardous material to a certified disposal site. The cost to do the soils
testing, cleanup and soil disposal is $27,500. The estimated quantity of soil cleanup is
approximately 2,000 cubic yards.
In an effort to prevent recurrence of illegal dumping, staff is also recommending that the site
be secured by repairing broken fencing, adding additional fencing, and installing signs that
will allow the Police Department to enforce illegal dumping on-site. Over the past thirty
days, staff has been monitoring the site for illegal dumping and has found that a majority of
the dumping is being done at night and on weekends. Once the area is cleaned, secured
and posted, the Police Department and the Park Ranger can begin strict enforcement of the
dumping ordinance. However, staff cannot guarantee that future illegal dumping will not
take place. It will continue to be a problem until the city proceeds with the construction of
the undeveloped portions of Central Park. As long as these areas are vacant, they are an
open invitation for illegal dumping.
The total contracted price for soil testing, cleanup and disposal; and, fence repair, relocation
and new fencing is approximately $38,308. However, staff is recommending an appro-
priation of $80,000 to cover the cost of signs, drainage repair, installation of possible
barricades, and a contingency in the event that during the testing process, hazardous
material is found on-site. Because of the urgent necessity to comply, staff obtained informal
bids instead of formal bids pursuant to the City Charter which states:
All public works contracts exceeding the sum of Twenty-five Thousand
Dollars ($25,000) may be let and purchases exceeding the sum of
Twenty-five Thousand Dollars ($25,000) may be made without adver-
tising for bids if such work or the purchase of such materials or supplies
shall be deemed by the City Council to be of urgent necessity for the
preservation of life, health, or property and shall be authorized by at
least five affirmative votes of the City Council.
Attached are communications between the city and the CRWQCB regarding this issue and
the timeline in which the city must comply. The CRWQCB is allowed to impose up to a
$1,000 a day fine for noncompliance. Consequently, staff is recommending that the city
proceed with the above described remedy in the most expeditious manner.

After reviewing Don Noble's memorandum, dated December 23, 1996, 1 scheduled an on-site
job walk, January 8, 1997, with three qualified licensed contractors. Attached for your review
and action are three informal bids obtained from the licensed contractors to remove the
illegally dumped material and perform the required fence work to secure the site from future
illegal dumping activity. The following is a summary of the bids received:
I. L,T Excavating, Inc., Laguna Niguel, CA $38,308.65
II. Durda Equipment Rental Inc., Htg. Bch, CA $79,553.00
III. Wakeham-Baker Inc., Fountain Valley, CA $107,700.00
In general, the bids are consistent and each identifies similar exclusions. This same sort of
large variation in bids from low to high, occurred not to long ago when bids were obtained for
some emergency earthwork at the Horse Stable de-silting basin. L.T. Excavating came in low
as well by more than fifty percent. They were given the work and performed very well.
If the decision is made to use L.T. Excavating, a minimum $10,000 dollar contingency is
recommended to offset any of the possible exclusions, identified in their bid, that might occur
during the progress of work. In addition, a maintenance item amount, similar to that of Blufftop
Park temporary fence, should also be considered.
Should you want to discuss this matter further, let me know. Keep in mind, the CRWQCB did
grant a 90 day time extension giving the City until the end of March to complete the work.

MONTHLY PROGRESS REPORT- JANUARY 1997
Dear Ms. Lee,
Pursuant to the Board letter, dated January 13, 1997, the following monthly progress report is hereby
submitted for your review.
City staff has estimated the quantity of the illegally dumped material at 2000 cubic yards. The site
needs approximately 615 lineal feet of new six foot high chain link fencing. Approximately 375 lineal
feet of existing six foot high chain link fencing needs repair. In addition, 300 lineal feet of six foot
high chain link fencing, along with an entrance gate, needs relocation. All this fencing improvement
should prevent and discourage future illegal dumping activity once implemented.
To date, items one and two of the City's workplan have been completed. On January 8, 1997, the City
scheduled an on-site job walk with three qualified licensed contractors and requested bids to perform
the required remedial work. On January 14, 1997, three bids were received and ranged in amounts
from $38,000 to $107,700. City staff is preparing to bring this issue before the City Council and
request expenditure authorization, not to exceed $50,000, at the regular scheduled meeting of February
18, 1997. Once approved by City Council, staff will issue a Notice to Proceed to the General
Contractor authorizing the prosecution of work. The work is anticipated to take five to ten working
days to complete.

PROPOSED WORKPLAN FOR IMPLEMENTATION OF REMEDIAL ACTIVITIES AT
HUNTINGTON BEACH LANDFILL
Dear Mr. Stack:
We have reviewed the above proposed workplan, dated December 20, 1996, for the
removal, disposal, and prevention of illegal dumping at the Huntington Beach Landfill,
and have the following comments:
1. You have proposed a 90-day extension from the January 3, 1997 deadline to
remove all illegally disposed material at the landirli_ This 90-day time extension
also includes the Installation of a new chain link IE7nce to prevent future illegal
dumping at the site. The time extension is needed to obtain City Council
authorization for funding for the required remedial works. The 90-day time
extension is hereby granted; all remedial activities to remove illegally disposed
materials at the site and to prevent future illegal dumping must be implemented
by April 4, 1997. Please submit a monthly progress report on the remedial
activities to us by the end of January, February, and March. We further
request that you notify us In writing within 30 days after the completion of the
remedial works at the site.
2. The proposed workplan does not outline the steps the City will take should
Illegal dumping continue In the interim and after the installation of new chain link
fence. Please submit this information to us with the first monthly progress
report due January 31, 1997.
3. We concur with your opinion that the slit fence and the plastic downdraln are
not necessary now that there is vegetation on the slope. These structures may
be removed. However, the entrance to the landfill at Talbert Avenue must be
graded and compacted now to prevent sediment transport into the parking lot of
the library.

WORKPLAN FOR IMPLEDIENTATION OF REMEDIAL ACTIVITIES
Dear Ms. Lee,
The City is in receipt of your letter, dated October 23. 1996. concerning the closed Huntington
Landfill. located at Golden West Street and Talbert Avenue. Pursuant to that letter and your
subsequent transmittal memo, dated December 17, 1996, I have met with the appropriate city staff to
help determine a course of action to comply with your request for remedial activities regarding this
site.
The dumping issue is a somewhat more complex then it seems. Because the piles literally show up
overnight by illegal dumping activity, simply remm ing them does not provide for any real long term
Solution to the problem. In these times of very tight fiscal constraints, we wish to avoid spending time
and money inefficiently. In addition, any approved remedial activities will require City Council
approval for the authorization of funds.
The following workplan, for the removal, disposal, and prevention of illegal dumping together with the
implementation of remedial erosion control, is hereby submitted for Regional Board review and
approval.
I. Determine the quantity of material illegally dumped and the required linear footage of chain
link fence to secure the site.
2. Obtain informal bids for the removal and legal disposal of the illegally dumped material,
improve sediment control in the area of the downdrain, installation of new chain link fencing
together with some minor relocation of existing fencing to prevent future illegal dumping
activity, and removal of all damaged silt fencing. The existing silt fencing was never a long
term measure for erosion control. Its only intention was to minimize and help prevent
sediment transport during the plant establishment of the hydroseeded slopes of the landfill.
3. Obtain City Council authorization for funding the required work.
4. Issue notice-to-proceed to general contractor to complete the work.

While our intention is to provide both short term and long term mitigation to the problem, it is not
possible for the city to accomplish it in the time frame specified by you. However, staff is already
working on estimating the quantities identified above and obtaining informal bids. We therefore
request a 90 day time extension to complete the required work, with the intent of being in full
compliance as soon as possible.
As a side note. the plastic downdrain mentioned in your letter, was an emergency measure brought on
by the winter rains of January 1995. That event, if you recall, was declared, not only by the State of
California, but by the Federal government, as a natural disaster. Those intense rains occurred when
little to no vegetation existed on the site. Today. the site is quite different and has a well established
vegetation base to help prevent sediment transport. It's questionable if this downdrain is even useful.
We trust submittal of this proposed workplan demonstrates our intent to work with the Board to

FACILITY INSPECTION, BRUCE BROS. PIT, CITY OF HUNTINGTON BEACH,
ORDER NO. 81-12
Dear Mr. Larkin:
On October 9, 1996, Joanne Lee of my staff conducted a facility inspection of the
Bruce Bros. Pit (BBP) Landfill and the adjacent City-owned landfill, which was formerly
operated by the County of Orange, Integrated Waste Management Department. The
purpose of the inspection was to determine site compliance with Order No. 81-12.
Order No. 81-12 was adopted by the Board for inert waste landfilling operations at the
BBP Landfill. Mr. Don Noble of the City of Huntington Beach, Public Works Division,
was present during the inspection. Several areas of concern were observed and
discussed with Mr.,Noble during the inspection, and are summarized below:
1. Erosion and Sediment Control
Erosion and sediment control measures such as the plastic downdrain and the
silt fence located around the north and northwest sides of the site were
damaged (see attached site map). These measures must be repaired and
properly maintained to minimize the discharge of sediment in stormwater
discharges from the site. In addition, erosion control measures for the. acCes,
road at the Talbert Street entrance to the landfill must be implemented to
minimize the transport of sediment in the stormwater discharges from the site.
2. Illegal Disposal
Numerous soil, woodwaste, and asphalt concrete waste stockpiles were found
on-site, outside the BBP Landfill, at locations shown on the attached site map.
Mr. Noble informed me at that time that he had no knowledge of these
stockpiles and suspected-that they might be illegally disposed of at the site.
Woodwaste and asphalt concrete waste may be disposed of at the BBP
Landfill. The soil stockpiles must be analyzed and disposed of appropriately at
authorized disposal facilities. If the soil stockpiles are determined to be
nonhazardous, they may be disposed of at the BBP Landfill. However, if
additional time is needed to determine appropriate disposal alternatives for the

soil stockpiles, they may be left on-site temporarily, and covered with
impermeable material such as plastic sheeting to protect them from
precipitation. In addition, the City must implement site security measures to
prevent and discourage future illegal dumping at the site. Please be aware that
illegal disposal at the site is a nuisance and is in violation of Discharge
Specifications A.1. and A.2. of Order No. 81-12. Any violations of waste
discharge requirements may result in enforcement actions by the Regional
Board.
By November 6, 1996, please submit a workplan to address the above areas of
concern. All erosion and sediment control measures must be implemented by
November 30, 1996 to prepare the site for the winter rainy season.
