In order to proceed, the City is required to appropriate matching funds for the project. Funding Source: The funding source is the unappropriated Redevelopment Agency Fund Balance, Fund 305 for the match of the approved FEMA Grant. The FEMA funding is a grant that will be funded by revenues not anticipated in the original budget and will not affect the fund balance of any other fund. Recommended City Council Action: Motion to: 1. Approve the acceptance of the FEMA Grant for 75% reimbursement (not to exceed $3 Million Dollars) of the cost to study, design, manage and construct the seismic strengthening of the Administration Building at City Hall; and 2. Approve the appropriation of $4 million from the Unappropriated Redevelopment Agency Fund Balance, Fund 305; and 2. Adopt Resolution No. �656 Agreeing to pay certain costs related to the seismic rehabilitation of the Administration Building of City Hall and making certain determination and findings pursuant to Health and Safety Code Section 33445. Alternative Action: Motion to: 1. Direct staff to not accept FEMA Grant and not request appropriation from Redevelopment Agency fund balance. 2. Analysis: City Hall's five-story Administration Building was designed and built to the seismic standards that existed in the early 1970's. The building has performed well under a number of small earthquakes with no appreciable damage. The building represents a substantial asset and the expectation is that the building will continue to be occupied for many years to come. Since the Administration Building is very close to the Newport-Inglewood Fault, a structural engineering firm was hired to determine how our building would handle a strong earthquake. The reason only the Administration Building was studied is that its height, age and structural system are similar to many in the Western United States that have been identified as having possible earthquake problems. In addition, the other buildings on the site have structural systems that are safer in an earthquake. In 2003, the City contracted with Saiful/Bouquet, a respected structural engineering firm, to perform a preliminary seismic performance evaluation of the Administration Building. Their report identified a number of substantial issues that need to be addressed to assure a safe building for the future. When it comes to the words "safe" and "earthquakes" it is always a relative topic. In this case, our initial objective was to ensure that City Hall would suffer very little damage and be able to be occupied immediately after an earthquake; this standard is called "immediate occupancy". The engineer's evaluation states that "immediate occupancy", would be equivalent to constructing a new building with a projected cost of over $14 million. In fact, we believe the replacement cost would be $20 million or more when you consider moving to a separate facility during construction. Due to the substantial cost of using the immediate occupancy standard for the design, the proposed solution became what is called "life-safety". This is a common design standard for existing buildings when bringing the building up to current code is not feasible. "Life-Safety" is essentially a method of making the building safe for the occupants so they can escape without harm but the building may sustain substantial damage. So if we do have the largest -2- 11/14/2005 6:36 PM • REQUEST FOR ACTION MEETING DATE: 11/21/2005 DEPARTMENT ID NUMBER:BD 2005-06 earthquake that the scientific community believes is possible and we are close to the epicenter, the design goal of "life-safety" would prevent the loss of life but could render the building unusable. On a more positive note, if we experience a smaller earthquake, which is more probable, the "life-safety" design would not only protect the occupants but the building as well. The engineering evaluation was revised in February 2005 to estimate the total costs for the proposed life-safety solution. The evaluation estimates the design, management and construction costs to be $5,879,517. Due to the uncertainty of the final design, the cost for construction materials, the complexity of this project and the issues associated with an existing building, staff is recommending a total estimated project cost of $7 million. This number will need to be reevaluated when the construction drawings are complete and the costs can be projected more accurately. Staff has been pursuing government grants so the City would not bear the full cost. This was communicated to Council in the form of an information report RCA on December 20, 2004. After a competitive process we were successful in being granted $3 million dollars from FEMA to help accomplish this project. This grant officially started September 9, 2005 and we have up to 3 years to complete the project. This FEMA Grant was justified solely under their Pre-Disaster Mitigation Program. The money cannot be used for anything other than the scope items that are needed to strengthen the Administration Building. The City will receive the funds from FEMA only as a reimbursement thus we will be "fronting" the money then applying for a 75% reimbursement. For the accumulative reimbursements the City will receive up to $3 million as FEMA's portion of the project. This project will have many phases. If the money is appropriated, we will be sending RFQ's out for the design services for this project by the end of November. Once we contract with an engineering firm and they develop the final proposed solution to strengthen the Administration Building, we will be submitting the design to the Design Review Board. In addition to this, we anticipate one or more study sessions with City Council to present elevations of the proposed design and the architectural treatments. This will be done before we allow the engineer to proceed with construction drawings. The construction of the project will be challenging. A substantial amount of the work will be on the exterior and the interior areas will be handled by working after hours or relocating limited areas for hopefully short periods of time. A project team has already been formed and Building and Safety will be leading the project team to the completion of construction drawings, then Public Works will be leading the project team through the construction phases. -3- 11/14/2005 6:36 PM REQUEST FOR ACTION MEETING DATE: 11/21/2005 DEPARTMENT ID NUMBER:BD 2005-06 Additional Funding Information: The Redevelopment Agency negotiated a participation payment agreement with the developer of the Hyatt Residential component, which will generate one-time revenue to the Redevelopment Agency based upon sales of Sea Colony and Sea Cove homes built to the north of the Hyatt Regency Huntington Beach Resort and Spa. This revenue can only be used for projects within the Redevelopment Project Area or which will benefit the Redevelopment Project Area, per California Redevelopment Law. To date, about $13 million has been received by the Redevelopment Agency for these specific uses. Seismic strengthening of the City Hall Administration Building meets all eligibility criteria. California Health and Safety Code Section 33445 requires that, with the consent of the City Council and the Redevelopment Agency, the Agency may pay all or part of the cost of installation and construction of any publicly-owned facility either within or outside a project area. The Agency's agreement to pay the balance of the costs for the project constitutes an indebtedness of the Agency for the. purpose of carrying out the redevelopment for Project Areas, and no portion of the payment provided by the Agency may be derived from tax increment funds, but wholly from the one-time participation payment revenues. FEMA has a Grant Program that can provide up to 3 million dollars in matching funds for improving the seismic capacity of government buildings. Staff hired an outside structural engineering firm to perform a preliminary seismic analysis of the Administration Building to determine if there were any obvious deficiencies that should be corrected. This analysis indicates that the structure should be strengthened to assure the building remains safe for the future. We plan on completing the application for the Grant and will be returning to Council to request approval for the matching funds that will be between 2 and 3 million dollars. If we are successful with the Grant, we then will have 5 to 6 million dollars to accomplish the strengthening program. REQUEST FOR ACTION MEETING DATE: December 20, 2004 DEPARTMENT ID NUMBER:BD2004-05 Analysis: City Hall was designed and built to the standards that existed in the early 1970's. In fact in some respects the actual design exceeded the standards that were required at that time. The complex has performed well under a number of seismic events with no appreciable damage and there is no reason to believe that the building is unsafe to occupy. The complex represents a substantial asset and the expectation is that the building will continue to be occupied for many years to come. In order to assure that this asset is protected, it is prudent to review its ability to sustain a probable earthquake centered close to the building as currently predicted by the scientific community. The fault that would be used in this study is the Newport/Inglewood fault since it runs very close to City Hall. In order for the City to know the issues that should be addressed, staff contracted with a structural firm to perform a preliminary seismic performance evaluation of the Administration Building. This report does identify a number of issues that should be addressed to assure a safe building for the future. The cost for the design, construction and other issues will be between 5 and 6 million dollars. This is substantially less than replacing the building. So that the City would not bear the full cost, staff has been pursuing government grants. One such grant that looks promising is a FEMA grant that can provide up to 3 million dollars. We plan to pursue the grant process and the application period closes the end of February. We will be returning to Council for authorization of the estimated 2 to 3 million dollars in matching funds. This would then provide 5 to 6 million dollars to accomplish the seismic strengthening of City Hall and assure that the structure would be safe well into the future. FEMA has a Grant Program that can provide up to 3 million dollars in matching funds for improving the seismic capacity of government buildings. Staff hired an outside structural engineering firm to perform a preliminary seismic analysis of the Administration Building to determine if there were any obvious deficiencies that should be corrected. This analysis indicates that the structure should be strengthened to assure the building remains safe for the future. We plan on completing the application for the Grant and will be returning to Council to request approval for the matching funds that will be between 2 and 3 million dollars. If we are successful with the Grant, we then will have 5 to 6 million dollars to accomplish the strengthening program. REQUEST FOR ACTION MEETING DATE: December 20, 2004 DEPARTMENT ID NUMBER:BD2004-05 Analysis: City Hall was designed and built to the standards that existed in the early 1970's. In fact in some respects the actual design exceeded the standards that were required at that time. The complex has performed well under a number of seismic events with no appreciable damage and there is no reason to believe that the building is unsafe to occupy. The complex represents a substantial asset and the expectation is that the building will continue to be occupied for many years to come. In order to assure that this asset is protected, it is prudent to review its ability to sustain a probable earthquake centered close to the building as currently predicted by the scientific community. The fault that would be used in this study is the Newport/Inglewood fault since it runs very close to City Hall. In order for the City to know the issues that should be addressed, staff contracted with a structural firm to perform a preliminary seismic performance evaluation of the Administration Building. This report does identify a number of issues that should be addressed to assure a safe building for the future. The cost for the design, construction and other issues will be between 5 and 6 million dollars. This is substantially less than replacing the building. So that the City would not bear the full cost, staff has been pursuing government grants. One such grant that looks promising is a FEMA grant that can provide up to 3 million dollars. We plan to pursue the grant process and the application period closes the end of February. We will be returning to Council for authorization of the estimated 2 to 3 million dollars in matching funds. This would then provide 5 to 6 million dollars to accomplish the seismic strengthening of City Hall and assure that the structure would be safe well into the future.
