W I T N E S S E T H WHEREAS, in accordance with the provisions of Section 1770 of the Labor Code, CITY has ascertained the general prevailing rate of wages applicable to the work covered by this contract as more partic- ularly set forth in a resolution of the City Council of the City of Huntington Beach, a certified copy of which resolution is on file in the office of the City Clerk and made a part hereof and designated as Resolution No. 3707, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH SPECIFYING THE PREVAILING RATES OF PER DIEM WAGES OF PUBLIC WORKS CONTRACTS" WHEREAS, HBPFC pursuant to statutes in such cases made and provided, duly and regularly caused a notice to be published, calling for bids for labor, material, tools and equipment for the monitoring operating, and maintaining mechanical systems in the Civic Center Complex and Library in the City of Huntington Beach, California, said work to be constructed according to plans, specifications, general requirements, and special provisions for same prepared by Nack and Sunderland, Mechanical Engineers on file in the office of the Director of Public Works and adopted by HBPFC on the 29th day of August, 1973, to which said plans, specifications, general requirements, and special provisions reference is hereby made, and by such reference they are made a part of this contract as if herein set out in full; and WHEREAS, CITY and HBPFC at a regular meeting thereof and at the time and place appointed therefor received the report of the results of the bids submitted by the respective bidders for the construction and completion of the above mentioned work, and after careful con- sideration of all bids submitted CITY and HBPFC awarded the contract therefor to the Contractor therein named at the prices set forth in his bid, it being the lowest and best bid received by CITY and HBPFC, NOW THEREFORE, in consideration of the covenants and agree- ments herein contained, being done and performed by the parties hereto, it is hereby agreed as follows: I. By my signature hereunder, as Contractor, I certify that I am aware of the provisions of Section 3700 of the Labor Code which require every employer to be insured against liability for Workmen' s Compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions before commencing the performance of the work of this contract. II. Contractor agrees to receive and accept as full compensation for furnishing all materials and for doing all the work contemplated and embraced in this agreement, the total bid amount Contractor sub- mitted in his proposal which was accepted by CITY and HBPFC. A copy of said proposal is attached hereto and incorporated herein by reference and made a part hereof. Contractor further agrees that said payment by CITY and HBPFC shall include all payments for all loss or damage arising out of the nature of the work aforesaid, or from the action of the elements, or from any unforeseen difficulties Page - - or obstructions which may arise or be encountered in the prosecution of the work until its acceptance by CITY and HBPFC, and for all risks of every description connected with the work; also for all expenses incurred by or in consequence of the suspension or discontinuance of work and for well and faithfully completing the work, and the whole thereof, in the manner and according to the plans and specifications, and the requirements of the Engineer under them. III. CITY and HBPFC agrees with the said Contractor to employ, and does hereby employ, the said Contractor to provide the materials and to do the work according to the terms and conditions herein con- tained and referred to, for the prices aforesaid, and hereby contracts to pay the same at the time, in the manner and upon the conditions as set forth in the general requirements and the said parties for themselves, their heirs, executors, administrators, successors and assigns, do hereby agree to the full performance of the covenants herein contained. IV. It is further expressly agreed by and between the parties hereto that should there be any conflict between the terms of this instrument and the bid or proposal of said Contractor, then this instrument shall control and nothing herein shall be considered as an acceptance of the said terms of said proposal conflicting herewith. V. Bid Bond. The Contractor further agrees that his proposal was accompanied by a bidder's security in an amount equal to ten percent (10%) of his bid in accordance with California Government Code, Section 37931 et seq. VII. California Fair Employment Practice Act. The Contractor agrees to utilize fair employment practices in accordance with California Labor Code, Section 1410 et seq. VIII. CITY and HBPFC agree that the provisions and covenants of this contract shall and must be in accordance with the provisions of the Lease and Sub-Lease entered into by the CITY and HBPFC on September 1, 1971, and in no way shall the provisions of the Lease and Sub-Lease be amended. IX. CITY and HBPFC and Contractor agree the following bid items of the proposal for the work have been accepted and are incorporated into the contract work for the amounts set forth in the bid: ITEM lA - Base Bid lA - Furnish and install Civic Center Mon- itoring and Operating System. RECOMMENDED ACTION: The City Council approve the expenditure of an estimated $28 ,000 by the Public Facilities Corporation for the following items: 1. There is no sign indicating that the Central Library is indeed a library. Signing for this had been designed at the time of construction by the architect working with the library. The building needs to be identified at both Golden West and Gothard. 2. With the number of exhibits and displays in which the library becomes involved, considerable time could be saved and wall damage eliminated if there were a simple track placed near the ceiling allowing pictures to be hung and removed with ease. 3. An announcement panel is currently being used as a portion of a permanent wall for the Art and Bookstore. This should be changed in that it is at best a make- shift arrangement and does not allow for best use of either the store or announcements . 4 . A security system in the library would not only pro- tect those items that disappear with increasing frequency but it would also eliminate the exaspera- tion of both staff and patrons when attempts are made to find critical information no longer there. As requested, a more detailed breakdown of the estimated costs and an explanation of the needs are attached along with excerpts of the original documents indicating original estimated costs and design layouts . A 10% per year. inflation factor has been added. RECOMMENDED ACTION: That City Council permit PFC to review and correct problem areas. ANALYSIS: Exterior Signs: There are no signs identifying the library in any way. Exterior signing was originally bid for one illuminated sign at the entrance to the library, $4,400, and for three non- illuminated signs at Goldenwest, Gothard and the library drive entry off Talbert, $1,800 each. It is estimated that the illuminated sign would cost $6,400 and $2,600 for each non-illuminated sign. In that building identity is important for the hundreds of people visiting the library, it is recommended that a minimum of two non- illuminated signs be considered for the corners of Goldenwest and Talbert and Gothard and Talbert. Estimated cost $5, 200. Display Wall: The east wall of the Bookstore is currently com- prised of a mobile display panel designed to be used as an area from which pamphlets, flyers, posters and other ephemeral materials could be placed and picked up by the public. At the time of con- struction, the original wall was withdrawn from the design because there was some concern regarding the methods used to stabilize it As a temporary alternative, the display panel was installed. The Bookstore Committee of the Friends of the Library have expressed a continued dissatisfaction with the temporary wall and the lack of visibility it gives them. D � I Display Wall ((, -it.) In addition, indications are that the Sister City Program will accumulate items of interest that should be displayed properly in the library. A glass wall of lockable display units would solve both problems. Estimated cost $2 ,900 . Picture Molding: As a cultural center, several displays of aintings are exhibited regularly in the library. If picture molding were attached to the wall at ceiling height, paintings could be hung and removed with ease without the disfiguring process of pounding nail holes in the walls and the attendant time and labor involved. Approximately 800 feet of anodized picture molding at $1.05/ft. is required. Estimated cost $840 . Installation 400 . Total cost $1,240 . Book Detection System: This system prevents individuals from leaving the building through public exits with unauthorized materials. It can protect books, records, cassettes and period- icals by placing a "signalized" strip of tape within the item which sets off an alarm system if normal checkout procedures are not followed. The library has had over $3,000 worth of phonograph records missing from theft and an equal amount in books. Assuming the system would reduce losses by 75%, the system would pay for itself in about three years. The public expects to find essential reference and periodical materials on the shelves; theft prevents us from supplying these needs in a timely manner. The Genealogical Society of Orange County, who house their materials within the library, report that several donators of valuable materials have been reluctant to do so for fear of loss. The system would reduce that fear. Estimated cost $ 6,100. Gates 565. Bookcheck unit 2,400 . Installation 400. Freight 200. Book detection strips 2,500 . Total cost $12,165. BOX 190 CALIFORNIA 92648 ENGINEERING DEPARTMENT October 27,1973 Honorable Mayor and City Council City of Huntington Beach,California; Board of Directors of The Huntington Beach Public Facilities Corporation Subject : Civic Center and Central Library Mechanical Systems Monitoring and Maintenance Contract CC-268 Gentlemen: The bid proposal from Honeywell Corporation was received at the advertised time,and was opened at 2:00 P.M. on October 25,1973 •The proposal items and quotations have been reviewed and found to be in order and satisfactory. The Honeywell bid was the only proposal submitted,however interest was shown by three additional companies during the bid period.The company reasons for no submittal by these three firms are known,and without divulging names,the reasons are as follows; one could not perform all the phases of the contract,one could not receive a committment from management to fund a portion of the contract in anticipation of future customers,and the third was experiencing internal problems. Therefore,it is recommended that your honorable bodies accept the bid and award the contract to The Honeywell Corporation. The contract must be a three party document due to the fact the work involved includes fixed equipment to be funded by the Corporation and maintenance over five years to be funded by the City. A brief summary of prior events and decisions follows in order that you may understand the necessary separated funding along with accounting summary sheets indicative of the amounts. -1- During the latter portion of 1972 and spring of 1973 , the Department of Public Works began accumulating information for a system to monitor,operate,and afford protection for the major portions of over one million dollars worth of heating and air conditioning equipment in the Civic Center and Library.Approval was obtained to employ Nack and Sunderland,mechanical engineers, to prepare a preliminary study,estimate,and subsequent specifications. The report was completed in May 1973,and recommended a monitoring and operating system together with full service maintenance based on the economics of several combinations.The preliminary estimate indicated a costing for 36 point coverage at Civic Center and 14 point coverage for the Library to be as follows for one year: Automation $1$9000,Monitoring $149400,and Maintenance $31,000 for a total of $63 ,400 first year cost. It was decided at 1973-74 budget sessions to include city funds of $22000 for the maintenance portion and to submit the balance of $40,700 for payment by the Public Facilities Corporation. The calculations derived from the installation costs plus six months monitoring and maintenance anticipated between occupancy and full acceptance of either facility. The final design and specification preparation culminated with additional point coverages,with Public Works request and approval,causing to be bid 49 at Civic Center and 1$ at the Library. The attached bid summary sheets analyze three different funding approaches with a detail of the recommended analysis "B".These were necessitated by the information received that the base bid for installation included 46% of the equipment costs and the other 54% was spread over the five year monitoring and operating costs. This procedure is normal to assist an owner in reducing first year costs but the City and Corporation arrangements do not lend themselves to take full advantage of the delays. It is further requested that your honorable bodies direct the office of the City Attorney to prepare the three party contract and that the City Clerk be directed to transmit for execution. Donald W.
