Palin, Director of Development Services o O Subject: CODE AMENDMENT NO. 82-13, "FLOODPLAIN DISTRICT RE LATIONS" Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments: STATEMENT OF ISSUE: Attached is an urgency ordinance which will constitute an amendment to the Huntington Beach Ordinance Code by amending Article 969. 6 entitled "Floodplain District Regulations. " This ordinance will adopt the Federal Insurance Administration' s Flood Insurance Study for the City of Huntington Beach, dated August 12 , 1982 as well as the accompanying Flood Insurance Rate Map. The ordinance will also establish -FP2 and -FP3 suffix designations for areas of special flood hazard as identified on the Flood Insurance Rate Map and will establish addi- tional development regulations for new construction in those areas as required by the Federal Insurance Administration. The federal government has set a deadline of February 16 , 1983 for the ordinance to . be effective. If the City misses the deadline, the federal aovei-m;-Zt may withhold VA and FHA loan availabilitv in the City and withdraw disaster relief eligibility in the event of a flood. For this reason, the ordinance has been prepared for adoption as an urgency ordinance. If adopted on January 17, 1983, however, it will not be enforced by the City until February 16, 1983 when the deadline expires and the Flood Insurance Rate Map becomes effective. PLANNING COMMISSION ACTION: December 21, 1982 The Planning Commission approved and recommended Code Amendment No. 82-13 for adoption by the City Council by the following vote: ON MOTION BY LIVENGOOD AND SECOND BY WINCHELL: AYES : Livengood, Winchell, Porter, Mirjahangir NOES : None ABSENT: Higgins, Paone, Schumacher ABSTAIN: None r C.A. 82-13 January .17, 1983 Page 2 RECOMMENDATION: Approve Code Amendment No. 82-13 and adopt the attached urgency ordinance which will adopt the Federal Insurance Administration' s Flood Insurance Study and Flood Insurance Rate Map for Huntington Beach and amend Article 969. 6 "Floodplain District Regulations" to include additional floodplain suffixes (-FP2 and -FP3) and establish development regulations for those areas. ANALYSIS: This code amendment concerns the City' s participation in the National Flood Insurance Program and the requirement that the City adopt the Flood Insurance Rate Map and floodplain development regulations as mandated by the Federal Insurance Administration. In a letter dated November 16 , 1982 , the Federal Emergency Management Agency informed the City that the regulations must be adopted by February 16 , 1983 or the City may be suspended from the National Flood Insurance Program. If the City is dropped from the program, the federal government will withhold VA and FHA loan availability in the City as well as withdraw City eligibility for disaster relief funding in the event of a flood. Following is a description of the National Flood Insurance Program, a history of the City ' s involvement and an explanation of the regulations which must be adopted by the City. The National Flood Insurance Program consists of two components; federally subsidized insurance for existing development in the flood- plain, and floodplain management regulations for new construction in the floodplain. These two components are implemented in two phases : Emergency and Regular. In the •Emergency phase of the program, in which the City has partici- pated since 1972, flood hazard areas in the City are identified and mapped by the federal government and flood insurance becomes mandatory for new home loans in the flood hazard areas. The Flood Hazard Boundary Maps (FHBM' s) indicate the boundaries of flooding which would occur from overflow of the Santa Ana River in the event of a 100-year flood. A maximum of $35, 000 of flood insurance is available at a uniform rate for all affected home buyers. After a City enters the Emergency phase of the program, the federal government begins a detailed flood insurance study to identify the depths of flooding which would occur throughout the City. This in- formation is eventually depicted on a Flood Insurance Rate Map (FIRM) . When the FIRM is prepared, the City must adopt a detailed set of flood- plain development regulations and enter the Regular phase of the insurance program. In this phase, which the City is now preparing to enter, a maximum of $185, 000 of flood insurance becomes available and affected homeowners must purchase enough to cover their outstanding mortgages. C.A. 82-13 ' January 17 , 1983 Page 3 The City of Huntington Beach received a preliminary Flood Insurance Rate Map from the federal government in July 1980. The map indicated flood depths of between 2 and 10 feet between Beach Boulevard and the Santa Ana River and depths of 1 to 3 feet in the central portion of the City (see figure 1) . Before this map became final, the City was allowed to appeal any areas which were deemed to be inaccuratly depicted as being subject to flooding. Consequently, the City appealed the one- foot flood areas in the center of the City by submitting grading plans which showed that many homes were graded above the level of projected flooding. The City also joined with the other Orange County cities in support of the County EMA' s appeal of the Santa Ana River capacity assumptions which were used in the flood insurance study. In April, 1982, the City was informed that the EMA' s river capacity appeal had been denied but that the City' s appeal of the one-foot flood areas would be partially successful. The City eventually received Letters of Map Amendments (LOMA' s) exempting from flood insurance requirements approximatly 5, 000 of the 7, 000 lots which were within the appeal area. Because of the scale of the FIRM, however, the ex- empted lots will not appear as being exempted on the actual FIRM. After finally resolving the City' s appeal of the preliminary FIRM, the federal government on August 16, 1982, submitted to the City the final Flood Insurance Study and Flood Insurance Rate Map which must now be adopted by the City along with floodplain devleopment regulations. The regulations which must be adopted include regulations for development in the Floodway (-FP1) , development in the A, AO, AH and Al-A30 FIRM zones (-FP2) , and Development in the coastal V and V1-V30 FIRM zones (-FP3) . The City already has -FP1 zoning due to Cobey - Alquist Management Act requirements for land at the mouth of the Sariza Ana River. When the City was required to adopt the -FP1 zoning in 1981, the floodplain ordinance (Article 969. 6) was established with the knowledge and intent that the -FP2 and -FP3 suffixes and regulations would be added later. The -FP1 regulations in the proposed amended ordinance remain unchanged. The -FP1 suffix is extremely restrictive and is intended to prevent development in areas designated as being necessary for discharge of floodwaters. It is not anticipated that any additional -FP1 areas will be designated in the City. The -FP2 and FP3 regulations which are being added to the ordinance are much less restrictive than -FP1 and essentially allow any development which is permitted in the underlying base zoning district. The regulations do, however, establish additional development standards which must be complied with. The -FP2 regulations will require that new residential construction in the floodplain have the lowest habitable floor elevated to or above the flood level depicted on the FIRM. New commercial or industrial construction need not be elevated but must be floodproofed in accordance with standards established in the ordinance . In addition to new construction, substantial improvements to existing structures (improve- ments which equal or exceed 50 percent of the market value of the C .A. 82-13 January 17, 1983 Page 4 structure) must also meet the requirements of the ordinance. It is anticipated that the -FP2 regulations will not significantly effect construction in the shallow flooding areas . In deeper flooding areas, however, (such as the 5 to 10 foot zone) new residential construction will probably have to utilize techniques such as tuck-under parking to raise floor levels substantially without expensive use of fill. The -FP3 regulations establish requirements for structural support of new construction on the ocean side of Pacific Coast Highway. Since nearly all of this land is occupied by City and State Beaches, it is not expected that the -FP3 regulations will pose any substantial con- struction problems. The amended ordinance will require that certification be submitted to the City by a registered engineer stating that development plans for flood areas meet the elevation and/or floodproofing standards of the ordinance. Until the Building Division receives such certification, a building permit for construction within the flood zone will not be issued. After construction is completed, certification of compliance must 'also be submitted. The City will then be required to keep such certifications on file. In certain instances, Section 969. 6 . 22 of the ordinance will allow the Planning Commission to grant variances to the regulations. The Planning Commisssion will also hear and decide any appeals which may arise pursuant to the provisions of the ordinance. All reference to fees in the ordinance shall mean those fees already established by the City and currently in effect. The ordinance as submitted herein has been .prepared using a model which was provided by the federal government. While the attached ordinance has been adjusted to provide greater clarity and to better fit the City ' s individual needs, it must be noted that any substantial changes to the content will jeopardize the City' s continued participation in the flood insurance program. Upon adoption of the ordinance, it must be submitted to the Federal Emergency Management Agency for final approval. It should also be noted that after the ordinance is adopted, additional actions should be pursued by the City. While the ordinance will establish the Flood Insurance Study and Flood Insurance Rate Map as the official designation of the areas of special flood hazard in the City, as well as establish development regulations for those areas, it will still be desirable to eventually initiate action to place the floodplain overlay zoning on the City' s zoning district maps. The City should also pursue a General Plan amendment to include the new Flood Insurance Rate Map in the Seismic Safety Element in place of the old flood map. These actions should be pursued in early 1983. As a final note, all of the other orange County cities in the flood- plain have already adopted the same floodplain development regulations. Huntington Beach' s, February 1983 deadline was later than the other cities' due to the City' s extensive appeal of the FIRM and also due to additional coastal studies done by the federal government. Such action will result in the suspension of the City from the National Flood Insurance Program. If the City is suspended from the program, the federal government will withhold VA and FHA loan availability in the City and withdraw City eligibility for disaster relief funding in the event of a flood. He states in his letter of appeal, that he is concerned about traffic that will be re-routed in front of his business as a result of the remodeling. Staff had no additional comments. The public hearing was opened. Seeing no one came forward to address the Commission on this item, the public hearing was closed, Commissioners discussed the possibility of relocating the roadway, or putting in speed bumps to slow down traffic. After being questioned by a Commissioner, the bank manager stated that he had the permission of the major landowner to go ahead with remodeling plans. The public hearing was opened, Terry Jacobs, representing Target Stores, stated that the request in the staff report was for a sign 15 ' X 151 ; he stated that in actuality the request is for a sign 14 ' X 14 ° o He further stated that his headquarters was expecting to see a profit in the next five years to substantiate the relocation to the west coast and felt that sign visibility was an important factor. Joe Arena and Anthony Carvas, both tenants in the shopping center, spoke against the proposed sign at the requested height. The public hearing was closed. Commissioners asked if staff considered an administrative action permit for a two-year period. Staff stated that the applicant wanted a per- manent approval of the nonconforming sign. Commissioner Livengood stated he was in favor of granting the special sign permit because it would give the new owner a "running start" in their venture. Commissioner Porter stated he was opposed to the permit because he "believes in the sign code" . A motion was made by Winchell and seconded by Porter to deny the special sign permit with the findings for denial stated in the staff report. This motion failed to attain four affirmative votes. " This ordinance will adopt the Federal Insurance Administration' s Flood Insurance Study for the City of Huntington Beach, dated August 12, 1982 as well as the accompanying Flood Insurance Rate Map. The ordinance will also establish -FP2 and -FP3 suffix designations for areas of special flood hazard as identified on the Flood Insurance Rate Map and will establish addi- tional development regulations for new construction in those areas as required by the Federal Insurance Administration. 3. 0 ANALYSIS : This code amendment concerns the City' s participation in the National Flood Insurance Program and the requirement that the City adopt the Flood Insurance Rate Map and floodplain development regulations as mandated by the Federal Insurance Administration. In a letter dated November 16, 1982, the Federal Emergency Management Agency informed the City that the regulations must be adopted by February 16, 1983 or the City may be suspended from the National Flood Insurance Program. If the City is dropped from the program, the federal government will withhold VA and FHA loan availability in the City as well as withdraw City eligibility for disaster relief funding in the event of a flood. Following is a description of the National Flood Insurance Program, a history of the City' s involvement and an explanation of the regulations which must be adopted by the City. The National Flood Insurance Program consists of two components; federally subsidized insurance for existing development in the flood- plain, and floodplain management regulations for new construction in the floodplain. These two components are implemented in two phases: Emergency and Regular. In the Emergency phase of the program, in which the City has partici- pated since 1972, flood hazard areas in the City are identified and k A-FM-23A CA No. 82-13 December 21, 1982 Page 2 mapped by the federal government and flood insurance becomes mandatory for new home loans in the flood hazard areas. The Flood Hazard Boundary Maps (FHBM' s) indicate the boundaries of flooding which would occur from overflow of the Santa Ana River in the event of a 100-year flood. A maximum of $35, 000 of flood insurance is available at a uniform rate for all affected home buyers. After a City enters the Emergency phase of the program, the federal government begins a detailed flood insurance study to identify the depths of flooding which would occur throughout the City. This in- formation is eventually depicted on a Flood Insurance Rate Map (FIRM) . When the FIRM is prepared, the City must adopt a detailed set of flood- plain -development regulations and enter the Regular phase of the insurance program. In this phase, which the City is now preparing to enter, a maximum of $185 , 000 of flood insurance becomes available and affected homeowners must purchase enough to cover their outstanding mortgages. The City of Huntington Beach received a preliminary Flood Insurance Rate Map from the federal government in July 1980. The map indicated flood depths of between 2 and 10 feet between Beach Boulevard and the Santa Ana River and depths of 1 to 3 feet in the central portion of the City (see figure 1) . Before this map became final, the City was allowed to appeal any areas which were deemed to be inaccuratly depicted as being subject toflooding. Consequently, the City appealed the one- foot flood areas in the center of the City by submitting grading plans which showed that many homes were graded above the level of projected flooding. The City also joined with the other Orange County cities in support of the County EMA' s appeal of the Santa Ana River capacity assumptions which were used in the flood insurance study. In April, 1982 , the' City was informed that the EMA' s river capacity appeal had been denied but that the City' s appeal of the one-foot flood areas would be partially successful. The City eventually received Letters of Map Amendments (LOMA' s) exempting from flood insurance requirements approximatly 5, 000 of the 7 , 000 lots which were within the appeal area. Because of the scale of the FIRM, however, the ex- empted lots will not appear as being exempted on the actual FIRM. After finally resolving the City' s appeal of the preliminary FIRM, the federal government on August 16, 1982 , submitted to the City the final Flood Insurance study and Flood Insurance Rate Map which must now be adopted by the City along with floodplain development regulations. The regulations which must be adopted include regulations for development in the Floodway (-FP1) , development in the A, AO, AH and Al-A30 FIRM zones (-FP2) , and Development in the coastal V and Vl-V30 FIRM zones (-FP3) . The City already has -FP1 zoning due to Cobey - Alguist Management Act requirements for land at the mouth of the Santa Ana River. When the City was required to adopt the -FP1 zoning in 1981, the floodplain ordinance (Article 969 . 6) was established with the knowledge and intent that the -FP2 and -FP3 suffixes and regulations would be added later. CA No. 82-13 ' December 21, 1982 Page 3 The -FPl regulations in the proposed amended ordinance remain unchanged. The -FP1 suffix is extremely restrictive and is intended to prevent development in areas designated as being necessary for discharge of floodwaters. It is not anticipated that any additional -FP1 areas will be designated in the City. The -FP2 and -FP3 regulations which are being added to the ordinance are much less restrictive than -FPL and essentially allow anyy development which is permitted in the underlying base zoning district. The regulations do, however, establish additional development standards which must be complied with. The -FP2 regulations will require that new residential construction in the floodplain have the lowest habitable floor elevated to or above the flood level depicted on the FIRM. New commercial or industrial construction need not be elevated but must be floodproofed in accordance with standards established in the ordinance. In addition to new construction, substantial improvements to existing structures (improve- ments which equal or exceed 50 percent of the market value of the structure) must also meet the requirements of the ordinance. It is anticipated that the -FP2 regulations will not significantly effect construction in the shallow flooding areas . In deeper flooding areas, however, (such as the 5 to 10 foot zone) new residential construction will probably have to utilize techniques such as tuck-under parking to raise floor levels substantially without expensive use of fill. The -FP3 regulations establish requirements for structural support of new construction on the ocean side of Pacific Coast Highway. Since nearly all of this land is occupied by City and State Beaches, it is not expected that the -FP3 regulations will pose any substantial con- struction problems. The amended ordinance will require that certification be submitted to the City by a registered engineer stating that development plans for flood areas meet the elevation and/or floodproofing standards of the ordinance. Until the Building division receives such certification, a building permit for construction within the flood zone will not be issued. After construction is completed, certification of compliance must also be submitted. The City will then be required to keep such certifications on file. In certain instances, Section 969 . 6 . 22 of the ordinance will allow the Planning Commission to grant variances to the regulations. The Planning Commission will also hear and decide any appeals which may arise pursuant to the provisions of the ordinance. The ordinance as submitted herein has been prepared using a model which was provided by the federal government. While the attached ordinance has been adjusted to provide greater clarity and to better fit the City ' s individual needs, it must be noted that any substantial changes to the content will jeopardize the City' s continued participation in the flood insurance program. Upon adoption of the ordinance, it must be submitted to the Federal Emergency Management Agency for final approval. It should also be noted that after the ordinance is adopted, additional actions should be pursued by the City. While the ordinance will establish the Flood Insurance Study and Flood Insurance Rate Map as the official desingation of the areas of special flood hazard in the CA No. 82-13 December 21, 1982 Page 4 City, as well as establish development regulations for those areas, it will still be desirable to eventually initiate action to place the floodplain overlay zoning on the City ' s zoning district maps. The City should also pursue a General Plan amendment to include the new Flood Insurance Rate Map in the Seismic Safety Element in place of the old flood map. These actions should be pursued in early 1983 . As a final note, all of the other Orange County cities in the flood- plain have already adopted the same ,floodplain development regulations. Huntington Beach' s, February 1983 deadline was later than the other cities due to the City' s extensive appeal of the FIRM and also due to . additional coastal studies done by the federal government. RECOMMENDED ACTION: Because of the severity of federal sanctions for non - compliance, staff recommends that the Planning Commission approve Code Amendment No. 82-13 adopting the Federal Flood Insurance Study and Flood Insurance Rate Map and establishing floodplain development regulations for flood hazard areas depicted on the FIRM. �HHSS :dw L '_
