The amount will be approxi- mately $4 ,000.00. For a non-profit organization such as a church I have no objection to such a delay for a maximum period of two years. If this is approved in concept by the City Council on December 15, 1975, a building permit can be issued to the church immediately thereafter. Swanigan, et al (owners of Tory Pines apartment houses) be placed on the agenda for the August 18, 1975, City Council meeting for the purpose of resolving the drainage problem due to a city-dedicated easement on Lot 10, Tract No. 8412, in the City of Huntington Beach. The problem is stated briefly as follows: Water flows from an access hole (approximately 3 ft. x 4 ft. ) in the wall bordering the south end of Lot 10, thus carrying debris, trash and mud westerly down the driveway and along both sides of Regina Circle north to Heil. The mud and trash settles in the gutters in front of the apartments, creating a dirty and messy street as well as making a difficult rental situation for owners to acquire new tenants. " We have contacted Covington Brothers (the builders and sellers) who claim it' s the city's problem. We have contacted various departments of the City we shifted from department to department but to no avail. Mr. Percy, of Public Works, said that the City would maintain the streets and the vacant lot area dividing the property; however, to this date, trash and debris is still being washed down the driveway and into the street. It is, of course, worse in the rainy reason, which will soon be upon us. Therefore, as a last resort, we wish to place the problem before the City Council for resolution. ADMINISTRATIVE OFFICE Subject: Drainage Easement Lot 10, Tract 8412 Dear Mr. Swanigan: Your complaint regarding the drainage facility on the subject lot and the missing street name sign has been referred to this office. The street name sign has been reordered and will be reinstalled as soon as it is available. The drainage facility is constructed in accordance with ap- proved plans for the subdivision. This drainage is within a drainage easement dedicated to the City of Huntington Beach and shown on the recorded tract map for Tract 8412 (see copy attached) . The deed for Lot 10 of Tract 8412 should indicate this drainage easement. Also, it was a condition of approval for Tract 8412 to provide drainage through the block wall for Tract 7805, which is the tract south of Tract 8412. These requirements were shown on approved grading plans and street improvement plans for both sub- divisions. To alter this drainage would require major changes of street and lot elevations and the cost would be prohibitive. During last winter' s rains and while lots were not landscaped, there was a problem of erosion and mud through this drain. Belsito City Administrator Subject: Drainage Problem at Florida and Owen Dear Council Members: Until the master storm drain is installed (Old Town Drainage) , the area in the vicinity of Florida and Owen is subject to inundation from the rains. We requested $9 ,500 in the 1976-77 budget to provide an interim relief to the problem. That item was denied, however, approval was granted for the project from Revenue Sharing Funds which will not be available until January 1977 . In order to install the temporary facilities prior to the rainy season, it is recommended that amount of $9,500 be encumbered from the Contingency fund to be repaid by Revenue Sharing funds after the first of the year. Belsito City Administrator Subject: Ash Tree Program Dear Council Members: The following steps have been taken to alleviate the problem of damage caused by Ash trees: 1. $40,000 was committed from Contingency funds last year to complete tree removal. This work is ongoing. 2. $43 ,000 was approved from HCD funds to perform remedial work, but will not be available until the middle of August. 3. $218 ,000 of Revenue Sharing was approved, but will not be available until January 1, 1977 . 4. Manpower has commenced recruiting 12 CETA employees to work on the program. (This program has a committed life until January 31, 1977. ) Due to the fact HCD funds will not be available until the middle of August and the Revenue Sharing funds will not be available until the first of 1977 , in order to proceed with the repair work it will be necessary to encumber up to $122 ,000 from the Contingency fund. The borrowed amount will be paid back upon receipt of Revenue Sharing funds. The EAC acted favorably at its meeting of August 11, 1976. It is recommended that the City Administrator be authorized to set up the special fund from the General fund in the amount of $122 ,000 to implement the program. Recommendation: Direct the City Attorney to prepare an ordinance change amending Section 14 . 48. 070 of the H.B.M.C. to place a 10 year limitation on drainage reim- bursement agreements and to increase the maximum refund from 90o to 1000. Analysis: Mr. Zinngrabe installed a master plan storm drain system to serve Drainage District 8G (Oldtown Drainage Area) and has applied to the City for reim- bursement for the construction cost. An agreement was written for repayment to his company in accordance with Section 14 .48 . 070 of the Code. Among the provisions of this section are the following conditions : Refunds are payable for five years only from the date of the applicant ' s application. Refunds shall not exceed 90o of the offsite construction cost. When informed of these conditions, Mr. Zinngrabe requested that the 90o refund and the five year limitation be removed for the reimbursement agreement. In order to support this request, this office contacted three Orange County cities to discover how they handle reimbursements. The cities of Newport Beach, Fountain Valley and Santa Ana were contacted. The City of Santa Ana will pay up to 100a of the reimbursable amount less the builder ' s share of the construction cost. The City of Fountain Valley will pay up to 100% of the construction cost. In cooperation with Mr. Hartge's office we have arrived at a final cost figure of $45,202.81 which should be repaid to us from future assessments. However, the Huntington Beach Municipal Code provides a maximum, refund period of five years with no guarantee that any of the agreed amount will be paid to us. We are requesting that this condition be modified so that we may be assured of eventually receiving our money. Secondly, Huntington Beach retains Code Section 14.48.070 (c) which mandates a ten percent deduction from our final figure and we feel it is unfair to charge us this fee for services, particularly since no overhead or profit to our construction division is included in our final figure. Zinngrabe Dear Bob: I have reviewed the proposed agreement for reimburse- ment of flood control facilities between your corporation and the City of Huntington Beach and believe it conforms substan- tially to the provisions of the Government Code relating to such matters with two notable exceptions (1) The agreement provides for a termination period of five years whereas no such limitation is required by law. This restriction is apparently based upon a provision in the Huntington Beach Municipal Code, which is similar to those contained in many city ordinances prior to the enactment of the Subdivision Map Act in 1959 . With' the adoption of this Act, however, most cities have removed this anachronism from their Code as it can serve no purpose other than to give the city a windfall as to any funds collected after the expiration of the five-year period or to give later users a free ride at the original developer' s expense. I would recommend that you seek to have this restriction removed by an appropriate amend- ment of the City Code. (2) The agreement contains a provision which reduces the recovered amount of 10% pursuant to Huntington Beach Muni- cipal Code §14.48. 070(e) . Government Code §66486 provides for full reimbursement of all costs not attributable to the developer ' s project without deduction. Inasmuch as the City only has to collect this money and pay it directly to the developer, the charge of 10% seems somewhat excessive. If a small handling charge is desired to be collected, it should be added to the fees to be paid by later developers pursuant to the provisions of Government Code §66487 . In summary, a reading of Sections 66486 and 66487 make it quite clear that processing fees , if any, CITY OF HUNTINGTON BEACH CA 76- s 7 COUNCIL - ADMINISTRATOR COMMUNICATION HUNTINGTON BEACH To Honorable Mayor and From City Administrator City Council Members Subject TALBERT LAKE PUMP REPLACEMENT Date April 28 , 1976 There are three existing pumps at Talbert Lake in Huntington Central Park which are failing to meet the continuous demand. The pumps draw water from the lake for park irrigation. These pumps are designed to operate at 3450 RPM instead of 1750 RPM which is the optimum opera- tional level . Consultants have advised us that the pumps cannot be rewound to the lower RPM level. Replacement is our only alternative . Failure to replace these pumps will have a high cost to the city, both in the increased water billings and in the replacement cost for foliage ruined by inadequate irrigation during the annual dry periods . RECOMMENDATION Replace the three pumps at an approximate cost of $16 , 850 to come from the Contingency Fund. The EAC approved this expenditure on April 21 , 1976 . This work is ongoing. 2. $43,000 was approved from HCD funds to perform remedial work, but will not be available until the middle of August. 3. $218,000 of Revenue Sharing was approved, but will not be available until January 1, 1977. 4. Manpower has commenced recruiting 12 CETA employees to work on the program. (This program has a committed life until January 31, 1977. ) Due to fact HCD funds will not be available until the middle of August and the Revenue Sharing funds will not be available until the first of 1977 , it will be necessary to borrow up to $122, 000 from the General fund. The borrowed amount will be paid back upon receipt of Revenue Sharing funds. Hartge, Director of Public Works 404— DATE: September 16, 1977 SUBJECT: Rehabilitation of the Pumps Within the Slater--Banning Storm Drain Pump Station STATEMENT OF PROBLEM Revenue sharing funds in the amount of $20,000 were set aside in the 1977-78 budget for the purpose of rehabilitating the storm drain pumps located in the Slater-Banning Storm Drain Pump Station. Recently the pumps have been disassembled and a determination made that the repair work will cost approximately $50,000 rather than the $20 ,000 originally estimated. RECOMMENDED ACTION It is recommended that the City Council authorize the expendi ture of $30,000 from the Contingency Fund to cover the total cost of the required repairs to the Slater-Banning Pumps. ANALYSIS The original estimate of $20,000 for repairs to the Slater- Banning Pumps was obtained from a specialty pump contractor. It was known at that time that the estimate was at best an educated guess because the internal components were enclosed and concealed from visual inspection. A detailed inspection was only possible after the pump units had been removed and dis, assembled. It was at this time that the $20,000 original estimate was revised to $50,000. ALTERNATIVE A reduction in repair cost is possible if certain repairs recom.: mended by the specialty company are not made at this time; however, this would increase the risk of losing one of the units at a time of critical need and is, therefore, not recommended. Funds have been collected in District 7E to provide for this work. The pump station was designed in 1967 for an ultimate of three pumps. The station was constructed in 1967 with one pump. The second pump was installed in 1971. This will be the final pump to be installed in the existing building. According to Section 15070 of the State Guidelines, it is the opinion of the City Attorney' s office that this is an on-going project and is not subject to the Environmental Protection Agency. Our master plan calls for a pump station to be located adjacent to the Huntington Beach Channel east of Beach Boulevard and north of Atlanta Avenue, a storm drain in Atlanta westerly to future Delaware, a storm drain in Delaware both north and south of Atlanta, and a storm drain in Beach Boule- vard north of Atlanta. Enclosed is a plan showing the locations. First phase of work would consist of the construction of the pump station with one pump, the Atlanta Avenue pipeline, the Delaware line north of Atlanta, and a portion of the Beach Boulevard pipeline all at an estimated cost of $530,000.00. Second phase, consisting of the pipeline in Delaware south of Atlanta and the second pump in the pump station, is estimated to cost $190,000.00. Third phase, consisting of the third pump in the pump station, is estimated to cost $60,000.00. The total cost of $780,000 for the drainage area of approxi- mately 280 acres will cost $2,800 per acre payable at the time of development. We have a bond for $200,000 from American-Hawaiian Steamship Company, successor in interest to Capital Development Company, guaranteeing either pay- ment of drainage fees or construction of facilities for the mobil home park south of Frankfort Street. Drainage fees for their 61.4 acres, which includes the two mobil home parks, amounts to $172,000.00. It is recommended that this drainage area borrow $358,000 from the Sewer Fund for the construction of Phase One. It was pointed out that approximately $80,000 was set aside in the original estimate for the construc- tion of a concrete-lined channel and that it would cost approximately $260,000 to construct an enclosed conduit. Additionally, it was pointed out that there is approximately $31,000 in drainage area 5A for construction purposes. A tentative map consisting of 50 acres has been filed within the drainage area which will contribute approximately $30,000 in drainage fees, however, there is no way of knowing when the tract will be recorded and the drainage fees paid. Additionally, approximately 60 acres within the drainage area remain to be developed at some indefinite date. An up-to-date accounting reveals that there is $35,000 presently in the account of drainage area 5A for a total sum of $101,000 eventually available to complete the construction. Due to the upcoming rainy season, this is not the time of the year to contract for a drainage channel. It can be anticipated that the contractor will make a liberal allowance for extra cost resulting from rains and accord- ingly bid higher than during the spring or summer. However, if the Council desires to proceed with the project at this time, transmitted herewith are plans and specifications and a resolution establishing the wage scale. If the Council authorizes the advertisement of the project, it is suggested that you direct the City Clerk to advertise the project immediately, calling for bids to be received on November 18, 1968. It is estimated that the cost related to the channel construction such as concrete lining and the fencing will amount to approximately $100,000 and that the cost related to State gas tax funds such as the reinforced concrete box culvert, and new street construction will amount to approximately $25,000 for a total project estimate of $125,000.00. i; Honorable Mayor and City Council October 25, 1968 Page 2 In view of the fact there 1s $35,000 available from drainage district funds, it will be necessary to either make an expenditure of $65,000 from general funds or borrow $65,000 from another fund such as the sewer fund. Flooding Four times within the last year dozens of homes in our tract have been threatened by serious flooding conditions. This has occurred during moderate to heavy storms on November 6, 1966; December 4, 1966; January, 1967; and most recently, November, 1967. In each instance water has come perilously close our doorsteps, measuring two to three feet at its deepest points. Only a slackening in the rain prevented widespread, extensive damage to property. This repeated flooding represents a grave hazard to small children on their way to and from school who do not have the capacity to gauge water depth and the danger. On one occasion work crews were reported to have opened the sanitary sewers to reduce the rater level. Lawns have been washed away, and people have had the expense and labor of relandscaping. Lastly, there has been considerable inconvenience. Auto traffic has been impeded, or completely stopped. People have not been able to come in or get out. They have been late for work and appointments. Trash and garbage collection has been delayed until the next pickup. If they had been needed, ambulances and emergency vehicles mould have been hampered in getting into the area. 2. Drainage Another problem relates to gutter drainage along the streets. Most of us believe this problem is separate from the flooding. Year around, even in driest weather, there is water running along the curbs or collecting in stagnant pools, indicating an inadequate grade to the streets. CAUSE It is our understanding that the problem is a temporary pump station at Brookhurst and Tilton. Some of our people were told a year ago this would be replaced by a permanent installation by this winter which would adequately serve the drainage district. This was not accomplished, we learn, because of insufficient funds. We now understand that if funding can be worked out construction will proceed beginning in March, and completed in about six months. p.ECOIMNDATIONS 1. That the city proceed with all haste to construct the permanent pumping facility, and notify homeowners in the area as to plans and progress. 2. That the city have on standby basis a portable pump ready for inmmdiate use in this tract should the occasion arise. Last year the builder of the tract rented a pump and prevented water from entering our homes, and we indeed thank the company for their action. A portable pump that rents for $34 per day and pumps 9,000 gallons per hour would supplement the present pump, particularly during the rainy season. Hargrave. The letter requested help from the City in making possible the construction of curbs and gutters along Florida Street south of Yorktoim Avenue, particularly on the ,Test side for a distance of approximately 350 feet south of Yorktown. Transmitted here, ith is a sketch sho,,ing the nature of improvements along Florida Street from Yorktoun Avenue to Utica Street. On the TTest side approximately 13% of the frontage has curb and gutter but no side-,Talks. On the east side approximately 63% of the frontage has curb and gutter and side- walk. For that area which Tjill be developed in the future, street improvements can be required by City Ordinance at the time of issuance of building permits. For those lots on v-hich houses have been built, but Tahich do not have improvements on the street, two methods can be pursued by the owners to accomplish street improvements. 1. An improvement district such as by the 1911 Act can be requested by the property owners. The cost of this work can be spread over a number of years, normally 10 years for this type of improvement, and can be financed by the issuance of bnnds. It is recommended that if this method is decided upon, petitions representing a minimum of 60% of the property owners in the district be required. 2. Streets and Highways Code, Articles 5870 to 5895, makes provision for the improvement of street frontage in cases similar to the one cited herein. Among the items covered in this chapter are: 1) Sixty (60) percent of the front footage of the block (Yorktown to Utica) must file a petition requesting the VTork; or if more than fifty (50) percent on one side of the block have frontage improvements the superintendent of streets may serve notice that the improvements shall be constructed in front of the unimproved portion of the street. Honorable Mayor and City Council April 20, 1967 Page 2 2) Notice may be given to the owners to construct the improvements. 3) If the work is not commenced within 60 days after notice is given, the superintendent of streets shall cause the construc- tion to be done. 4) The property owner shall pay his share of cost of construction within five (5) days after notice, or if not paid the assessment shall be a lien on the property. 5) The legislative body may determine that the payment of assess- ment may be made in annual installments not to exceed ten (10), and that the payment shall bear interest on the unpaid balance at the rate to be determined by the legislative body not to exceed six (6) percent per annum. The latter method of accomplishing the improvements cannot be recommended at this time due to the fact that the City would be obligated to finance any portion not paid by the owner of an individual parcel. Since a sewer line and a water line exist in the street, the improvements could be confined to curb and gutters, sidewalks, driveways, and parlcuay trees. Very truly yours, s R. The agreed payment for construction required the developer of tracts 5560 and 5561, C and P Development Comxzany, to contract for the construction and the remaining developers to deposit $22061.49 with the City to be held until the con— struction was completed. Upon completion of the work the City was to refund these monies to C and D Development Company. The City did collect the monies and the station has been completed. Water inundation occurred some two years ago to these same properties when the P.F. Galliennes occupied the house at 617 Frankfort Street. At that time' we contacted the Engineer's officer and on their recommendation' installed "gates" on the sewer lines to correct a condition that was the city's responsibility. Then' part_ of my bathroom floor had to be replacedq new linoleum purchasedp and the toilet reset. Can you imagine my reaction on awakening at night last- Thursday (December 9) to, find most of the house covered by sewer water? This is the type of shock likely to- produce a heart attackp especially since water had gushed into my home before. It also brings to my mind this question, "Is the effort and expense to maintain property that is an asset to Huntington Beach worth while?"- I am asking for no favorsq merely petitioning that simple justice be done- namely that the city correct this conditions and refrain from using properties at 615 and 617 Frankfort Street to drain the surrounding area. The water used to drain tnrough a natural tide slough which followed the Coast up to the Huntington Beach Mesa and then the slough made a turn paralleling the contour of the Mesa Northeasterly up to and across Atlanta Avenue. We have been gradually developing, improving, and making fills over the years without providing sufficient outlet for the drainage water from the overflow of the Huntington Beach mesa and the flood water from the Northeast. Tne easiest and best solution of this lower basin would be to get an ea,seiaent from the Mills Land and Water Company, commencing at the ,southerly culvert of Highway 39, and carry it through to the outlet provided by the Southern California Edison Company. I have had this matter up with t-ne Mills Land and Water Company, and apparently they would be favorable towards granting an easement. Several facts are considered in this conclusion as follows: (1) Since the storm drain system is completely separate from the sanitary sewer system, the rainfall would not overload the sever lines.
