HOPKINS, PE, DIRECTOR PUBLIC WO S SUBJECT: Adopt Resolution to Enter into a Financial Assistance Agreement with the State Water Resources Control Board for the Talbert Lake Diversion Project Statement of Issue, Funding Source, Recommended Action, Alternative Action(s), Analysis, Environmental Status, Attachment(s) Statement of Issue: The State Water Resources Control Board (SWRCB) has frozen the Phase 1 Talbert Lake Diversion grant due to State cash flow issues. However, the project is eligible for an alternative grant through the American Reinvestment and Recovery Act (ARRA). The proposed resolution authorizes the City of Huntington Beach to enter into a financial assistance agreement with the SWRCB and designates a representative to sign the financial assistance agreement. Funding Source: The total state grant amount is $2,326,000 budgeted in Storm Water Quality Grants, 89288005.82500. The grant application is for $5,134,000 to complete the project. Recommended Action: Motion to: Adopt Resolution No. 2009-25 a Resolution of the City Council of the City of Huntington Beach Authorizing Entering into a Financial Assistance Agreement with the State of California Water Resources Control Board. Alternative Action(s): Deny approval of the resolution. This action will result in the forfeiture of the grant funds for the Talbert Lake Diversion Project, Phase I. REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 5/18/2009 DEPARTMENT ID NUMBER: PW 09-020 Analysis: In December 2008, the State Water Resources Control Board was directed by the State Department of Finance to suspend payment on all grant funded projects. After passage of the American Reinvestment and Recovery Act (ARRA), federal funds were made available to the State through the State Revolving Fund (SRF) program to fund eligible projects. On April 6, 2009, the City was informed that the Natural Treatment System - East Garden Grove Wintersburg Channel Urban Runoff Diversion Project into Talbert Lake was selected to receive ARRA funds. The State Division of Financial Assistance is following ARRA guidance to distribute money equitably and in a process that is transparent to the public. The eligible projects list was based on survey responses and other available information on project readiness, threat to public health or the environment if the project was not completed, and the number of jobs that will be created or saved. Before the project funding was frozen, the consultant for the project, Pacific Advanced Civil Engineering (PACE), had submitted 75% complete design plans and cost estimates for City's review. Based on increased construction costs since project inception and final construction details, the City is requesting $5,134,000 in ARRA funds to complete the design and construct the project. If the funding amount is approved, the project should begin construction in January 2010 and be completed in approximately one year. Public Works Commission Action: Not required. Strategic Plan Goal: 1-1 Improve the City's plan for funding and completing infrastructure needs, and develop strategies for resolving crucial infrastructure problems to preserve the physical foundation of the community and enable the community's value to grow. Council of the City of Huntington Beach Authorizing Entering into a Financial Assistance Agreement with the State of California Water Resources Control Board. -2- 5/4/2009 11:10 AM RESOLUTION NO. 2009-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING ENTERING INTO A FINANCIAL ASSISTANCE AGREEMENT WITH THE STATE OF CALIFORNIA WATER RESOURCES CONTROL BOARD WHEREAS, the City of Huntington Beach is authorized to enter into a financial assistance agreement with the State of California and the State Water Resources Control Board; and The Director of Public Works or his designee, is hereby authorized to sign the financial assistance agreement, and any amendments thereto; and The City Council agrees and further authorizes the Director of Public Works, or his designee, to certify that the City has and will comply with all applicable federal and state statutory and regulatory requirements related to any financial assistance funds received, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: To authorize entering into a financial assistance agreement with the California Water Resources Control Board and designating the Director of Public Works, or his designee, to sign the financial assistance agreement and any of its amendments, and to certify that the City has complied with all statutory and regulatory requirements of the state and federal government related to any financial assistance funds received.
