City Attorney's Quarterly Report for July 1, 2007 through September 30, 2007 ATTACHMENT 1 City Attorney's Quarterly Report This report reflects the activities of the City Attorney's Office for July 1, 2007 through September 30, 2007. Administration Division The administration and support functions are performed under the supervision of the City Attorney. This includes personnel, clerical, financial, technology, training and development, and records management support. This function also includes attendance at regular council meetings as parliamentarian and advisor, and active participation in the executive management team to promote the strategic goals of the City Council. Significant accomplishments for the Administration section include: 1. Implementation of a comprehensive training program on the Brown Act, Public Records Act, and sexual harassment prevention. Advisory Division The Advisory Division, comprised of four deputy city attorneys, is supervised by an Assistant City Attorney and provides legal assistance on all matters pertaining to the daily operation of the City to the City Council and City officers. It prepares all legal documents and opinions to ensure the City can accomplish its goals and objectives with little, if any, risk of litigation. The Advisory Division received 136 requests for legal assistance and completed 133 requests. There are 175 outstanding requests for legal assistance. Prepared the Second implementation Agreement for Bella Terra. 2. Updated the Outdoor Dining License Agreement for Downtown. 3. Assisted the Planning Department in reviewing the First Christian Church application. 4. Advised the Agency and City with regard to the proposed Community Facilities District for Pacific City. 5. Advised Planning Department and Planning Commission with regard to the Medicinal Marijuana Dispensary ordinance. 6. Prepared amendments to the zoning code and municipal code relating to communication facilities in the public right-of-way. 7. Provided advice relating to the purchase of surplus school sites pursuant to the Naylor Act. 8. Assisted with issues relating to the recording of the Pacific City Final Map. 9. Assisted department with CIM development issues. 10. Advised Public Works regarding process that must be followed when modifying or increasing water or sewer rates pursuant to Proposition 218. 2 f 11. Assisted in the negotiation of Municipal Employee Association Memorandum of Understanding. 12. Successfully negotiated allocation agreement with Verizon Wireless. Litigation Division The Litigation Division, comprised of three deputy attorneys, is supervised by an Assistant City Attorney and handles all civil matters on behalf of the City and its employees and officials. All cases are handled by the in-house staff unless there is a conflict in representation or the outside counsel is paid by a third party. Currently, the City Attorney has assigned two personnel related cases to outside counsel. The Litigation Division is currently handling 37 active cases, which the City was served with four new cases. The charts below identify the types of cases and the potential liability exposure of these cases. Lawsuit for injuries allegedly caused by condition of sidewalk and sustained injuries. A letter stating that the State, not the City owned and maintained the sidewalk was sent to plaintiff who agreed to dismiss the lawsuit. 2. A federal action challenging a warrantless search of plaintiffs house. 3. A civil rights lawsuit challenging a warrentless search of Plaintiffs garage. 4. Action for damages resulting from plaintiffs' purchase of a condominium that was unlawfully converted. 5. Claims for false arrest and civil rights violations arising from Plaintiffs arrest for felony spousal battery. 6. Minor tripped over tree root while chasing down volleyball during physical education at Sowers Middle School. The Litigation Division also resolved the following matters: 1. City employee driving City vehicle hit a vehicle, propelling it into Plaintiffs vehicle. 2. Presented the first revisions to the Huntington Beach Municipal Code Chapters 1 and 2, including additional revisions to campaign contribution regulation pursuant to City Council direction. 2 Prepared the agreement with Evolution Film to produce a television show about Huntington Beach lifeguards. 3. Actively participated on the City's labor negotiation team to successfully negotiate a Memorandum of Understanding with the Management Employees Association and Surf City Lifeguard Employee Association. 4. Participated with Fire Department to establish a procedure for enforcing the fire sprinkler requirements for assemblies. 5. Prepared a Sales Tax Sharing Agreement to induce seller of petroleum products to relocate to Huntington Beach. 6. Prepared ordinance and resolutions to comply with State law requirement relating to the use eminent domain within Redevelopment Project Areas. 7. Negotiated with the County Tax Assessor and successfully reduced security requirement imposed on Bella Terra by County Tax Assessor. 8. The Litigation Division resolved the following cases with no monies paid to the plaintiff: 1. Lawsuit for violating constitutional rights to remove overgrown vegetation on plaintiff's property. 2. Action for injuries based on negligent sewer work by City contractor causing sewer problems at plaintiff's property. 3. Complaint alleges that City interfered with developer's right to provide water and sewer services to the development. Significant cases resolved second quarter include: 1. A CEQA suit to challenge the development of a wholesale nursery located underneath the Edison power lines, west of the Santa Ana River and between Atlanta Avenue and Le Bard Park. Court of Appeal affirmed judgment in favor of City. 2. CEQA writ action over proposed seawater desalination facility. City is recovering its legal fees. The Litigation Division also resolved the following matters: 1. Plaintiff became entangled with a telephone or cable wire while riding her bicycle. Case settled. 2. Advisory Division The Advisory Division, comprised of three deputy city attorneys, is supervised by an Assistant City Attorney and provides legal assistance on all matters pertaining to the daily operation of the City to the City Council and City officers. It prepares all legal documents and opinions to ensure the City can accomplish its goals and objectives with little, if any, risk of litigation. The Advisory Division received 74 requests for legal assistance and completed 144 requests. There are 232 outstanding requests for legal assistance. As part of the City's ongoing annexation of a portion of the Bolsa Chica mesa, completed an agreement for the Brightwater Pump Station to serve the Hearthside Homes project. 2 Prepared the revised lease with the Huntington Beach Playhouse for use of the Central Library Theater. 3. Contacted counsel for Coastal Commission to successfully resolve issues raised by Coastal Commission staff relating to the City's request to amend its Local Coastal Plan to allow fractional ownership and condominium hotels within Pacific City and at the third Waterfront hotel. 4. Facilitated Public Works desire to have the County repair and subsequently maintain Edinger Bridge as a County highway. 5. Worked with Planning and Public Works staff to successfully resolve outstanding issues on Phase I of Bella Terra in furtherance of map recordation. 6. Successfully received and was granted a stay of enforcement of a court order to return medical marijuana to a criminal defendant, until the final disposition of two pending appellate cases on the same issue. 7. Actively participated in the newly restructured Public Nuisance Task Force meetings. 2 8. Actively participated on the City's labor negotiation team to successfully negotiate a Memorandum of Understanding with the Fire Management Association. 9. Successfully defended City position to terminate an employee before administrative body. 10. All cases are handled by the in-house staff unless there is a conflict in representation or the outside counsel is paid by a third party. The Litigation Division is currently handling 45 active cases. The City resolved a significant employment case and was served with three civil rights cases in March. Lawsuit for water damage to Plaintiffs' homes. Plaintiffs have dismissed the City from the action for a waiver of costs. 2. Action for injuries allegedly caused by condition of sidewalk, at no cost to City. Significant cases resolved first quarter include: 1. City of Huntington Beach v. HBPOA, et aL (Gun Range) City sued the POA to recover the cost to clean-up lead contamination at the former Gun Range. In a related action, the POA's insurers litigated their responsibility for paying for any clean-up costs on behalf of the POA. From the 1971 through 1997, the City leased five acres in Central Park to the POA for use as a Gun Range. During its 25 year operation, millions of rounds of lead ammunition were fired at the Range by several dozen police departments, public agencies, and private security companies, along with hundreds of individuals. In 1998, after closure of the Range, the City discovered extensive lead contamination. In November 2001, the City sued the POA in Federal Court to recover the cost for lead clean-up. In 2004, the City amended its suit to add as defendants the major public and private entities that used the Gun Range for firearms training. Assistant City Attorney Scott Field was primarily responsible for settling this matter with a recovery of $615,167.40. 4 2. City ficus trees damaged the neighbors' gutters, sidewalks, driveways, which caused a dangerous condition of public property. Deputy City Attorney John Fujii negotiated a favorable settlement for minimal costs to City and removal of the subject ficus trees consistent with current Public Works policy. 3. A former police detective sued the City to challenge his compelled disability retirement. On November 23, 2004, the Federal District Court rejected the suit, and granted summary judgment in favor of the City. Assistant City Attorney Scott Field handled the matter on appeal and the Ninth Circuit affirmed the judgment in favor of the City on March 21, 2007. 4. Complaint for false arrest, battery, and civil rights violations arising from a traffic stop of plaintiffs vehicle for suspected DUI. Case dismissed for waiver of costs. The Litigation Division also resolved the following matters: 1. Small claims action regarding damage to Plaintiffs residential sewer lateral allegedly caused by the City's ficus tree roots. The City appealed Plaintiffs small claims court judgment, but the Court upheld the judgment against the City. The City paid the judgment. 2. Plaintiff was arrested for not wearing his seat belt, and not having any identification. Plaintiff alleged that police searched his vehicle without probable cause. Case settled. 3.
