The City Council considered a communication from Mayor Pro Tempore Bauer, dated
July 1, 1996, regarding the Commercial Development of Vacant Surplus School Sites adjacent
to Major Arterials and other vacant or under utilized sites.
A communication, dated July 1, 1996, from the Community Development Director, regarding
Public Notification for the City Council Discussion on the Commercial Development at
Vacant/Surplus School Sites, etc. (245 residents notified - Crest View Schools Site)
A motion was made by Bauer, second Garofalo, to adopt Resolution No. 96-57 - "A
Resolution Of The City Council Of The City Of Huntington Beach Applications For Commercial
Development On Large Parcels Of Land Adjacent To Major Arterial Highways Or Other Vacant
Or Under Utilized Parcels In The City."
Councilman Green stated that he would like a Study Session on this issue as he requires more
information.
Each Councilmember spoke regarding the Agenda Item.
The motion made by Bauer, seconded by Garofalo, carried by the following roll call vote:
AYES: Harman, Leipzig, Bauer, Sullivan, Dettloff, Garofalo

(City Council) Overhead/Administrative Cost To Manage Refuse Contract Deferred To
August 19, 1996 (810.20)
The City Council considered a communication from Councilman Garofalo dated June 24, 1996,
regarding the One Million Dollar Overhead/Administrative Cost to the City of Huntington Beach
to Manage Refuse Contract.
Councilman Garofalo reported.
The City Administrator recommended that this item return to Council the second meeting in
August.
On motion by Garofalo, second Green, Council directed the City Administrator to return with a
report at the August 19, 1996 Council meeting. The motion carried unanimously.

RESOLUTION NO. 96-57
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF HUNTINGTON BEACH ENCOURAGING APPLICATIONS FOR
COMMERCIAL DEVELOPMENT ON LARGE PARCELS OF LAND
ADJACENT TO MAJOR ARTERIAL HIGHWAYS OR
OTHER VACANT OR UNDER UTILIZED PARCELS IN THE CITY
WHEREAS, the City desires to increase the commercial development opportunities at the
few remaining vacant or underutilized parcels in the city; and
A top priority of the City Council is to improve the City's revenue base; and
In pursuit of this goal, the City has analyzed commercial land use opportunities to expand
the city's retail sales tax, reduce retail sales tax leakage, and improve its overall economic base;
and
There are a limited number of large parcels adjacent to major arterials, including
vacant/surplus school sites or any other vacant or underutilized sites which may lend themselves
to commercial/retail development and which can accommodate the types of sales tax generators
desired,
NOW, THEREFORE, the City Council of the city of Huntington Beach does hereby
resolve as follows:
1. That the City shall review any commercial site plan that mitigates the potential
impacts to the surrounding neighborhood to the greatest extent possible, while still allowing for a
market driven development.

2. That the City Council acknowledges and supports the required land use review and
pubft hearing process, the professional recommendations of City staff and the advisory role and
recommendations of the Planning Commission.
3. That the City Administrator is requested to work toward the pursuit of commercial
development opportunities on large parcels adjacent to major arterial highways, including
vacant/surplus school sites, or any other vacant or underutilized sites or parcels in the City of
Huntington Beach.
4. That the property owner/applicant for any such commercial/retail project shall pay
all entitlement fees necessary for the processing of the project.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 1st day of JulY , 1996.

I would like the City Council to consider a motion to adopt the attached resolution which
states the City's desire to increase the commercial development opportunities at the
few remaining vacant or underutilized parcels. A top priority of the City Council is to
improve the City's revenue base. In pursuit of this goal, the City has been looking at
commercial land use opportunities to expand the city's retail sales tax, reduce retail
sales tax leakage, and improve it's overall economic base. There are a limited number
of sites which may lend themselves to retail development and which can accommodate
the types of sales tax generators desired. Possible locations for such new commercial
opportunities are vacant/surplus school sites adjacent to major arterials and any other
vacant or underutilized sites.
As part of this resolution it shall be the City's role to review any commercial site plan
that mitigates the potential impacts to the surrounding neighborhood to the greatest
extent possible, while still allowing for a market driven development. In addition, the
City Council acknowledges and supports the required land use review and public
hearing process, the professional recommendations of City staff and the advisory role
and recommendation of the Planning Commission.

DISCUSSION ON THE COMMERCIAL DEVELOPMENT AT
VACANT/SURPLUS SCHOOL SITES, ETC.
A total of 245 residents of the Crest View school site were notified of the
scheduled Council/Agency (H Item) discussion presented by Council Member
Bauer. These residents were notified because Mr. Uberuaga promised the
people who attended the General Plan meetings that they would be notified of
any public meeting on the subject of development at the Crest View school site.
The list used in the notification of the residents was derived from the sign-in list
obtained at the Crest View community meeting and the petition submitted during
the General Plan update process. No notification of the residents at the other
potential sites was done because no list has been generated or currently exists.

Dear Ms. Brockway:
I am a resident of the Crest View neighborhood, a
taxpayer and homeowner in Huntington Beach.
If Crest View goes to a retail development you can bet
that a lot more will have been lost than simply the school
property. I have always voted for any and all school bond
issues, etc. -- anything that appeared on the ballot that would
give more money to our schools, I was in favor of. However,
through this incredibly long drawn out process that we, the
residents of Crest View School have been going through, seeing
our school district administrators working hand in hand with
commercial developers -- constantly meeting in closed sessions --
it has made me painfully mistrustful and painfully aware of the
serious levels of mismanagement, misguidance and waste within our
city's school districts adminstrations.
I, for one, will never vote for another dime of my
taxpayer monies to funds for our schools because of the total
mistrust this whole process has caused me to feel. If my tax
money goes to build a school, I expect it to stay there. I
expect the school administrations to look at cost cutting if they
expect to gain my support once again. I expect the public
entities such as the Ocean View School District and the city
government of Huntington Beach to act resfunsibly and to do what
is right and listen to the residents and taxpayers of HB and to
work with us in a just and fair way. The repercussions from the
city council's actions regarding Crest View and all closed school
sites will be seriously detrimental to the residents of
Huntington Beach and our quality of life in Huntington Beach, if
you, our elected leaders, do not take a long hard look at any and
all possible solutions to the money problems facing the city, and
come up with a "quality" , thoroughly researched and well thought
out, long-term solution, not some short-sighted quick fix, where
the short term "possible" monetary gain is all that is looked at.
If Crest View goes retail, you will have taken away our
only open space/buffer to the freeway-like Beach Blvd. and
surrounding 4 lane streets. Lambert Park is not even worth
mentioning as an open space area for our neighborhood. It is

located within a closed/gated community, with virtually no
entrance to it for the general public.
I realize the bottom line is the issue of private
property and the almighty dollar. However, equally compelling is
that the Ocean View School District, the HB Planning Commission
and the city council, are all public entities, who should not be
behaving as though they were mere private landowners, selling to
the highest bidder, with no consideration for the surrounding
residents and church next to the Crest View property. Needless
to say, the overall quality of life and general planning for
Huntington Beach should also be seriously looked at.
Crest View would be a perfect youth sport site. It is
centrally located within HB, has playing fields already in place,
adequate parking and is desired by the surrounding residents.
We, the residents of Crest View, have made it abundantly clear
time and time again that a commercial development is not wanted,
not needed and not desirable for the Crest View site. We have
heard the latest rumor is that a Home Base store is being planned
for Crest View. Could anything be more disgusting? ONE MILE
AWAY IS THE SITE FOR HOME DEPOT. LESS THAN ONE MILE AWAY IS
BARR LUMBER. Do you really think there is that much money to go
around? All around our neighborhood are closed businesses. And
fairly recently on the corner of Beach Blvd. and Talbert a
"Condom Revolution" store and large pawn shop now are store front
occupants, all within close proximity to our family-oriented
neighborhood. Is this really the direction our city should be
heading in? I think not. I urge you to abide by the HB General
Plan and do the right thing. Do not rezone the Crest View site
to "commercial" .

YOU, ladies and gentlwwn of our City Council, are the only body standing
between us, the home owners of Crest View disbiat, and the autocratic Tarwater
court, also known as Ocean View School District including sympathizers at the
city staff.
Our position has been clearly explained In the form of petitions(April 5.
and October 4. 19951 and by numerous speakers personally appearing before
the City Council during council meetings on February S. &April 22.1996. Today,
July 1., 1998 we are going to face the City Council for the third time this year
regarding the some subject There isn't much I can say now that has not been
said mazy times before. As a home owner in the Crest View district I want to
once more express my stron opposition to any attempt to re-zone the Crest
View school property.
As members of the City Council you are elected to represent our
interests. We have no one else to turn to for help.Young families with school
age children are now moving In here at increasing numbers. However, if you are
certain that the school can never be returned to its original purpose, perhaps
the millions of dollars proposed for a gym in Murdy Paris could be utilized to re-
model the various braidings at Crust View. This location already has a fairly
large auditorium and lots of open air green belt to serve as a future Sports
Center for Huntington Beach.

Dear Mayor Sullivan:',
Our Board of Directors at their June 26 meeting discussed the
closed Crestview School Site. I am writing to relay their input
to you at this time.
For the past several years, the city's budget shortfall has
been a major concern for staff, council and the community.
The Chamber feels that revenue to balance the budget should
come from business activites, e.g. sales tax, transient occupancy
tax, property tax -- which occurs through business attraction
and retention.
We all know that our sales tax collection is far below the county
average and that we lose sales tax dollars to our adjacent commu-
nities.
Our recommendation is for the city to encourage sales tax generating
commercial development on property along major traffic corridors.
The Crestview Site provides the perfect opportunity for the
city to proceed in this regard. We feel that this 15 acre site
can be designed to enhance the city's tax base as well as mitigate
any impacts on the adjacent residential property.
As we look around our city, it is readily apparent that there
are too few opportunities for new commercial development that
will generate the needed sales tax dollars . We urge the city
council to begin the process that will allow commercial development
on the Crestview Site.

Dear Mayor Sullivan and City Council Members:
This letter is written in support of the resolution on the Monday, July 1, 1996 City
Council Agenda entitled, "Commercial Development on Vacan#Surplus School Sites
Adjacent to Major Arterials and Other Vacant or Underutilized Sites.
We concur with the City's desire to increase the commercial development opportunities
at the few remaining vacant or underutilized parcels in the City and to thus improve the
City's revenue base. We acknowledge and support the City's required land use review
and public hearing process, the professional recommendations of City staff and the
advisory role and recommendation of the Planning Commission. We believe that the City
government should act in the best interest of all the citizens and agencies in the City; we
believe that it is in the best financial interest of both Schools and the City for vacant
parcels to go to their highest and best land use, some of which will be commercial and
will enhance the revenue base.
We urge the adoption of Council member Bauer's resolution on the July 1st agenda and
believe it to be in the best interest of the City, Schools and all our citizens.
