Smith, Management Assistant SUBJECT: Legislation Authorization Process Options Statement of Issue, Funding Source, Recommended Action, Alternative Action(s), Analysis, Environmental Status, Attachment(s) Statement of Issue: Should the process for gaining City Council authorization to act on legislative issues be modified to meet varying time constraints, and if so, how? Fundinq Source: No funding necessary. Recommended Action: Motion to: a. Approve the use of a modified authorization process to act on pending legislative issues in a timely manner, and b: Approve the use of the "Abbreviated" and "Fast Track" authorization models when demonstrated time constraints do not allow the full City Council to act upon pending legislative issues in a timely manner. Alternative Action(s): a. Do not approve the use of a modified authorization process to act on pending legislative issues and continue to have full City Council approval for all legislative issues. b. Do not approve the use of the "Abbreviated" and/or "Fast Track" authorization models. Create another model to use or direct staff to develop additional model alternatives. Analysis: Historically, the City Council of Huntington Beach has taken positions of support or opposition on intergovernmental affairs, primarily State or federal legislation. On occasion, such action was rendered ineffective, or the City Council had insufficient time to act, due to the fast pace the legislative process can move at. R�QUEST FOR COUNCIL ACTIUA MEETING DATE: June 17, 1996 DEPARTMENT ID NUMBER: AD 96-21 On August 8, 1995, the City Council created a Legislative Committee to meet with staff to discuss and formulate positions on legislative issues that may impact our city. This committee meets monthly to review these issues. Positions are determined and brought to the next scheduled City Council meeting for full Council consideration. The amount of time needed for the City Council to approve a position is between 15 and 42 days depending on when the Legislative Committee is next scheduled to meet. At the start of the State Legislature's session, .this time lapse does not cause a problem as bills are being introduced and staff analysis drafted. However, during the session, bills are amended and new bills introduced. As deadlines on the Legislative calendar approach, the speed at which bills are considered increases. The result is that the concerns of the City Huntington Beach are less likely to be heard by that process. Staff proposes that a process be approved to allow this organization to voice its concerns regardless of time constraints. To achieve this, alternatives to the "normal" process must be in place. The following are alternatives offered by staff. "Abbreviated" Process Model - Action required after next Legislative Committee meeting but prior to next Council meeting ( 5-41 days). The steps of this process would include: • a recommendation from staff carried to the (normally scheduled) Legislative Committee, • the Legislative Committee directs staff to act, • the'Mayor authorizes action, i.e. signs letter of support/opposition, • staff performs action, and • Committee Chairperson reports action to the full Council at its next meeting. "Fast Track" Options - Action required between Legislative Committee meetings (1-29 days). Tri-Signatures Process Model (Option A) The steps of this process would include: • Staff would request the Committee Chairperson, the City Administrator and the Mayor to "OK" a recommended action, • Staff performs action, and • Committee Chairperson reports action to the full Council at its next meeting. Fast Track Special Committee Meeting with Mayor's Signature Process Model (Option B) The steps of this process would include: • Staff would schedule and post a "Special Meeting" of the Legislative Committee, 0019303.01 -2- 06/10/96 3:48 PM RL-t�UEST FOR COUNCIL ACTI1... MEETING DATE: June 17, 1996 DEPARTMENT ID NUMBER: - AD 96-21 • The Legislative Committee would meet and direct staff to meet, • The Mayor would authorize staff action, • Staff.performs action, and • Committee Chairperson reports action to the full Council at its next meeting. To successfully voice the City's opinion, the process used must be flexible with respect to time. However, any modified process must be sensitive to any concerns of the full Council. The specific model or option used is dependent upon when the position/action request is introduced into the "normal" process. Staff recommends these options be approved by the City Council and used to meet the time constraints faced .when voicing the City's position on intergovernmental issues. Last day for policy committees to report same - house bills for referral to fiscal committees. Jan 26 Last day for committees to report same -house bills introduced in 1995. Jan 31 Last day to pass same -house bills introduced in 1995. Feb 23 Last day to introduce bills. Mar 26 Primary election. Mar 28 Easter Recess begins at day's end. Apr 8 Legislature reconvenes. Apr 19 Last day for policy committees to report same - house bills for referral to fiscal committees. May 10 Last day for policy committees to report same - house non -fiscal bills to Floor. May 17 Last day for policy committees to meet prior to June 3. May 24 Last day for fiscal committees to report same - house bills to Floor. Last day for fiscal committees to meet prior to June 3. May 31 Last day to pass same -house bills. June 3 Committee meetings may resume. June 15 Budget must be passed by midnight. June 27 Last day for a legislative measure to qualify for the Nov 5 general election ballot. July 5 Last day for policy committees to report other - house bills. Summer Recess begins at day's end if Budget Bill has been enacted. Aug 5 Legislature reconvenes. Aug 16 Last day for fiscal committees to report bills to Floor. Aug 30 Last day to pass bills to take effect Jan 1, 1997. Aug 31 Final Recess begins at day's end. Sept 30 Last day for Governor to sign or veto bills passed on or before Sept 1. Oct 2 Bills enacted on or before this date take effect Jan 1, 1997. Nov 30 Adjournment sine die midnight. Dec 2 1997-98 Legislative Session begins at 12 noon.
