Analysis:
This item is in response to a request by Council to review options for streamlining the filing
of Notices of Completion. At the conclusion of every capital improvement project, the
Public Works Department requests that the City Council accept the project and direct the
City Clerk to file a "Notice of Completion" with the County Recorder's office. This task can
be performed administratively with the adoption of the appropriate resolution. Adoption of
the resolution will expedite the process for filing Notices of Completion, and eliminate the
need for City Council action to accept each project.
The "Notice of Completion", as defined by Section 3093 of the California Civil Code,
requires that the notice be signed and verified by the owner "or his agent" and then filed in
the office of the County Recorder within ten days after project completion. Since the statute
itself delegates the authority to appoint an agent to process the acceptance and the
notices, adoption of this resolution is appropriate.
Public Works Commission: Not required.
Environmental Status: Not Applicable
