BEARDSLEY, Director of Public Works PREPARED BY° Xv,4p. 2 0 0 2 w/ SUBJECT: ADOPT RESOLUTION TO FILE NOTICE OF COMPLETION Statement of Issue, Funding Source, Recommended Action, Alternative Action(s), Analysis, Environmental Status, Attachment(s) Statement of Issue: The City Council may adopt a resolution authorizing the Director of Public Works or the City Engineer to file a Notice of Completion (NOC) for construction projects. This will allow the NOC filing with the County Recorder without requiring City Council action. Funding Source: No funds are required for this action. Recommended Action: Motion to - Adopt Resolution No ao0-7--/a of the City Council of the City of Huntington Beach authorizing the Director of Public Works or the City Engineer to accept the construction projects as complete and file a Notice of Completion in the office of the County Recorder. Alternative Action(s): Do not adopt the resolution. At the conclusion of every capital improvement project, the Public Works Department requests that the City Council accept the project and direct the City Clerk to file a "Notice of Completion" with the County Recorder's office. This task can be performed administratively with the adoption of the appropriate resolution. Adoption of the resolution will expedite the process for filing Notices of Completion, and eliminate the need for City Council action to accept each project. The "Notice of Completion", as defined by Section 3093 of the California Civil Code, requires that the notice be signed and verified by the owner "or his agent" and then filed in the office of the County Recorder within ten days after project completion. Since the statute itself delegates the authority to appoint an agent to process the acceptance and the notices, adoption of this resolution is appropriate. Public Works Commission: Not required. Environmental Status: Not Applicable Attachment(s): RCA Author: Shoja:jm C:\windows\TEMP\02-008 Feb 19 Shoja (Resolution for Notice of Completion).doc -3- 02/08/02 11:07 AM ATTACHMENT #1 RESOLUTION NO. 2002-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE DIRECTOR OF PUBLIC WORKS OR THE CITY ENGINEER TO ACCEPT THE CONSTRUCTION PROJECTS AS COMPLETE AND FILE A NOTICE OF COMPLETION IN THE OFFICE OF THE COUNTY RECORDER WHEREAS, the City Council presently accepts the construction projects as complete and the City Clerk files a Notice of Completion with the County Recorder's Office at the conclusion of every capital improvement project; and The Council finds that the approval of completed projects may be handled expeditiously as an administrative function, NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Huntington Beach as follows: SECTION 1. The Director of Public Works or the City Engineer is hereby authorized to accept construction projects as complete at the conclusion of every capital improvement project. SECTION 2. The City Clerk is hereby authorized to file the Notice of Completion in the office of the County Recorder within 10 days after the project completion.
