He informed the Council that the contract apt only permits, but requires joint participation with other organized service bodies. Such joint occupancy, of course, must be on a basis of mutual agreement as to time and date. At the council meeting of August 20th, 1964, the - - a+n -Valley American Legion post requested the City Council to allow that post to use Lake Park Clubhouse. In the course of the discussion, the Council requested me to investigate the possibility of this post using Memorial Hall pursuant to the conditions of the existing agreement between the City of Huntington Beach and Joseph Rodman Post No. 133• I have reviewed that lease and I note that on Page 3, starting at Line 24, is the following language: "It is further understood and agreed that the second floor of said building,shall at such times as the same may not be in actual use by the said Post, be made available by said Post under such reasonable terms,conditions,regulations and restrictions as may be imposed by them to any and all other organ- izations of veteran soldiers, sailors and marines who have served the United States honorably in any of its wars, together with their auxiliary organi- zations, without charge by said Post for such use. It has been the policy of the Council to deny use of the .Club-.. . . house as a regular meeting place for any organization. There have been one or two exceptions to this, i.e. , the Senior Citizens group was granted day time use on a weekly basis on Mondays, and a Girl Scout Troop was granted temporary use for a set date. The Clubhouse is, one of the few available places where various groups and organizations can hold an occassional meeting and the granting of permission for regular use will often create a hardship for many groups. With Memorial Hall being taken over by City offices and Council Chamber in the very near future, this will eliminate one more building whibh has been used by the public. . The Huntington Valley Post has already obtained a temporary charter. We would like the building for permanent use of our meetings. We understand that it should be free of charge for this purpose , but our post will be glad to lease the building for monthly or yearly basis. We would like to know the fee. Our post would like to use the building on the 1st and 3rd Thursday of every month. We would also like the key for the building, thus we are willing to make a key at our expense. Officers of the post will be responsible for care of the building. Your kindness and prompt attention to this matter will be greatly appreciated by all the members of the post. Re: Huntington Beach-Seal Beach Municipal Court Gentlemen: There appears to be a movement by the City of Westminster to have the jurisdictional District Court locat- ed in .their city. I believe that they realize the value to the town of having the Court in Westminster. I feel it would behoove the City of Huntington Beach to make a reason- able effort to retain the Court -here in the City and to co- operate with the County in this regard when and wherever nec- essary. The reasons are many. Herein outlined are some of the major seasons for retaining the Court within this City. 1. Accessibility to the Court will save the City expenses as .follows:_ (a) Police Department: Transporting prisoners to and from .the court and jail. Based on April 1964 figures, the cost of transpporting prisoners to and from the Court - 164 hours or approx- imately $600.00 (During the months of April thru October, the cost is doubled or $1, 200.00 Avefage miles traveled per day (twice each day) 40 miles ® 10¢ $4.00 per day x 26 days 104.00 (b) City Attorneys' expenses for mileage, time spent on the road to and from Westminster and the time spent waiting in Court. 1. (There are now 50 people in the local court It is foreseeable that the Court will em- ploy 150 people in the future) . (f) History has proven that the hub, businesswise, seems to revolve around the township in which the court is situated. This move would make Westminster the hub of our area, rather than Huntington Beach. This will become more and :more important as the area becomes more populated and the Court increases from the present .two divisions to the possibility of 10 divisions in the future. . Therefore, as the City Attorney of Huntington Beach, I recommend to the City Council that a concerted effort be made to stop the movement of the Court from the City of Huntington Beach. ! Jones It is requested that you arrange with the City painters to stencil the City Seal and the letters M.H. on the underside of all tables at Memorial Hall ; and the same with the letters L.P. on the tables at Lake Park Clubhouse. It is further requested that this matter be given as much priority as possible because of the fact that during the Christmas Season it may be necessary to exchange tables on occassion between the two buildings. City of Huntington Beach Cal ifontia April 2. 1962 Memorandum to City Engineer: Recently we have had a problem in protecting the public address system and microphone extension cords at Memorial Hall from damage as a result of teen-age dances being held there. After consultitg with the City Electrician, we arrived at cer- tain measures which would not entail a great deal of work on either his part or the part of the carpenter, yet it would provide additional protection in this matter. Also,, several months ago we discussed the possibility of stor- ing the stage platforms which receive very little use in the rental of the Hall, behind the curtains on the stage. A study in this matter showed that they are generally not used more than once or twice a year. It was determined that there would be room to stand them on end behind the curtains, providing hooks would be installed to hold them in place and keep them from toppling. It is therefore requested that the following work be scheduled at the convenience of your department: 1. That an extension on the public address outlet, which is presently in front of the stage, be made to the stage it- self, in order that the microphone may be pluggedel-n on the stage and, not in front of it. 2. That a switch which will turn the public address system on and off be extended outside the cabinet enclosing the public address system. Page #2 Mere. to City Engineer 3. That work be done on the public address cupboard to make it possible to lock it up completely, and yet to be access- ible for use of the record player. That the following repairs be made to the American Legion Hall, in Memorial Hall.. Repair of the roof, there are several leaks when it rains, and has ruined carpeting and furniture.. Repair of plaster, and it is badly in need of being painted, in the Legion Hall and adjoining rooms. Four of the light fixtures are not in working condition, and the electricial wiring would not pass inspection, under the code at the present time. , To the Councilmen who are not familiar with the Lease between the City and the American Legion, I will quote a portion of a para- graph from the lease, as follows: "that the said City will furnish, replace, refurnish and repair , and provide all. necessary custodians, employees, attendants and supplies for the proper maintenance of the said Memorial Hall.. The matter of the leaks from the roof, has been reported over a period of years, but the repair was never satisfactorily completed, due no doubt to the fact, that the termites have not been exterminated and dry rot removed. The termites are still present in the attic of Memorial Mall._ It is further respectfully requested, that in lieu of the privi- ledge the Post has of holding meetings on the main floor of Memorial Hall, that we be given the right, in exchange, of holding such meetings or social functions in the Lane Park club house, rent free. Again, I will quote from the Lease, for the benefit of those Councilmen not familiar with the Lease as follows: "The Post shall. have the _right to use of said main floor, for such functions, meetings, gatherings, dances or conventions as may be desired, by them." Window panes have been broken; windows will neither open nor shut; termites are rampant, leaving sawdust piles .-all over;• plaster is crumbling; the roof leaks leaving soggy water-stained walls; sections of wallboard are loose--some sections look as if they may fall and injure someone at any time; the hand rail on the stairway is very rickety and needs bracing; and last -but not least, the whole upstairs is in need of paint. Under terms of the lease between the City of Huntington Beach and American Legion Post No. 133, care, custody and control of the second floor of the Memorial Hall lies exclusively with Post No. 133. We have found that on numerous occasions un- authorized groups, committees and even unknown individuals have utilized the facilities of Post No. 133 leaving trash, dirt, beer cans, coke bottles and even evidence of lighted cigarettes having been dropped on the wooden floor to burn out, maring and scaring the floor. This emergency was met with utilizing the ground floor of our Memorial Hall as an Annex to the City Hall, and this area was remodeled into offices and Council Chambers. In the remodeling process, the emergency fire exit for the second floor of the Memorial Hall was eliminated, which has created a serious hazard for those who utilize this upstairs hall, as the only means of ingress and egress now is by the wooden front stairs which are, in themselves, a fire hazard. Also, the loss of this emergency fire exit has forced the Fire Department to limit the maximum capacity of the Legion Hall to 50 persons.
