The mortgae loan provided by the California Housing Finance Agency is to be
closed on gust 29, 1981. As part of the documents required to be submitted at
the time of the closing, it will be necessary for the City to certify that fire
protection will be available and is adequate to serve the 155-unit apartment
building.

Dear Mr. Thompson:
I recently had an opportunity to discuss your letter with Mr. Stuart Honse
of CHFA and he informed me that you have now been advised by Mr. Walter
G. Farr, Jr. , their executive director, that the mortgage and Section 8
commitment made to the subject property is not transferable. Your letter
has, however, raised some serious questions in their minds as to the
city's commitment to proceed with this development. They are therefore
asking for written reassurance from the City of Huntington Beach that
the city is not changing their position on this project.
CHFA further points out to me that any serious time delay would jeopardize
the mortgage and Section 8 commitment. I gave Mr. Honse my assurance that
The William Lyon Company is not delaying on this project and is now in the
process of completing working drawings. I'm sure it is not your intention
to jeopardize this project, and I would therefore request that either
yourself or the mayor promptly respond to Mr. Honse's request.

Dear Mr. Farr
As you may be aware , your agency has committed to .finance a 155
unit Section 8 new construction for the elderly project in
.Huntington Beach. The Huntington Seaview project is presently
scheduled to be constructed on property owned by the City of
Huntington Beach. and leased to the developer of the project , the
William Lyon Company of Newport Beach. The loan committee re-
commended, and the Board- of CHFA approved, mortgage commitment
for this project on March 12 , 1981 . The developer is now in the
process of preparing working drawings for this project .
The City has supported .this project and feels that such a project
will be a real asset in our community. In a recent review of this
project , however, City staff was able to locate what we believe
to be a much superior site - greater area , close to transportation ,
medical facilities and a nice park. I 'm writing to you at this
time to request information regarding the specific actions the
City might take to achieve the relocation of the project , along
with its mortgage commitment and Section 8 subsidy allocation to
this. new site . We would welcome your .comments and assistance on
the feasibility of relocating the project to this new alternative
site: The present site will be crowded and will not allow for
any future expansion .
I would like to emphasize that under no circumstances does the
City intend to withdraw its commitment to the project in its
current form if the project cannot be relocated. The developer
is continuing to prepare working drawings for the project and the
City staff is continuing to implement the steps preliminary to
commencement of construction. The City will acquire this new

site and pursue the relocation of the project only if it may be
accomplished without loss of the financing and subsidy commit-
ments from your agency, and without substantial time delay or
cost. to the developer.
We wish to determine the feasibility of relocating the Huntington

proceeding with the preparation of working drawings , and with
construction scheduled to commence within approximately four to
five months , I would like to respectfully request your , ssistance
in determining the feasibility of the suggestion of relocating
Huntington Seaview. I would like to have an opportunity to meet
and discuss this issue with you in the interests of a better
project.

SEAVIEW SITE
As you know,. I .have been requested to investigate the possibility. of relocating
the planned Huntington Seaview senior citizen Section 8 project to a new location.
One of the key.elements in assessing the feasibility of such a proposal is to
determine the attitudes and procedures of the CHFA.
The CHFA is providing the construction loan for long-term financing for the
Huntington Seaview project and the Section 8 subsidy commitment has also been
allocated by CHFA. I contacted the staff of CHFA on May .19, 1981, and broached
the subject of relocating the project. There follows information I was able to
ascertain at that time.
1. CHFA staff stated that it's very late in the process to consider a new
site for this project, especially in light of the fact that the developer
has already commenced working drawings.
2. To relocate the project at this time would require essentially CHFA
processing to begin from the start. While the CHFA staff would be availa-
ble to review a new site, there would be no guarantee that the site would
be approvable.
3. CHFA staff would be required to re-evaluate a new site, as well as the
design of the proposed facility, and determine if the architectural concept
of the current project would be appropriate on any new site.
4. At this time CHFA staff is occupied with reviewing a number of recently
received proposals in response to an advertisement. As a result, CHFA
staff could not review a new site for at least two weeks, with design and
management team comments available at least one week thereafter.
5. Any change in the site at this point would require the project to return
to the CHFA Board for review and reconsideration.
6. A delay of at least 6 months could be anticipated if the project were re-
located.
While the above information identifies the procedure that could be followed, and
the time that would be required to complete the review of any new site, there are
other factors involved in any modification of the Huntington Seaview proposal at
this time. These items are of crucial concern to the City.

7. The Board of CHFA has a new policy regarding the design of these
projects. All one-bedroom units can no .longer exceed 550 net square
feet. The one-bedroom units within Huntington Seaview contain 'between
550 and 675 net square feet; therefore, reconsideration of the project
at this time would result in. smaller units and this change would be
so substantial as to cause the architect to redesign the entire project.
8. The CHFA Board also has a new policy which prohibits rents on such
projects from exceeding the FMR's established by HUD by more than .10
percent. At the time the Huntington Seaview project was approved by
this Board this ceiling was established at 26 percent above the FMR's.
This reduction in the maximum rent allowable on the units would seriously
jeopardize the cash flow of the project and its ability to amortize the
mortgage. This would likely result in the financial infeasibility of
the Huntington Seaview project and its cancellation..
9. In addition, the CHFA Board has another new policy. The maximum loan
period for such a project is now 30 years. The Huntington Seaview project,
however, has a 40 year mortgage. Since the actual construction cost of
Huntington Seaview on a new site would be essentially the same as its
current projected cost (or perhaps more) , the reduction in the mortgage
term and the reduction in the maximum rent allowable would severely impact
the financial feasibility of the project.
10. Perhaps the greatest concern in attempting to relocate the.Huntington Sea-
view project is that there is a real and great risk that the Section 8
subsidies which make the units affordable to the tenants would be lost.
At this time CHFA is ._pushing al.l projects with Section 8 commitments
in response to a request from HUD for a greater production record by
this agency. With the exception of Section 8 subsidy funds already com-
mitted to specific projects and sites, no Section 8 funds are available
nationwide; in fact, it is anticipated that'the Section 8 New Construction
Program will not be continued by the Federal Government- in the upcoming
year. Therefore, the Section 8 funds already committed to Huntington Sea-
view constitute the City's last opportunity to participate in this housing.

tute such a substantial delay in the implementation of the project, the
CHFA has stated that they would likely reassign the subsidies to some
other project.

1. open air easement - the final wording of the easement will be worked out
between Huntington Beach and the CHFA.
2. Landscape plan - due to the fact- that no landscape plan has been provided,
the final plan is subject to the approval of .the CHFA.
3. Flues for unit heaters - schematic solutions for the stepping. end units were
discussed.. CHFA reserves the right to replace the wal'1 heaters with FAUs if, at
a later date, our flues do not really work. (especially in the 2 bdrm units) . The
City of Huntington Beach will most likely not accept heaters that vent on the
exterior wall.
4. Doors to units on southeast wing - the doors now do not directly line up - an
offset of three feet would be better. As we cannot provide this, we should look
into changing door swings to increase privacy.
5. Parking garage - six hcp spaces provided; as is an overhead rolling; door. The for-
mula for the number of spaces was-discussed- The project was designed to .H.B. City
requirements: 1 space .for 3. units. CHFA requires ,1 space for •2 units. 'Therefore
we are under-parked but the CHFA ;is accepting it, if we provide 6 to 8 hcp
parking spaces.
6. , Solar heating - both CHFA .and Huntington Beach would like to see solar in this
project. In the conditions for approval, the client has asked for a statement
of willingness to look at a solar proposal at a later date when more information
is available.
7. Green house - the City has expressed a desire to re-introduce this element into
the project if it is at all possible. This will require checking into previous
existing problems. CHFA is also interested in having this feature (located on the
roof of the three story section adjacent to the four story section) .
8. Unit refinement - refrigerators will be frost free; hcp bathrooms still are not
correct; a mgr. unit has yet to be submitted.
9. Design - upon loan commitment, there-,remain still at least three weeks of dcusign
on this project before working drawings can be started.
10. Architectural approval - Gene Lai gave the project architectural approval with
some reservation. He will be compiling a list of conditions we must meet.

the areas designated as "setbacks" on the Huntington Seaview site plan will be
reserved as open space in perpetuity. The Huntington Seaview project is developed
under an amendment to the City's zoning ordinance known as the. "Old Civic Center
Specific Plan". This specific plan closely identifies the setback requirements
for both the Huntington Seaview project, as well as the adjacent senior citizen
recreation center to be developed by the City.
I hope that this supplies .you with sufficient documentation of the setbacks
surrounding the Huntington Seaview project to permit the continued processing

1. To .satisfy set back requirements between the housing and senior citizen center,
we need a permanent open space easement established' by the City of Huntington
Beach.
2. Off site improvements - who is responsible? Where do we tie into the project?
3. Who is responsible for removing trees, existing buildings?
BUILDING
1. Ground Floor
A. We need sections through the center section (community space) and north eastern
wing showing type of construction,- materials, etc.
B. We need sections through ramps that connect the ground floor units (@ 8'-1"
ceiling height) with the common spaces (9'-l" ceiling height) . The maximum slope
is 1" in 12" , less is more desirable.
C. Hard surface for entry lobby near elevator.
D. Double door @ entry and exit in common area to the north. If this is a problem,
clarify why one door (3'-6") would be better.
E. The garage:
1) provide 6 to 8 handicap stalls, located so that a person does not cross,
behind a regular space to get to them.
2) provide gate detail - (a bi-gate) so space for motor does not obstruct parking .
space.
3) provide 2 ' @ latch side of door that connects the garage to the lobby.
F. No door to mechanical room from the lobby - enter from outside.
G. Access to manager's office from mgr unit to be provided.
H. Move 1st floor trash room @ north eastern wing indoors.
I. Provide shelving and slop sink in maintenance room/change doors.

9. Refine F unit: 3'-4" corridor, bathroom, not good (use a 6' tub) .
10. Wall heaters do not work in 2nd bedrm of G unit, G's bathroom is too tight.

his attendant would be most .beneficial,
Currently, the housing component of the Dayl,e McIntosh Center has a
list of some fifty (50) persons who require two ((.) .bedroom units.

Thank you for the opportunity to rneet with you and your staff on November 3; 1980. In
response to your request at that time, .i am transmitting herewith information that you
requested.
I. Demolition and Site Deliver The municipal building that is existing on the site
or untington Seaview will e demolished by a firm under contract with the
City of Huntington Beach, and the City will prepare the demolition
specifications. The City is funding this demolition with Housing and Community
Development Block Grant funds. Demolition is scheduled to occur in January,
1981. The site will be delivered to the William Lyon Company with all debris
removed and ready for the commencement of construction. The City will not,
however, do any grading for the new project.
2. Enclosed please find a letter of certification that the Huntington Seaview site is
not within a federally designated floodplain.
3. Also enclosed, please find a copy of the Conditional Use Permit (No. 80-11),
including the 13 conditions approved by the Plcnning Commission, May 6, 1980.

In addition, the most recent yet still unofficial in-
formation (a Special Flood Insurance Study and Prelimi-
nary Map) prepared by the Los Angeles District Corps of
Engineers for the Federal Emergency Management Agency, and
released in January 1980, also indicates the property is

Location: The subject property is located on
a parcel bounded by Main, 5th and 6th
Streets and Orange Avenue.
Date.-of Approval : May 6 , 1980
FINDINGS':
1 . The proposed 157 unit senior citizen housing complex complies with
all applicable provisionsof the Huntington Beach Ordinance Code
and specifically Article 914 , the Old Civic Center Specific Plan.
2 . The General Plan sets forth provisions for this type of land use- as
well as setting forth objectives for implementation of this type of
housing .
3 . The Planning Commission has received the staff report and all pertin-
ent information submitted to them for their deliberation.
CONDITIONS OF APPROVAL:
1 . The site plan received and dated March 25, 1980 shall be the approved
layout.
2 . The floor plans and elevations received and dated March 25 , 1980
shall be the approved floor plans and elevations .
3 . The applicant shall comply with all of the conditions set forth in
the approved and signed participation agreement between the City of
Huntington Beach and the William Lyon Company.
4 . Fire protection system, ..including automatic sprinkler system, stand-
pipe system, fire hydrants , fire alarm system, and any other required
fire protection and detection devices or systems shall comply with
the specifications of the IIuntington. Beach Fire Code . Plans for such
systems and devices shall be submitted to the Fire Department and shall
be subject to approval by the Departments of Fire and Public Works .
5. Natural gas and 220V electrical shall be stubbed in at the location
of clothes dryers .

6 . Low-volume heads shall be used on all indoor . showers .
7 . All building spoils , such as unusable lumber, wire, pipe, and other
surplus or unusable material , shall be disposed of at an offsite
facility equipped to handle them.
8 . The structures on the subject property, whether attached or detached,
shall be constructed in compliance with the state acoustical stand-
ards set forth for units that lie within the 60 CNEL contours of the
property. Evidence of compliance shall consist of submittal of an
acoustical analysis report prepared under the supervision of a person.
experienced in the field of acoustical engineering; such report shall
be submitted with the application for building permits . All measures -
recommended to mitigate noise to acceptable levels shall be incor-
porated into the design of the project.
9 . If lighting is included in the parking lot, energy efficient lamps
shall be used (e.g . , high-pressure sodium vapor, metal halide) . All' .
outside lighting shall be directed to prevent "spillage" onto ad-
jacent properties .
10 . A detailed soils analysis shall be prepared by a registered soils
engineer . This analysis shall include onsite soil sampling and
laboratory testing of materials to provide detailed recommendations
regarding grading, chemical and fill properties , foundations ,
retaining walls , streets , and utilities .
11 . A plan for silt control for all storm runoff from the property dur-
ing construction and during initial operation of the project shall
be submitted to the California Regional Water Quality Control Board
staff for its review prior to the issuance of grading permits .
12 . The applicant, shall provide a solar-assisted hot water system for
the entire proposed residential project. If the applicant subse-
quently can provide information to the. Director of Development
Services proving that the solar system is . not economically feasible
at the time of construction, this condition may be waived and . a gas-
fired central hot water system shall be installed .
13 . The developer shall provide individual cable television hook-ups to
each residential dwelling unit within the complex at the time of
construction.
I hereby certify that Conditional Use Permit No . 80-11 was approved by
the Planning Commission of the City of Huntington Beach, California, on
May 6., 1980 upon the foregoing conditions and citations .

Council of the entire project.
2. A change in the building configuration would require the project to be re-reviewed .
by the Planning Commission (one composed of different members than those who pre-
viously reviewed it) .

This. project must adhere to the HUD MPS to get Section 8 funds. But ••it will not.

5. The stated income from the commercial segment was questioned by Margo. In fact,
whether itIis. to remain at all in the project is doubtful. Therefore it will not
be included when computing income. ;3
6. Two bedroom units could be reinstated into the project if there is determined to
be a need for. them (handicapped units) . They must be kept to less than 10 in
number including the manager's unit. Efficiency or "0" bedroom units-are still out.

It is my pleasure to inform you that the Article XXXIV referendum
measure placed on the June 3, 1980 ballot by the Huntington Beach
City Council has met with the approval of the voters . The final
vote count on our Proposition L was 25, 003 in favor and 16 , 800
against the measure (copy of Proposition L enclosed) .
The immediate impact of the passage of this measure is upon the
Huntington Seaview elderly housing project now under review by your
Agency. With the referendum approval, it is my understanding that
it is now possible for this project to receive Section 8 New Construc-
tion subsidies for 100 percent of the units . I also understand that
the sponsor of this project, the William Lyon Company, has expressed
to you its- desire to achieve a 100 percent subsidized project.
I would like to forward to you the City ' s endorsement of the concept
of full Secion 8 subsidy for the 157 units of Huntington Seaview.
The seniors in Huntington Beach find it increasingly difficult to
secure decent housing at an affordable cost and the full subsidiza-
tion of Huntington Seaview would provide additional stable and
affordable housing to meet their needs .

market conditions and the ability of CHFA to provide 8h% financing for this

I would also like to advise you that the County of Orange and City of
Huntington Beach have both processed resolutions for the June ballot for

As you know ,- we finance interim construction loans with short-
term bond anticipation notes and permanent loans with long-term
bonds. We are , at present , unable to proceed with commitment of
new loans and closing of some committed loans presently on our
books, because high interest rates prevent us from being able to
sell bonds and notes at rates which make projects feasible.
We have been processing the referenced proposal anticipating
that we could make a loan commitment at_8% in the near future.
If you choose to continue this process , -it should be with full
understanding that we have no funding available at present but:
that our best efforts are being made to secure funds that would
provide a rate of 101ro for both short-term and long-term
financing. We hope to achieve this within the next 90 to 3.80
days . We cannot , however , be certain of when the Agency w11..
again be in a position to make loan commitments , or when funds
will be available for project cicsings.
Please respond, in writing, within the next 15 days with your
decision on whether or not you wish to continue processing your
project under these conditions.

It becomes clear that either a new market must be located for 51%
of the units, now that the Section 8 existing program through the
Housing Authority may not be implemented, or that Referenda Authority
must be approved by the voters of the City of Huntington Beach for
this project .
Last Friday I met with Stephen Kohler at a NAHRO conference and he
spoke of the possibility of a November 1979 ballot for Article 34.
The successful outcome of this election would cancel the need for
your marketing outreach program and so, I would suggest that you
monitor the progress of this measure.

I have reviewed the request from Reed Flory for a determination
as 'to whether Article 34 referendum authority is needed on the
Huntington Beach project. I have determined that referendum
authority is needed.
Article 34 states that "No low rent housing project shall here-
after be developed, constructed , or acquired in any manner
by any state public body until, a majority of the qualified
electors of the city, town, or county, as the case may be . . .
approve such project by voting in favor thereof. . . . " There
are three determinations that Article 34 requires us to make
in this kind of situation.
1. Is the housing development a project?
2. Is a state body developing , construction or acquiring
the project?
3. Is the project low rent?
The 157 unit development on one site is .clearly a project under
any definition. Elliott makes clear that in our main multi-
family program our invo vl ement constitutes development. So the
only question that remains is whether the project is low rent?
HCD determined that the project was not low rent because only
490 of the units would be subsidized by the Agency. They deter-
mined that it was irrelevant whether or not additional units
will be occupied by families with Section 8 certificates adminis-
tered by the housing authority. My reading of the Elliott and
Patitucci cases leads me to a different conclusion.
The Patitucci case discusses the meaning of low rent by looking
to the actual persons living in the project to determine if it is
"in effect a low income project" . It found that since the develop-
ment was one "in which less that 1/2 the units are intended for
persons of low income, it did not fall within the meaing of
Article 34 because "it represented an obvious good faith effort
to integrate low income tenants into a larger community in which
the majority of people (at least 51%) are higher on the economic
scale. "

The Huntington Beach project clearly does not meet these
requirements. It is the stated intention of the developer
to rent a significant number , perhaps up to a total of 80% ,
of additional units to Section 8 tenants. This obviously
is more than the 75% which the Court in Elliott found to be
sufficient to hold that the project was low rent.
Please let me know if you need a more detailed discussion
or, if you want me to speak with the development directly.

1 . HOUSING ASSISTANCE PLAN CONSISTENCY
The subject project for 83 assisted units for the elderly and the
handicapped is not inconsistent with the City' s HUD-approved Housing
Assistance Plan. The City posts no objection to your approval of
this application.
2. LOCAL ORDINANCES
The City is preparing, and intends to adopt a specific plan amend-
ment to the Zoning Ordinance to accommodate this project. The City
Council approved a General Plan Amendment to accommodate this project.
3. OTHER LOCAL CONCERNS
In addition, the City has budgeted and received HUD-approval of
CDBG funds in the amount of $550, 000 to assist with off-site improve-
ments for this project and to construct a 10, 000 square foot senior
citizens recreation center on an adjacent parcel ($450, 000 of total) .

struct the senior citizen housing on the old civic center site, proposes to fin-
ance the development through CHFA.
The enclosed forms are copies of what has been forwarded to CHFA in the
initial processing application.
