BRANCH, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF PECAN AVENUE WHEREAS, on July 16, 1979, the City Council of the City of Huntington Beach duly adopted Resolution No. 4776 de- claring its intention to vacate a portion of Pecan Avenue, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of August . 6, 1979 at the hour of 7 : 30 p.m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all .persons. interested in or objecting to the proposed vacation, which time was not less than fifteen. (15) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along that portion of Pecan Avenue proposed .to _be vacated and such notices were posted not more than three hundred (300)' feet apart and at least three_ (3) were .posted,'. On August 6, 1979, at the hour of 7 : 30 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did. convene for the purpose of hearing all persons interested in or objecting to the proposed vacation o.f Pecan Avenue, at which time no- objection was made to said vacation, and evidence was presented showing that such- proposed vacation was not necessary for present and prospective public street purposes and is not suitable for use or development as bicycle paths or routes. Palin Department Development Services Date Prepared July 3, ' 1979 Backup Material Attached © Yes No Subject RESOLUTION OF INTENTION TO VACATE A PORTION OF PECAN AVENUE; OLD CIVIC CENTER PROJECT City Administrator's Comments Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions; STATEMENT OF ISSUE: To accomplish the implementation of new senior housing and recreation facilities at the Old Civic Center, it is necessary to vacate a portion of Pecan Avenue. The appropriate Resolution of Intent has been pre- pared and is attached for the Council ' s consideration. RECOMMENDATION: Adopt Resolution No. a resolution of the City. of Huntington Beach of intention to vacate a portion of Pecan Avenue. ANALYSIS: Since the right-of-way of Pecan Avenue on the Old Civic Center site has never been officially vacated, it is necessary to do so at this time to accommodate the City' s plans for the site. This is necessary even though the right-of-way has been used as a parking lot for a number of years. The first step in the vacation procedure requires that the Planning Commission make a determination that the action is consistent with the General Plan. Such finding was made by the Planning Commission on June 5, 1979 , and a copy of the Commission' s Notice of Action is attached for the Council ' s review. The Resolution of Intent provides that, after adoption, the site will be posted with notices of intention to. vacate the right-of-way and that a public notice will be placed in the newspaper. It also sets the date for a public hearing on the vacation for Monday, August 6 , 1979 at 7: 30 p.m. in the Council Chambers, at which time the Council may, after hearing any members of the public, consider adoption of a second resolution that will actually vacate the right-of-way. The street vacation is being requested in order to incorporate this area into the site upon which a Senior _Citizen Housing and Recreation Complex is to be built. 2 .0 ANALYSIS • The Pecan Avenue right-of-way in question encompasses a land area of one-third of an acre, and is presently utilized as a parking area to serve the library annex and other uses on the old civic center site . The right-of-way has been used for parking for many years and during this time has remained partially open to through traffic. The pro- posed Senior Citizen Housing and Recreation Facility will be constructed on the entire 3. 5 acre site and will necessitate the removal of the existing parking area. The policy of "developing a system of arterial streets and highways that ensures the. safe and efficient movement of people and goods" is somewhat deterred; however, the street section in question has been semi-closed for many years and the volume of traffic using this street could easily be diverted to other local streets in the area with little or no dis- ruption. Furthermore, the vacation of this street and the construction of the Seniors ' project will further a number of other General Plan housing and land use policies , among these: "conserving and expanding the housing stock, especially for persons of low and moderate income . Subsequent analysis of the site re- vealed that the portion of Pecan Avenue crossing the site has never been formally abandoned, although that portion of Pecan Avenue has been used primarily as a parking lot for a number of years. In order to complete the abandonment of Pecan Avenue, a legal description of Pecan Avenue between Fifth and Sixth Streets will be needed for the Resolution of Abandonment. I have discussed this situation with Charlie Davis and understand that Dick Boucher has the original subdivi- sion map for the old civic center property. Attached is a copy of the original deed for the property and a plat map indicating the area requiring a legal description.
