S. Constitution. The float is entered by the California Bicentennial Foundation on behalf of the people of California, with a campaign under way encouraging Californians to become rose sponsors. Individuals pledging a tax-deductible contribution of $10. 00 will receive a limited edition commemorative pin, certificate of participation, pocket Constitution, and will have their names placed on a scroll to be carried on the float. In addition, contributors will be eligible for a drawing to ride the float with celebrities representing California's diverse heritage. Responding to the theme for the 1988 New Year's Day Tournament of Roses Parade, "Thanks To Communications, " the Bicentennial float is entitled "The Constitution: 200 Years of Communicating Liberty. " It depicts the Constitution and Independence Hall connected by two. giant flags to a future represented by Astronaut Buzz Aldrin astride a Martian landscape. The float will depict 200 years of Constitutional society by using the largest American flags ever constructed of roses to link past and present frontiers Symbolized by a replica of Independence Hall and Buzz Aldrin astride a Mars landscape. 'Ihe float will also carry Bicentennial Ben, the Bicentennial mascot, and representative Californians standing adjacent to the Independence Hall replica. Sign-On Constitutions signed by over one million residents and scrolls with the names of all rose sponsors will also be included in the float. Californians will be encouraged to make a $10.00 tax-deductible donation to sponsor each rose and in return: 1. Be identified on a scroll that will be carried on the float; _ 2. Orange County Bicentennial Committee of the United States Constitution Summary of Meeting September 24, 1987 Members Present: Jane Gerber, Chair, Evelyn Carrillo, Wanda Cullers for Jack Peltason, Helen Curtis, Adrian Kuyper, Colleen McGregor, Harmon Scoville, James Silva, Lecil Slaback. Guests: Cathy Glasgow, Harbors, Beaches and Parks; Michelle Reinglass, Orange County Bar Association. Executive Officer: Robert Selway Staff: Mary Gass 1. The summary of the August 13, meeting was reviewed. Scoville moved and Kuyper seconded that the summary be approved as written. The motion passed unanimously. 2. Special Event Report Scoville reported on the September 16 program presented by the Orange County Bar Association and the Orange County Trial Lawyers Association, which was co-sponsored by the Committee. The program was excellent, although attendance was low. Curtis reported on the successful September 17 program presented by Rancho Santiago College, which was accompanied by a resource guide publication. Gerber reported on a program sponsored by the City of Westminster which resulted in 12,000 signatures for the Constitution sign in project. McGregor reported on the Knotts Berry Farm celebration, which was very successful. Commemorative pins were handed out. 3. Federal Recognition Gerber reported that official Federal recognition has been obtained. The committee is now able to utilize the official logo and can obtain pins, which could be used as fund raisers. 4. Formation of 501c3 No report. 5. Project Status Reports a. Freedom Shrine. McGregor, on behalf of the Committee and in conjunction with the Exchange Clubs of Orange County, is coordinating a proposal to the Chairman of the Board of Supervisors to place a Freedom Shrine in the Hall of Adminis- tration. McGregor would work with the various entities to organize a reception for the placement of the collection of framed, historic documents. r Summary of Meeting September 24, 1987 Page 2 b. Citizen Signature Constitutions. Staff has obtained the Constitution Sign-On package which contains 1000 facsimile Constitutions and assorted other items such as banner, small liberty bell and cassette tape. Cathy Glasgow of Harbors, Beaches, and Parks made a presentation regarding the celebration of. Irvine Park's 90th anniversary. A special program is being planned for the event October 4, 1987. One of the elements of this program will be a presentation of a constitution bicentennial plaque by the National Arborists Association and the International Society of Arborculture. The plaque will com- memorate an Oak tree as over 200 years old and a witness to the era of the signing of the constitution. Glasgow requested permission to use the sign on package as a way to enhance this ceremony. A booth would be provided and staffed by ranger reserves. The Committee would be credited as co-sponsor of this activity. McGregor moved and Silva seconded that the Committee endorse this proposal and make the materials available to Harbors, Beaches and Parks. The motion passed unanimously. c. Constitution - Historical and International Context. Gerber distributed a clipping regarding the longevity of the constitution in relation to the constitutions of other countries. Selway suggested that the committee might pursue this theme of the historical and international context of the constitution in working with schools, news- papers, etc. , on research, writing, etc. projects. 6. Liaison with Orange County Cities. As of September 23, 1987, there are fifteen Orange County cities that have officially recognized constitution bicentennial committees. Gerber suggested the Committee send a letter to all the cities urging them to form committees and requesting the names of members of those committees which exist. It was suggested a questionnaire be included as well as an explanation of the five years of celebration and different themes. Curtis suggested this committee keep a scrapbook of constitution bicentennial events throughout Orange County including as many cities and organizations as possible. McGregor noted this item could be sent to the Orange County archive, when the committee dissolved. Scoville moved Curtis' suggestion and McGregor seconded. The motion passed unanimously.. Curtis will maintain the scrapbook. She requested that the letter going to cities include a request for materials. 7. Next Meeting The next meeting will be November 5, at 1:30 p.m. in the Hall of Adminis- tration fifth floor Conference Room A. Introductions were made. 2. The summary of the July 1 meeting was approved as written. 3. Gerber announced that Orange County has been recognized by the State as a Designated Bicentennial Community. 4. Regarding bylaws, Rau moved, and MacLeod seconded that the Bylaws be approved as presented. 5. Regarding future activities, Rau suggested that the five-year length of the celebration be emphasized. Rau moved and McGregor seconded that the Committee endorse a forum on October 22 to be sponsored by the Constitutional Rights Foundation. The motion passed. Gerber informed the Committee that poster size copies of the Constitution for citizen signatures can be ordered. Staff was requested to investigate. McGregor suggested that the Exchange Club be contacted for the placement of a "freedom wall" (a display of historically important legal documents) in the Hall of Administration. She agreed to initiate contact. The use of traveling exhibits on the Constitution and related subjects for display in the Old Courthouse was suggested. 6. Regarding funding, Rau moved and McGregor seconded that the Committee take the necessary steps to establish a non-profit entity to provide a vehicle for raising, holding, and dispensing funds for purposes of this Committee, and that the Chair designate three to five members to serve as board members. The motion passed, Evelyn Carrillo, Dorothy Hughes, and John Rau will serve as board members, 7. Regarding staffing, Selway explained the services staff could provide, and several organizations were suggested as possible sources for volunteer staffing of activities. - 8. Staff reported that they had been told by the State office that it would not be possible for the Committee to co-sponsor the kick-off celebration at Knott's Berry Farm on September 17. A committee member will be contacting the California Bicentennial Foundation Chair for further discussion. 9. The Committee heard a proposal for a kick-off reception for the Constitution's Bicentennial to be hosted by the Orange County Bar Meeting Summary August 13, 1987 Page 2 Association on September 16, 1987. , McGregor moved and Rau seconded that the Committee endorse this program as presented. JW:no(WP6-23)7211 r DRAFT BY LAWS NAME Section 1 . Name The name of this organization shall be the "Orange County Bicentennial Committee of the United States Constitution. " PURPOSE Section 2. Purpose The Committee is established for the purpose of organizing or participating in activities appropriate for the celebration of the Bicentennial of the United States Constitution, by sponsoring events or joining as co-sponsor or otherwise coordinating with other Orange County and State and national public or private bicentennial groups and events. DURATION Section 3. Duration The Committee shall exist for five years marking the time from the drafting of the Constitution to the ratification of the Bill of Rights. MEMBERSHIP Section 4. Membership The Committee shall consist of 17 members. The Chairperson and two members of the Historical Commission, the District Attorney, the Public Defender, the County Counsel , the Presiding Judge of the Superior Court and two appointees from each Board office appointed by the Board of Supervisors. Each member shall have an alternate to represent him or her in his or her absence at meetings of the Committee who shall be counted for the purposes of quorum and voting at such meetings. The number and membership may be changed at any time by the Board of Supervisors. r DRAFT OFFICERS Section 5. Officers The Chairman of the Committee shall be the Chairperson of the Orange County Historical Commission. The Committee may appoint such co-chairman or alternate chairman as from time to time the Committee desires. The Committee may also appoint subcommittees as the Committee desires. Members of the subcommittees may or may not be members of the Committee. STAFF Section 6. Staff The executive officer for the Historial Commission will be Executive Officer for this Committee. MEETINGS Section 7. Meetings The Committee will meet as needed or as desired by Committee at a time and place designated by the Committee. The procedure and rules for calling and conducting its meetings shall be in conformance with the Ralph M. Brown public meeting law, Section 54950 et seq. , Government Code. Okounty 9of Orange 0 August 5, 1987 TO: Rob Selway, EMA FROM: Richard Keefe, CAO SUBJECT: Fund Raising for the Bicentennial Committee I have looked into the question of fundraising that was brought up at the first meeting of the Bicentennial Committee. There are two ways that the Committee could go: 1) establish a non-profit corporation or 2) set up a separate County Fund Budget Unit. Non-Profit Corporation The Bicentennial Committee could set up a separate non-profit corporation along the lines used by the Office of Protocol . There is paperwork involved in setting up a non-profit corporation but once established, the Committee would have a free hand in receiving and spending money as they saw fit. The corporation board itself could consist of members other than the members of the Bicentennial Committee but some Committee members should be board members to assure financial control . The corporation board would only need to meet once or twice a year to conduct its business and there are certain filings that must be made with the IRS and others annually. The Committee would need the assistance of a volunteer tax-lawyer or account- ant to incorporate and file for tax exempt status and the assistance of a CPA to set up the books. County Fund Budget Unit We could set up a Fund Budget Unit (FUBU) for the Bicentennial Committee that would receive all contributions and from which expenditures could be author- ized. While this is clearly a simpler process than setting up a non-profit corporation, this is fraught with practical difficulties. Since it is a County budget unit, it is governed by all the rules and red-tape of County financial procedures. The Committee would have to establish an annual budget and estimate how much revenue it would receive in the ,coming year and this budget would have to be approved by the Board of Supervisors. The Committee's appropriations (that is, any money it intends to spend) would have- to equal its estimated revenues. If the Committee failed to raise as much revenue as it estimated, the County would have to make up the difference. If it received more revenue than anticipated the Committee would have to ask the Board of Supervisors to approve an equal increase in its appropriations before the Committee-could spend the extra money. F 8504 88 0/8a) Rob Selway August 5, 1987 Page 2 The purposes for which the money is to be spent, too, would be governed by County rules. These rules are restrictive and could easily prevent the Committee from spending money on items that it desires. Too, the Committee would have to abide by County purchasing procedures when exceeding petty cash purchases. This means purchase orders and going through our Purchasing Depart- ment with all the delay that often entails. Recommendation In short, while the County FUBU approach is simpler to initiate, it is vastly more restrictive than establishing a non-profit corporation. The Committee would be subject to the delays and time constraints of bureaucratic procedure, and the necessity for Board approval for every expenditure. Once the non- profit corporation were set up, on the other hand, the Committee would be free to pursue its business as it saw fit unhindered by these complications. That is why I strongly recommend that the Bicentennial Committee opt for creating a non-profit corporation to handle its financial matters. Box 4048 Santa Ana, California 92702 Re: Orange County Bar Association Kick-Off Reception For Constitutional Bicentennial, September 16, 1987 Dear Ms. Gerber: I am contacting you at the suggestion of Mr.Rob Selway, whom I understand is a member of your Commission on the United States Constitutional Bicentennial. My committee of the Orange County Bar Association is sponsoring a Bicentennial Kick-Off Reception on the evening of September 16, 1987, from 5: 30 to 7: 30 p.m. in the Plaza of the Flags behind the Orange County Superior Courthouse in Santa Ana. We are in the process of obtaining approval through the County and City of Santa Ana Joint Powers Commission, and have ascertained that no other organization or association is planning an event for that evening which would conflict with ours. We declined to sponsor an event on September 17,the date of the actual Bicentennial, in light of the number of other functions including that of the Federal Court in Los -Angeles, Buena Park at Knott' s Berry Farm, and I believe the City of Santa Ana, to name a few. We have requested and are awaiting confirmation for partici- pation of the El Toro Marine Base Marching Band to open and close the reception. We are in the process of seeking a large-name person or entertainer as our main speaker and/or performer, with further speeches to be given by Stuart Waldrip, the president of the Orange County Bar Association, and a high school student who will also be speaking at the Federal Court function on September 17 . We will be inviting for our platform the members of the Board of Supervisors, as well as members of the government, judiciary and other dignitaries. We are also receiving participation by E 0 local restaurants to set up booths surrounding the platform and ' E\� provide food and drinks. We have received a commitment from�e 19�1 EMA Taco for its Del Taco Mobile Van, and are hoping to obtain a commitment from Coca-Cola Bottling Company. A number of other restaurants, have been contacted, and we are awaiting approval from them. We did get off to a somewhat late start, having only started our preparations in May, however, we are moving ahead quite rapidly with regular weekly or biweekly meetings. Through the Public Relations Committee of the Orange County Bar Association, we are planning a substantial amount of press coverage, both through press releases, PSA' s, and announcements in the local newspapers. We will also be submitting flyers to members of the Bar Association, and mailed personalized invitations. We would like to request the participation of your Commission and Committee as a co-sponsor, with a commitment for some assistance as needed, or wherever such can be provided. The committee will organize local activities surrounding celebration of the 200th anniversary of the Constitution. "The bicentennial is an opportunity for citizens 'to learn more about their government and pay tribute to the document that produced a way of life envied the world over," said Jane Gerber of Westminster, chairman of the committee and the Orange County Historical Commission. Both the national and county committees will observe the bicentennial for five years, marking time from drafting of the document to ratification of the Bill of Rights. Committee appointees include Historical Commission members Lecil Slaback of Silverado and Colleen McGregor of Buena Park. Also District Attorney Cecil Hicks, Public Defender Ronald Butler, County Counsel Adrian Kuyper and Presiding Judge Harmon Scoville. Gerber opened the meeting at 1:35 p.m. , and asked members to introduce themselves. 2. Selway discussed the background of the Committee's formation. 3. Scoville moved, and Rau seconded, that County Counsel draft the Committee's Bylaws. The motion passed. To help with the drafting of the Bylaws, Gerber suggested the Committee discuss its perceived goals. Arising from the discussion were the following goals: The Committee will pursue co-sponsorship of events with other bicentennial organizations and sponsor events of their own on a limited basis. Subcommittees will be formed as needed. Co-chairs to assist with the Committee and subcommittees were also discussed. Sources for volunteer staff will be investigated. 4. Possible projects were discussed, including: participation in the dedication of the Old County Courthouse; participation in the annual Law Day celebrations; participation in the Knott's Berry Farm event on September 17, 1987. Personal contact will be made concerning the event at Knott's Berry Farm with a letter to follow. 5. The next meeting will be held on August 13 at 1:30 p.m. 6. As no money has been budgeted for the Committee, it was explained that the intent was for the County to cover minimal staffing, but the CAO with County Counsel were asked to see if the Committee has authority to raise funds for events involvement, staffing assistance, etc. and, if so, what the procedures would be. -1- ry At the end of the meeting, assignments discussed were summarized. o Following contact by committee members, staff will write a letter to the California Bicentennial Foundation, as appropriate, regarding co-sponsorship of the event at Knott's Berry Farm. o CAO will check the proper mechanisms for fund raising, the deposit of contributions, etc. o County Counsel will. draft a set of Bylaws. o Staff will contact the Public Information Office and provide information for preparing a press release. o Staff will prepare a meeting summary. o Committee members will check for availability of volunteer staffing. o Staff will look into arranging parking at the County garage for future meetings. Purpose The Orange County Bicentennial Committee of the United States Constitution is establish- ed for the purpose of organizing or participating in activities appropriate for the celebration of the Bicentennial of the United States Constitution. The Committee is authorized to sponsor events on its own or join as co-sponsor with other Orange County public or private bicentennial groups. 2. Duration The National Commission will be observing .the bicentennial for five years marking the time from the drafting of the Constitution to the ratification of the Bill of Rights. The Orange County Committee will exist for five years as well . 3. Membership Membership of the Committee consists of the following seventeen persons: The Chairperson and two members of the Historical Commission The District Attorney The Public Defender The County Counsel The Presiding Judge of the Superior Court Two Appointees from each Board Office 4. Chairman The County's own Historical Commission will act as the core of the Bicentennial Committee and the Chairperson of the Historical Commission shall be the Chairperson of the Bicentennial Committee. 5. Staff EMA staff currently acts as Executive Officer for the Historical Commission. This person will be assigned to act as Executive Officer for the Bicentennial Committee as well . 6. Funding Funding for this Committee can be acquired through voluntary action and by "piggy- backing" on activities already financed from outside; e.g. holding a Constitution Day at sporting events at Anaheim Stadium, signing on as co-sponsor for the Knott's Berry Farm gala at Independence Hall . Incidental support can be provided by the offices of County members of the Committee and some non-County members. The County will also provide "in-kind" support by waiving fees for any events staged at County parks/facilities. fi 7. Meetings The full Committee will meet once a month and may form working subcommittees that would meet at least once again. 8. Activities and Time Commitment Involved The Federal Commission is acting as a clearinghouse for ideas and is anxious to assist local Committees. As a consequence, there are already numerous ideas available. The Committee can pick and choose among these depending upon the amount of time they are able to commit. Little time is necessary to generate ideas for- activities--only their local implementation. The number of events too would be up to the Committee. They could sponsor one major event per -year or several smaller. For this Fall , they might rededicate the old courthouse and this might be the only event they would need to do this year. The program for such a dedication is already prepared and speeches written. It would only require adaptation to Orange County. 9. JW:jnPR005-38 -1- 6220 Commission on the ficeniennial of $he Vniled Stakes Constitution THE SCOPE OF THE BICENTENNIAL CELEBRATION Throughout the United States , and in foreign nations as well, the 200th anniversary of the writing of the U.S. Constitution will be celebrated for the next three years. Every state., city, county and town is invited to participate. We encourage every community, however small or large, to conduct their own distinct commemoration and celebration in their own way. The federal Commission on the Bicentennial of the United States Constitution offers every community whatever assistance and help we may provide. Our Commission recognizes that both similarities and differences exist between the approaching Constitution Bicentennial and the 1976 Bicentennial of the American Revolution. In 1776 we confirmed our independence. Between 1787 and 1789 Americans built a new and totally unique form of government , and became one nation. The success with which we secured our Revolution through the establishment of representative institutions is unparalleled. It is a story that deserves to be told. The United States was built upon and remains committed to a written Constitution designed to establish a strong government while preserving and quaranteeing individual freedom and opportunity. The themes for our Constitution Bicentennial consist not only of the relation of the Constitution to the Declaration of Independence, but also of the Constitution ' s own history, the struggles and trials endured to secure it, and the Constitution ' s contribution to American life and the art of government. Each year of the Constitution Bicentennial period has a significance for the founding of our nation. The celebration of the Bicentennial of the Constitution really has three phases that correspond to the three-year period from 1987-1989. While the commemoration should- be grounded on the historical events of -200 years ago, the scope of our activities and celebration should include the entire 200 years of the American experience. The following approach, incorporating three phases over three years, is suggested to state and local commissions for their use. • (1) " :.987 : Framing the Constitution" . The year 1987 should be dedicated to the memory of the Foun ers and the great docu- ment they drafted in Philadelphia. The celebration during 1986 and 1987 should focus on events leading up to the Constitutional Convention in Philadelphia in the summer of 1787. The anniversary SCOPE (continued) of the Convention' s adoption of the Constitution on September 17, 1787 , will provide an occassion for appropriate ceremonies, both solemn and festive, throughout our nation. The larger scope of the celebration during 1986 and 1987 should be educational in. nature, with particular attention paid to the reasons for calling the Constitutional Convention; the strengths and weak- nesses of the Articles of Confederation; the moral, political and economic thought of the Founders; the influence of Western philosophical and religious tradition on the Founders; discussions and debates within the Convention; and analysis of the Constitution itself. (2) "1988: Ratifying the Constitution. " In 1988, the commemorative theme should be the great national debate that followed the adjournment of the Philadelphia Convention on September 17 , 1787. The 200th Anniversary of the ratification of the Constitution by the people of nine states will occur in 1988. The year 1988 thus should be one of public enlightenment about the exciting and learned deliberations , such as The Federalist papers, undertaken by the people in the states over the merits of the proposed Constitution. The period 1787- 1789 was one of the most dramatic periods in world history, with 'the fate of an empire' hanging in the balance. Fostering an understanding of and appreciation for the majesty of the drama of a freedom-loving peoples overcoming obstacles and choosing for itself a form of government through discussion and debate should be our primary goal during this phase of the celebration. . (3) " 1989 : Establishing a Government. " The year 1989 marks the 200th Anniversary of the establishment of the Legislative , Executive, and Judicial branches of the federal government under the Constitution, and of the inauguration of George -Washington as our first President. In 1989 the commemoration should focus primarily on the relationship between and historical development of the three branches of government. In 1789 Congress drafted proposed amendments to the Constitution that became our Bill of Rights in 1791. By commemorating in 1989 Congress' s adoption of those amendments we will prepare the way for a celebration of the Bicentennial of the Bill of Rights.
