They stand to loose $150k+ equity when they shouldn't have been able to buy moderate units but weren't stopped and had no disclosure — Past moderate owners did not qualify buyers — Current owners are being force to qualify buyers 4 Covenant Issues Discrimination — City is picking on current & recent owners who did not qualify and did not purchase at affordable prices but not pursuing ALL owners over the last 15 years. Results of City's Failures • Community is now distressed, undesirable property • Destroyed value of comps ® Impossible to find a prospective buyer ® Owners forced into foreclose because they cannot sell 5 Results Of City's Failures • Innocent, unqualified buyers lost $150k+ in equity vs. comparable properties • City's Low/Moderate Income Residents lost because property is owned by many unknowing, unqualified people -OR- now units are rental income others property owners — Negates Program's Purpose of putting those with limited income into housing. A specific covenant term, initialed by the buyer, states: The property value may not increase or decrease in the same manner == = as other similar real property; and • The determination of affordable housing cost takes interest costs into consideration. Upgrades: Their response to our not ing able to recoup our upgrades is: Original pur ser is prohibited from buying upgrades that increase th price above affordable housing cost. a. Well, this is not true any original purchasers DID buy upgrades that in eased the price of their home. And now are losin those costs. b. Also, their nswer for upgrades done after purchase is: true u don't get any of your money back. c. If yo don't change this requirement you are going to see s e nice communities turn into slums. What if I put down $100,000 to purchase the home; I lose my job, and I need to pull $50,000 out to survive . Your telling me I can't pull my own money out? ,The minimum requirement is to put down 5% of the purchase price. It doesn't say "yes, but if you put down more you lose it". b. Your consultant says you get the money back when you sell. What if the house doesn't sell? We have been ' trying to sell our home for a year now (and we have a nice home with many upgrades). It sounds much easier on paper than in reality. c. There needs to be a change so Cash Out is allowed. 3®) Resale a. In today's current market it is almost impossible to get a home loan unless you have great credit and at least 20% down. This means that to sell our home we need to find a buyer with a $94,000 down payment. Well, that rules out first time homebuyers. b. Also, a restriction has been changed so that buyers can only have 50% of the purchase price in assets. This can rule out many people that divorced, sold a property, and now have too big of a down payment to qualify for the program. Yet they are single parents with kids and don't make a lot of money. c. Something needs to change here. It is not working. The people that this program is intended for can't qualify for the program. 4.) Formula a. I don't think anyone has "played" with the formula to see how small changes affect it. Just last week the utilities number changed by $100 and it affected the price of our a } A homes by a $20,000 reduction in price. Did anyone know this would happen? I understand that utilities change but it shouldn't have such a big effect on the pricing formula. b. The formula needs to be re-done. One little change in any number, expenses or interest rate, greatly affects the price of our homes. Please give a bit more thought before you vote on these changes. SCENARIO 2: Income limit of$80,700 2 Retirees have the lower income to qualify, but if they want to pay cash or have more than 50% of the sales price in equity or assets, they do not qualify for this program. In regards to the purchase and acceptance of my Cape Ann property I had zero communication with,the city of Huntington Beach . NO DIRECT CONTACT NO LETTERS NO FAXES NO E-MAILS 2. My purchase of a Cape Ann property provided no benefits typical of"Affordable Housing" 1. Home purchase price was at"full market value"as determined by appraisal 2.There was no incentive regarding financing 3.There were no non-financial incentives 3. Original purchasers were not informed that their resale price would be tied to any indexed formula.They were instead,told that there was no explicit limitations on resale price.The singular limitation was that potential resale buyers would be limited to those within a capped income, no more than 120%of the Orange County median 4. Declaration of Conditions, Covenants and Restrictions. Recorded 03/23/99 [Reference No. 19990214033] which puts the encumbrances on my property was created after my Purchase and Sales agreement dated 02/06/99 5. The city's"Request for Action" Meeting of February 16, 1999 states that"John Laing Homes does not have a Approved Covenant" My Purchase and Sales Agreement is dated 02/06/99 6. The city has a dated document stating I have read the Declaration of Conditions,Covenants and Restrictions [Reference No. 19990214033]The date on this document is before the Declaration of Conditions,Covenants and Restrictions had been created. How did I read a document which had not been written. 7. In Regards to the Right to Rent My Property 1. Under the city's key reference Declaration of Condition,Covenants and Restrictions [Reference No. 19990214033] Page 2,Section B.1. (a): "The Property shall only be owned and occupied by Covenanter or by"Moderate Income Households." Moderate Income Households shall mean persons or families earning not more than One Hundred Twenty (120%}of the Orange County Median income ..." This Section,which defines the "Affordable Covenants",clearly permits renting with a singular restraint;120%of the county's median income. 2. Declaration of Covenants Conditions Restrictions [Cape Ann, Reference No.19990136116 J A. See page 22 Section 3: " In the event an owner has rented or leased his condominium his rights to use and enjoy common amenities on the corporation property shall be automatically delegated to his tenants or lessees for the duration of their tenancy." B. Seepage 69, Section 18: "There are no restrictions on right of an owner to rent or lease his condominium." 3. Department of Real Estate,State of California./Final Subdivision Report A. The City is continuously evolving its encumbrances upon my property. I purchased my property in 1999 .The City's Housing Program Policies And Procedures were created in 2004. How and why would these apply to me. Viewing these points with a unbiased eye the City must acknowledge their mistakes, and correct their mistakes. Remove the erroneous restrictions,encumbrances which you are trying to apply to my property. Litigation over the past three years with your citizens is not a proper way to govern. Y.. Introduction (con't) ® The City Attorney and City program consultant agreed that it is permissible to apply one or more of the reform measures to existing affordable housing owners, if both the City and the current owner agree. ® This seems like a promising way to begin to resolve the current disputes between existing owners and the City so that everyone involved can put these issues behind us and work toward a stronger, more logical affordable housing program. 1 2/3/2009 Introduction (con't) ® Therefore, we urge the City Council to include a provision -- in any new law or regulation that it adopts, or in any direction that it gives to staff-- that would allow for the application of one or more reform provisions that the City and a respective owner agree upon. ® This would (1) simplify the process for the City; (2.) open the possibility of settling the lawsuits; and (3) result in a reformed program that would be more fair to existing residents (although still far from perfect). 2 2/3/2009 Existing Cape Ann Owners' Response to the City's Proposed Program Changes: Ten Points for Giving Relief to Existing Affordable Homeowners Point 1 : RHNA • The City consultant argues that the resale price formula can't be changed or the City won't get credit towards its Regional Housing Needs Assessment. • Response: RHNA only concerns future housing targets, not existing affordable homes. • Thus, any changes to the resale price formula for existing Cape Ann homeowners so that it better tracks what was originally represented to them would have no effect on the City's ability to meet its RHNA goals. 1 2/3/2009 �J Point 1 (con't) • Can the City have more than one resale price formula? Yes. • In fact, the City has already adopted at least two formulas: the one being discussed today and the "equity share" approach it is using on some future units. • Thus, the City Council should direct staff to sit down with existing Cape Ann owners in an open dialogue to discuss variations of the formula F z --P t 2: State Lavv ows exibility in Resale Formulas • Is the current City formula the only one authorized by state law? No. • Jurisdictions throughout the state have variations in their formulas and programs designed to address some of the concerns we are raising about the City's program. • Hence, the City has the authority to make adjustments to the resale pricing formula they are applying to the existing Cape Ann units. 2 2/3/2009 -P6inf-3 : What the esa e - orrnula Is Not • Several City Council members made comments at the last Study Session that we are in a down real estate market. • The comments seemed to suggest that this has some bearing on the restricted resale price. • NO! Under the City's formula, whether market prices are up or down in the overall real estate market has no bearing on the restricted price. Please or Affordability Restriction Terra • Page i paragraph 1 of the CC&R Resale Restrictions state that the Affordability Period runs for "thirty (30) years from date the first certificate of occupancy is issued for a condominium unit in the Property...' • Since the certificate of occupancy for the first home in Cape Ann was issued in 1999, the affordability period should expire in 2029 for all Cape Ann homes. Point 4 (con't) • However, according to the information posted on the City's website, the Affordability Period for many of the units expire as late as 2o36. This is in direct conflict with the information in the CC&Rs. 4 2/3/2OG9 Point 4 (con't) • In addition, the expiration of the Affordability Period as published on the City's website in 2oo8 differs from those recently published in 2009. • This is true even regarding homes where there has been no sale or other change of title between 2oo8 and 2009. Point 4 (con't) • The City's consultant asserted that the "current requirement" is that the restriction period "restarts to Year 1 each time the unit resells." • This misstates what is clear in the CC&Rs; it does not restart. 5 2/3/2009 Point 5: Current Owners Should Be Permitted to Recover Costs of Improvements or Repairs • The current pricing formula does not allow for a seller to recoup any monies spent on repairing or improving the property. • At Cape Ann, individual homeowners, not homeowners associations, bear the cost of things such as exterior painting, plumbing, electrical, and roof repair/replacement. • Upgrades such as granite countertops, hardwood flooring, upgraded fixtures, etc. also cannot be recouped in the City's resale pricing formula. ,xb Point 5 (con't) • This leaves homeowners no incentive to maintain or improve their homes; in fact, they are penalized for doing so. 6 2/`3/2M) Point 5 (con't) • The City of San Francisco's Residential Inclusionary Affordable Housing Program permits owners to recoup for eligible capital improvements. • Home buyers are provided a list of items that will qualify as eligible capital improvements and the information is also readily available on the program's website. • The County of Monterey's program adds io%of the original sales price to the calculated resale price of the home if the home is in "decent condition" upon resale. -Au Point 6: Real Estate Agent Costs • San Francisco's program adds 5% of the calculated resale price if the unit is listed on the Multiple Listing Service and a real estate agent is used by the seller. • We ask that the City allow sellers to add 5% to the calculated price of the home if a real estate agent is used to sell the home. • This program is too complicated to expect homeowners to understand -- a professional is needed. • Encouraging the use of a real estate agent helps protect the City by facilitating better disclosure. 7 2/3/2009 t � Point 6 (con't) • Alternatively, the City should maintain a list of eligible (and pre-qualified) buyers for the homes to make selling easier. • Monterey's program circumvents the need for a real estate agent by having its Office of Housing and Redevelopment maintain a list of eligible buyers for affordable homes. z bi t 7: Other Formula' Fixes Which Are Needed • In San Francisco's program, if the calculated price is below that which was originally paid for the unit, the owner may elect to sell the unit for the original sales price (plus capital improvements and real estate fees). • This helps guarantee that buyers don't lose their down payment, which under earlier versions of the program was larger than is currently allowed. • This should be the rule in Huntington Beach. 8 213/2009 Point 7 (con't) • The City has unilaterally changed the "utility" factor in the formula in a way that reduces the resale price by tens of thousands of dollars in some cases. • Existing homeowners should be allowed to elect to keep the old utility factor in their calculation. ,F e a h Point 7 (con It) • The City has changed its source for determining the the mortgage interest rate numerous times over the years. • We have discovered that the interest rate published in these papers is often wrong! • The City Council should mandate that the staff be required to use a more accurate source other than a newspaper which may or may not provide the correct daily mortgage interest rate. 9 2/3/2009 Point 7 (con't) • The proposed program would prohibit refinancing that allows the owner to pull "equity" out of the home. • Although the consultant states this is not new, it is new to existing Cape Ann owners. • We ask that the City Council direct staff to sit down with existing owners to fashion a workable solution for all parties. c. Point 8: Inheritance • We agree generally with the City's proposed change to allow inheritance and presume this would apply to existing Cape Ann owners. • We ask that the City clarify that the transfer due to inheritance does not trigger a new affordability period. • Also, the program rules should make clear that a transfer to a family planning trust is allowed and will not trigger a new affordability term. 10 2/3/2000 �l Point 9 : Rental Permission • As a few City Council members have pointed out, the City can achieve its affordable housing goals through rentals (ownership is not required). • Thus, in addition to the rental provisions proposed, the City should consider allowing longer term rental on a certain percentage of the units in Cape Ann so long as the leases are to families within the income brackets. • This is necessary because a temporary job relocation or illness may well last longer than a year. • The i-year period appears to be arbitrary. —'Point 10: The Program Still Does Not Provide Adequate Disclosure or Protections Against Changes • The City states on its website "DO NOT CONTACT CITY OF HUNTINGTON BEACH FOR QUESTIONS!! CONTACT AGENT OR OWNER." This discourages buyers from contacting City staff. • The City needs to hold seminars, classes or workshops on affordable housing for potential buyers, and require buyers to attend them. 11 k. 2/3/2009 Point 10 (con"t) • Existing owners were never notified when the City changed aspects of the program. • The new City program should mandate that all current owners be notified in writing by certified mail to their home address (no less than sixty (60) days before adoption) of any and all future changes to the program. • The City should prohibit staff from retroactively applying program changes to existing homeowners without the knowledge and written consent of the owner. r, --P"o nt 10 (con"t) • Other cities have these protections. • When San Francisco adopted new policies and procedures for its program, current owners were not bound by the changes. Are the RHNA numbers affected when we rent our property? If not,than why all the burdensome guidelines? Many of us no longer meet the affordable restrictions of this program so what difference does it make if our renters meet these restrictions? Why only one year? Relocation: Who gets relocated for one year? Most companies want at least a two year contract. And now because of the economy, many companies are not giving out relocation packages. A one year rental restriction is not what people should be concerned about when they relocate. They should focus on their family's transition and doing the best job they can do so they can keep their job. Hardship: A one year rental restriction is often not adequate for hardship. Medical hardship often lasts longer than a year and also can result in a permanent disability. The income from their home rental may be what keeps them "a float"while living with family or in a long term care facility. Medical histories are confidential and the City should fully respect this right. It was stated that only a written medical excuse would be needed by the City for proof of medical hardship. Those are hard words to trust when a mother of triplets was told by the City that she could not rent her home because that was not considered a medical hardship. She was told do not climb stairs!! This example really makes me angry because she even had legal council write a letter to appeal to the City's legal department and was still denied. Who had the final word one this decision? The Process of Rental Approval: What are the steps? The owner finds the renter but what follows? Would this involve the owner looking at a pay stub to make sure they meet the guidelines for affordable housing restriction or does the City lengthen the process? As mentioned before, why would renters have to be income restricted in the first place? We (owners) no longer have to meet the guidelines? How long of an application process are we talking about? By the time they are City approves the affordable renter, the renter will probably have found another place. Who wants to move all their stuff for a one year rental? Is the City available on weekends to approve the renter? What if the renter meets affordable income guidelines and the gets a raise, what's the purpose? This was a poorly written and planned program by the City and John Laing homes with total lack of disclosure and a contract which was not really a contract because it did not contain the material facts. Politicians and lawyers got us into this mess and now we are back to politicians and lawyers getting us out of this mess. Consider liberating this program so we can have the rights that we should as homeowners. We will still keep the RHNA numbers intact for the 30 year contract and therefore some dignity, respect, and liberalization should be warranted, we are homeowners not program guinea pigs!
