NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Fountain Valley, California, does hereby find and declare the need to define and adjust the common boundary line between the City of Huntington Beach and the City of Fountain Valley, and does hereby consent to the correction, relocation and determination of an exact and definite description of that portion of the subject boundary line lying within the southeast one quarter of the southwest one quarter of above mentioned Section 36, and agrees to aid and support the City of Huntington Beach and the property owners with the preparation and submission of a petition to exclude territory lying within the northeast one quarter of the southwest one quarter and within the southeast one quarter of the northwest one quarter of above-mentioned Section 36, from the City of Fountain Valley and to annex the same territory to the City of Huntington Beach, said petition and action to conform to the provisions of Title 4, Division 2, Part 2, Chapter 1, Article 4 of the Government Code of the State of California. Neal: Our City Administrator, Mr. Miller, requested that I answer your letter of February 26, 1969, regarding the boundary adjustment between Huntington Beach and Fountain Valley., along Newland Street. This iscue is not dead, and I have been meeting with, persons concerned therein during the past four or five months. We were stymied for some time because we were unable to ,get the consent of two-thirds of owners of real property within the territory holdin- two-thirds of the value of the roperty within the territory, as required by Section 3530Z (a) of the Government Code. One individual, Mr. Wallace Mitchell, has been in contact with a potential buyer of the property owned by Kato Brothers -- the consent of which would give us the necessary 75%. This prospective buyer would make a rezoning of this property ,to R3 by the City of Huntington Beach, a part of the escro agreement. I do not believe such application for prezoniny has ,; been submitted to our Planning Department as yet, but I will endeavor to find out and let you know. It the client of Mr. Mitchell does purchase that property, we can immediately proceed in filing an annexation. In order to do this, the area will have to be split into two annexations to make it successful -- one being the annexation of Fountain Valley property and the other, the annexation of property in the County island to the west of Newland Street. We cannot combine the two because of the fact that with Mr. Dobkins objection being thrown into an overall annexation, it would not get the necessary 75%. Page 2 - Mr. James E. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOUNTAIN VALLEY CONSENTING TO THE CITY OF HUNTINGTON BEACH INITIATING PROCEEDINGS TO CLARIFY SAID CITY S COMMON BURY LIDS WITH T= CrM Or FMWMN VALLEY WHEREAS, a portion of the existing common boundary between the City of Huntington Beach, California and the City of Fountain Valley, California is not clearly delineated and bisects certain properties owned by the same person; and that portion of said common boundary line, which is not clearly delineated lies within Section 36, Township 5 South, Range 11 West, San Bernardino Base and Meridian, Orange County, Californiat and This boundary line, was first established by the descrip- tion of the boundaries of the City of Fountain Valley in its incorporation documents which effected the incorporation of said City on June 13, 1957; and This boundary lines was referred to as the easterly boundary line of an annexation to the City of Huntington Beach, California, known as Harper Annexation, certified on April 4, 1958, and thereby making said boundary the c, on boundary liner and The map of Tract No. 3534, within the City of Huntington Beach, recorded in Boots 127, pages 31 and 32 of Miscellaneous Maps, Records of Oranges County. The City Councils of the cities of Huntington Beach i and Fountain Valley are desirous, first, to clearly define the original line, and second, to adjust certain portions of the boundary line to coincide with individual property ownership boundaries; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Fountain Valley, California does hereby find and declare the need to define and adjust the common boundary line between the City of Huntington Beach and the City of Fountain Valley, and does hereby consent to the correction, relocation and determination of an exact and definite description of that portion of the subject boundary line lying within the southeast one quarter of the southwest one quarter ofabove mentioned Section 36, and agrees to aid and support the City of Huntington Beach and the property owners with the preparation and submission of a petition to exclude territory lying within the northeast one quarter of the southwest one quarter and within the southeast one quarter of the northwest one quarter of above-mentioned Section 36, from the City of Fountain Valley and to annex the same territory to the City of Huntington Beach, said petition and , action to conform to the provisions of Title 4, Division 2, Part. 2, Chapter 1, Article 4 of the Government Code of the State of California. BE IT FURTHER RESOLVED AND ORDERED that the above described petitions and subsequent actions shall be initiated -and prosecuted to completion by the City of Huntington Beach entirely with our consent and cooperation. The City of Huntington Beach filed the annexation with the consent of the City of Fountain Valley. Huntington Beach Pis considered the proponent on this request. This common boundary between these cities is not clearly delineated and bisects certain properties owned by the same person. Adjustment of this boundary of the two cities will move the line easterly approximately 105 feet to the easterly line of recorded Tract No. 3534. In 1962 and. 1963, each of these cities agreed to. detach one parcel of land and annex the parcel detached by the other city. Refer to the attached copies of City of San Juan Capistrano Resolution No. 62-11-13-2 and City of San Clemente Resolutions No. 1390 and 1421 and Ordinance No. 415. The boundary adjustment was only partly completed. An examination of the documents enclosed will reveal that the City of San Juan Capistrano did detach its parcel as intended, as evidenced by the certified annexation of the same parcel by ' the City of San Clemente. The detachment of A parcel by the City of San Clemente was apparently not completed because, (1) it was never certified by the Secretary of State, and (2) its annexation to the City of San Juan Capistrano was not pursued after the city's procedure was questioned. The remaining task consists of, very simply expressed: (a) Completing the de-annexation of the parcel intended to be de-annexed by the City of San Clemente, and (b) Annexing the same parcel, combined with a parcel of uninhabited State- owned land, to the City of San Juan Capistrano. It is respectfully requested that you approve the de-annexation from the City of San Clemente of the parcel described in its Resolution No. 1390, referred to as "San Clemente De-Annexation No. 1"; and approve the Via California Annexation to the City of San Juan Capistrano, as it is described in its Resolution No. 62-11-13-2, under the "Annexation of Uninhabited Territory :Act of 193911 as amended. It is further requested that you honor and help accomplish the mutual inten- tions of the cities involved. To this end, you are referred to Section 35,250 of.
