Beach, has requested an opinion whether territory may be trans-
fertod from one city to a contiguous cit in the same county
pursuant to Government Code Section 35276.
CONCLUSION
The territory may be so transferred .

procedure whereby a city may transfer its territory tq a con-

Huntington Reach ties Legislative r.onse'ne frou; an adjoining
city for the transfer of cortai.n territory in that city to
Huntington Beach in order to establish n &,finite boundney
line between the two citia5s , r

territory, it ' would be advantageous for us to be tebls ' to pro=

took an action which should he of. extreme concern to all
cities is Orange County . The Corunission , without an agendi-:ed
notice or hearing on the matter , deleted almost one-third of
Tustin ' s approved sphere ofinfluence in the unincorporated
area. This unilateral actionl set a precedent which can have
grave consequences for long-range planning and projections
for future community development by any City ill this County.

other agencies. Final action was taken by LAFCO ort the sphere
det6imination to Tustin by adopting Resolution No . 71-102 .
Now', over two years later , the Commission has rem-Ovecl this
' { area from the Tustin sphere of influence without ally advance
notice or any res`-u& of: the crLter;�.a that estaElished the
sphere in the first place ! The item on the agenda was a _
determination of the sphere of' influence for the City of Santa
Ana . Aster Santa Aria ' s sphere wes adopted (which
did not in- ' �
c:l.ade the Ai, Station) , the Corunission then in-

sphere and took the above action No information was presented
in
to- the Commission that. -was new or different than pros
ented n. :

1 . GENERAL APPLICATION. The fees set forth in this Wiedule shelf apply to all filings
m e pursuant ►o ections 549M to 54902 of the Government Cods. The pro ns visio and
definitions piven'in Sections 2 and 3 below shall be used to interpret and apply the fps»,
and serve as guides to insure -3cccptonce of flied documents. Fees shall accompany the
filed documents. See Paragraph 3 (h)
2 . DESCRIPTIONS AND MAPS.�� Everc ptron must be self-sufficient within itself and without the neeexsrty
of reference to any extrar+.eous document. When a descr;pt iori refers to a deed of record
the dead should be used only as a secondary call .
(b) When writing a metes and bound%I detcription of a contiguous annexation all
details of the contiquoui portion(%) of the boundary should be omitted. The points of
departure from the existing boundary must be clearly established .
(c). A specific parcel description in sectionalized lord (e .g. Thar,�Wl/4 of
Section 22, TIN, RIW) is permissable without a metes and bounds description *(:'he
perimeter boundary .
(d) A parcel description snaking reference only to a subdivision or a lot within
a subdivision is not acceptable.
(e) Every map must clearly indicate all existing streets, roock and highways
within and odjocant to the subject territory together with the current names of these
thoroughfares.
(f) Every map shall bear a scale and north point. If a reduced mop is to'be
filed, the original mop must have a graphic scale affixed to it beforss the reduction
is maids .

The boundaries of the subject territory must be distinct vely shown on the'ino"'without

FILING FEFS AND kOCSSIN+G FEES-GENERAL.
o rcel" means any separate geogro ical area. A "Parcel" can include one
or more ownerships a long as they are contiguous to each other.

(b) "Zone" includes temporary zones in highway lighting districh, other zcma3,
improvement districts or any other sine-unit of a .-icy or parent d isirlct.
(c) "Reorganization" InclWes any single action that involves two or more cities,
districts or zones in any comlilnation. A. transfer or exchange of territory betwom cilia,
di2trich or zones would therefore be a "reorganizotipn" under this definition. Irm cm-
solidation of districts of zones does not come under this dzfinition.
(d) If the subject territory is described entirely by sections or froctiwwl pwtia*
of sections (see Pnrogropl+ 2 (c) ) , compute the processing fee under the neat smaller
size cat' 'ry seven below, For example, the annexation of one section (610 ocres)
would be conpu:ed under the 20 - 100 acre catepory.
(e) ►f an "island" is created by the exception of territory, each-Islcnd shall be
considered to be one "Parcel".
(f) .The fees in Section 5 of this schedule are based on the concept that any
given oction is contuined within one county. If more than one county is Involved,
add $50 for the second and each additional county involved.
(g) The fee for adding an existing district to the tax roll shall not exceed $1000.
(h) The filing and processing fee shall occompony each statement union prior
orronpenwnt for quarterly p yments has been made. The use of quarterly payments
shall, be limited to those goverm. ental entities that normally file more than twenty-
fivt statements each year.
(i) If the January i it statutory deadline for filing skooments is extended by a

A . PREPARATION AND FILING OF FORMS
1. Proponentn of the annexa;ion may secure the following
forms from the Staff Secretary of the Commission, 383
Hall of Administration, 500 W. Temple Street, Loa
Angeles 12, California:
a) Notice of Intention to Annex
b) Justification of Proposal
54761, 2. Proponents shall file a Notice of Intention and com
Sect . 24 pleted Justification of Proposal along with 15 maps
Sect. 25 and a legal description of the subject area. No
proposal for annexation may be considered filed unless
accompanied by the Justif'..cation of Proposal completed
in full .
B. BOUNDARY C014MISSION ACTION
54762 1. Twelve maps and legal descriptions, and one transpar-
ency , along with a letter of transmittal, should be
filed with the County Boundary Commission either at
the same time oi- as soon an possible following the
filing with LAFC . A Notice of Intention ` - however must
be on file with LAFC a ore Min& with the HoundaEZ

2. An anon as, but not before , LAFC received a favorable
report from the Boundary Commission, the pr000nal In

C. ACTION OF THE LOCAL MENCY FORMATION OOM.MISSION

54763 1 . Upon receipt of the Boundary Co=lsslon report, LAFC
+shall set the proposed annexation for hearing not
more than 60 days after the filing of the Notice of
Intention .
Sect. 19 2. Prior to the time the matter is set for hearing. the
proponents may, on their own action, withdraw their
proposal ; attar the matter has been set for hearing,
however, it may be withdrawn only with the consent
of the Commission.
54763 3. At least 15 days before the hearing, the following
persons or agencies are notified of the date , time,
and place of the hearing:
a) the governing body of each city and special district
having jurisdiction within the boundaries of the
territory proposed to be annexed;
b) the governing body of each city lying within t;use
miles of the exterior boundary of the subject;
c) any interested party who has filed a written request
with the executive officer of the Commission for
such notice;
d) the proponents of the annexation .
54764 4. The week prior to the hearing, the staff shall have
prepared a report on all matters coming before the
Commission. This report shall be submitted to each
member of the Commission for review in advance of the
hearing.
5. Persons interested in being heard on any matter are
requested to inform the Staff Secretary at least three
.
days prior to the hearing.

D. DETERMINATION OF M. LOCAL AGENCY FORMATION COMMISSIM
54766 1 . Any matter, corning before the Commission may be approved,
approved with conditions, disapproved, or continued.
The Commission must present its determinations W thin
30 days following conclusion of the hearing. The
Commission may also adjourn a hearing from olme to tines,
