0 TITLE 5, DIVISION 1, PART 1 CIUMR 1 of the OOVEM fT ODDE Article 8. Citt Boundaries Sec. 50190. Tf the boundaries between citica or between a city and wiincor- porated territory are conflicu,ing or incorrectly described, or if by reason, of the resubdiviaion of larrl, the change in property lines or for other cause, the location of the boundaries becomes indeli.nite -or conflicts with the established property 2,1nec, the ba.mdaries may be corrected ur relocated to follow definite, established property lines purauant to this artil;l©. Sec. 50191. .Thr corrected or relocated bowidary lines shall conform as nearly an practicable to tha 'Former boundaries. fSeca 50192. Where boundary lines are corrected or relocated, the relocation of th'e new linen shall be made in such a canner that the majority of the area of the parcel or property affected determines the entity within whoae bo ndarlea the parcel or property is or shall be located. The 'purpose of this article ie; to authorize only minor corrections or relocations to be made, and no corrections or relocations shall be made hereunder which relocate within the boundaries of another entity property in any Wcel in excess of one acre in area. Sec. 50193. The legislative body of any city the boundaries .of which are incorrectly described, indefinite, or conflict with established property lines, or the board of euperviscrs of the county in which any such city is located, may file with the legislative body of any other affected city, or the county, a written petition upecifically describing the parcels of land affected and tho proposed loco- -ti.on of the new boundary line and requesting consent to the correction or relocation of such boundaries. Ser.. 501914. Petitions, ahall be subiaitted to and reported upon by the boundary comp isaion of the county prior to being filed or acted upon. Sec. 50195. The legislative body or bodies with which such petitions are filed shall by, resolution either poncent to or disapprove each of the corrections or relocations proposed by the petition within 30 days after receipt thereof. A cer- tifi.ed copy of such resolution of consent or disapproval shall be forthwith filed with the clerk of the petitioning legislativo body. Sec. 50196. The initiating legislative body may thereupon,'.b, rvsolytion, correct, relocate or alter such boundaries to the extent to' rhich_all affected legislative bodied have consented. Such resolution shall accurately describe the correcte�, relocated or altered boundaries. The enaeting lagislntire body shall � cause its clerk to transmit`a certified copy of such resolution to the Secretary of State,- to the board of supervisors of the county. in iftch the affected boundaries 04re situated, and to the legislative bodies of all affected cities. CHA,ME 6.5. LCCAL AaENry mEx noti cott ssrom (Part 1, Division 2 Title 5 of the Government Code) Sec. 54750. As used in this chapter: (a) "Commission" means a local agency annexation ,romissian. (b) "Special district" means an agony of the State for the local performance of governmental or proprietary functions within limited boundaries. "Special district" does not include ^he State, a city, .% county, or a echml district. (c) "Local agancy" mans city -zar special district . Sec. 54750.1. An used in. Sea. 54751• This chapter does not apply to any county 4n which there `is no city or in which there is only one city. Seca 54752. There is hereby created in each county of the State a local agency annexation commission. Sec. 54753. The comission shall consist' of five me**rs, selected as follows: i (a).O Two ropmsenting the county, each of whom shall be a county officer, appointed byy the board of supervisors. (b) Two 'representing the cities in the cowity., each of whom shall be a city office, appointed by the city selection committee. (c) one reprecenting the general public, appointed by the a".her four mewbere of the commission. ` Sec. 54r-'30,05. Sec. 54760. The comission shall have the rollowiing powers and duties: (1) To review and approve or disapprove, with or without amendment, molly, partially or conditionally, proposals for the annexation of territory to local agencies within the county. (2) To adopt standards and procedures for the evaluation of proposals for the annexation of territory -to local agencies within the county. I Sec. 54761. Tine notice shall contain the specific boundaries of the territory proposed to be annexed. Sec. 54762. Except as 'pro.-ided in this section, no further action shall be taken concerning -the proposed annexation until the co odasion has rendered ;its decision As provided in Section 5066. If other prov-isions of law which" govern the annexation prsv-1de for the suberiasion of the proposed boundaries of the 'tarritory to be annexed to be county boundary 'c of4mis a ion for review and report, such provisions of law shall be complied with ,after the filing of a notice of intention with the local agency annexation comission pursuant' to Section 54761. The date of the hearing shall not be more than 60 days folloodng receipt by the comission or such notice.-_' The commission shall notify the` governing body of each local' agenny having Jurisdiction within the boundaries of . the territory proposed to be annexed, and the governing body of each city within three miles of the exterior boundaries of the territory proposed to be annex+rd, any interes-:ed party who has filed a written request - with the e:;eCutirre officer of ttie commission for ouch notice, and thelpreponents of the amexation, of the date, time, a6d place of the public hearing, at least 15 days prior to the date fixed for the hearing. ` Sec. 54764. Factor* to be considered in the revtow of an annexation prgMal ataill include but not be limited to: ` ; A A+� (1) = Population; o atian i.ensity; land area az�d land uses; per capita assessed valuation; topography, natural bairydaries, and fiMainags basins; pro7.isd ty to other populated areas; the likelihood of significant growl-h in the areal and?'in adjacent incorporated and unincorporatwd areas, during the next lei years. (2) !teed for organized community services; the present cost and adequacy of governmental services and contrcla in the area; probable future, needa for such services and controls; probable effect of the proposed formation and of alternative courses of action on the coat and' adequacy of services and controls in the area and adjacent areas. (3) The affect of the proposed annex tion, `'and of altenatire actions, on adjacent areas, cn mutual social and econourdc interests and on the local, govarnmentil structure of the county. See: 54766. Upon concluaion of the hearing, the coantiseion :nay take the matter under consideration and aha?l, ' within 30 days following conclusion ,of the hearing, present its determination. The comraiasion may also adjourn a hearing from tine to time, but not to exceed a. total of 34 days. If the cow.dseion approves the annexation`, proceedings therefor may be contin- ued to otherwise provided by the governing law. If the cony ssion disapprevea the proposed annexation, further proceedings to annex tho territory to the local agency shall terminate.; If the commission approves the proposed annexation with modifications or conditions, further proceedings for the annexation may be continued only in com- pliance with such modifications or Conditions . Sec. 54767. . If the commianion disapproves the I annexation of territory to a city-, no notice of intention to annex the same or substantially the same territory to that city, may be filed with the corraission for aL least one year after the date of dioapproval. If the com+nission df.acpproves the winexation of territory to a especial district, no notice of intention to annex the sane nr substantially the sum territory to that special district may be filed with the comiaission for at least one year after the date ; of d1sapproval. Sec. 54768. If the territory of a special district ilea in mcre than one county, the' notice of intention to annex; required by Section 54761 at mill be filed with the comixei,on of the county in which the territory to be enr+exed lies. The board of supervisors shall furnish the comdesian with neces- sary quarters, equipment, and supplies, and the usual and necessary operating expenses incurred by the commission .shall be a county charge. (Added by Chap. 1830, Stato. 1963) (Stata. 1963, Chap. 1810, Sec, 2. This act shall becom operative only If Assembly Bill No. 1662 is enacted at the 1963 Regular Session of the Legislature and " in such case at the save time as Assembly Sill No. 1662 takes effect. If this bill and AnBembly Bill No. 1662 are both enacted at the 1963 Regular Session of tbs Legis- lature, no local agency annexation coeadaai.an shall be formed pursuant to Chapter 6.5 (commencing with Section 54750) of Part 1, Division 2, Title 5 of the 0overnwant Coda, but a local agency formation commission swell be formed in each county pursuant to Chapter 6.6 (commencing with Section 54775) of said part. The local agency ftiaation commission shall have all of the powers vested in the co%vission by said Chapter 6.6 and, in addition, shah', in each county, notwithstanding Guvernmant Code F*ction 54751, have all of the powers vented by said Chapter 6.5 in a local agency annexation con- mission and Chapter 6.5 shall apply in each county in the State. If a member cbases to be an officer of the entity he wre appointed to reereaerit. on the commission, his membership on the comission shall thereafter be cap sidered vacant. Sec. 54780. Sec, 54782. � (a) Before proceedings are initiated to form a special district the proponents of the creation of such district ahall file a notice of intention to forti the special district with the cowuisvion. The ncitice shall contain the specific boundaries of the proposed district and a description of the kiss of district proposed to be fca-med. For the purpose of this subdivisior, proceedings to initiate the forma- tion of a special district mans (1) The circulation, of a petition to farm a special district or the filing of notice to circulate such a petition if such notice is regriired. (2) The adoption of a rC30lu6,'Oion or ordinance b7 the board of supervisors initiating the formation of a special district. (b) After the provisions, if any, of law requiring the submission of the boundaries of the proposed "cial district to the county boundary comission for review have been complied with, and within 10, dkvs after the determdnation by the appropriate officer or body as to the sufficiency of the patitiai, or, if proceedings have not been initiated by petition, within 10 days after the boundaries of the proposed district have been finally determined by tho agency having the power to "ke such deter►aination, the officer, body, or agency raking at:.:*h determination shall notify* the commission of such action. No further action shall be taken concerning the proposed formation untl,: the. cotnnission has rendered its decision as provided in Uctions AM. Sec. 54784, Foll receipt of the notice prescribed by subdivisio►a (b of Seetion, 54781 or subdivisi b) of Section 54782, the cowiesion shall net: the date, tim, and place for a public hearing on the proposal. The date of the herring shall not be more than 60 daye, fo11M. ,g riCeipt by the commission or the notice heretofore described, in this section. The commission chall notify the governing body of each,, city or special district having jurisdiction within the boundaries of! f.he proposed city or' district, the governing body of each city within three miles of the exterior boundaries of the proposed city or district, any into;-estnd party who has filed a writ;t'im request Frith the executive officer of the cow.kasion for such notice, and the proponents of the fo.r:ution petition, of the date, time, and place of the public, hearing, at least. 15 days prior to the date fined for the hearing. The hearing shall bo held at the county seat of tha county or one of the counties in which the city or district is irrop03ed to be formed, or in a city or other place in the county designated by the eomissi on. Sec. 54785. At the hearing, the comnission shall hear any interested prrtiis having made formal request to appear and be heard, quad the report of the ,comod"ion's staff. The commission and its presiding officer shall have the powar to',&e snd enforce such rules and regulations as will proride for orderly mid fair conduct of the hearings. Sea. (3) 1 The effait of the proposed formution, and of alternative setions, an adJacent areas, on matual social and ecc �mic interest and on the local govenum ital structure of the county. Soc. 54767. Upon conclusion of the hearing, the eonaission may take the matter under consideratic6 and shLU., within 30 aaya following conclusion of the hearing, present its detervdnation. The commission may also adjourn a hearing from time to time, but not to exceed a to*%OAI of 60 days. If the cenrdasion approves the formation of the proposed city or district, proceedinl'is fore its formation may be continued as otherwise provided by the governing, law. . If the coinnission disapproves the proposed fornaticm, fwtber proceedings to form the city or distract shall tertrdnate. If the comisaion approves the proposed forma- tion with modifications or conditions., further proceedings for the formatim may be continued only in coupliance with such modifications or conditions. Sec. 5068. The board of supervisors shall furnish the camdssien with necessary quarters, equipment, and supplies, and the usual and necessary operating expenses incurred by the corrd.131on aball be a county charge. Sec. 54789. If the commission disapproves the formation of the proposed city, no notice of intention to form a new city composed of the same or subatentially'the aim territory .•may be filed with the commission for at least one year after the date of disapproval. — If the commission disapproves the formAtion of the proposed special district, no notice of intentim to fora a special district, under the same provisions of law p oviding for ,the folwtation of the special district which was disapproved, which is composed of the sam or substantially the same territory Nay be filed with the con- mission for at least one year after the date of disapproval. Sec. 54790.
