The cities of Westminster and Huntington Beach are proposing to transfer such properties pursuant to Government. Code Sec- tion 35270 et. seq . Section 35271 sto -,ea : i Proceedings to transfer territory from one city to a contiguous city are initiated by filing wi-th the board of supervisors of the county in which the cities are situated either by : a. A petition signed by not less than 25 percent of the registered electors residing in the territory to be transferred if the territory is inhabited, or b. A petition sit&;led by owners of not less than one- fourth of the land in the territory by area, and by assessed value as shown on the last equalized assessment roll of the county in which the terra- tory is situated if the territory is uninhabited; or C . A resolution of the legislative body of the city in which the territory is situated. There shall be filed with the petition a resolution of consent to the transfer adopted by the legislative body of the, city in which the territory is situated. In every case there shall be filed with the petition or j resolution a resolution of consent to the transfer adopted by the legislative body of the city to which it is proposed to transfer the territory. Quality Act of 1970 territory proposed to be transferred , the name of the city in which the territory is presently included and the name of the: city to which it is proposed that the territory will be annexed. ENVIRONMENTAL CONSIDERATIONS The LAFC staff contacted the affected cities regarding any proposed development on the properties to be transferred , to ascertain if there would be an environmental impact. The affected cities state tha'c there are no "underlying projects involved in the transfer of territory between the cities of Huntington Beach and Westminster ac this time , The property proposed for transfer to Westminster consists of 80 existing apartment units located bet-ween Heil Avenue and the northbound on-ramp of the San Diego Freeway at Magno1 ib Street. Future development in the area will be limited to a vacant one -acre parcel zoned for commercial use . The property proposed for transfer to Huntington Beach is vacant property and zoned in the City of Westminster for commercial use . The City of Huntington Beach states that upon transfer of the property to Huntington Beach, there will probably be iRmediate pressure for commercial development. The Executive I Officer has reviewed the Regaest , for Negative Declaration Status submitted by the tWo cities on- the annexations involved in this transfer of territory and determined the proposals will not have at significant effect``on the environment . Subsequently, the Executive Officer filed a negative declaration with the County Clerk relative to the transfer of territory on May 21 , 1974 . Page 4 In Re : Environmental Consideration by LAM on the matter of the City of Huntington Beach and the City of Westminster proposing to rranbfer territory from one city to a contiguous city, in compliance with the California Environmental Quality Act of 1970 COMMISSION ACTION At the Local Agency Formation Commission meeting of June 12 , 1974, the Commission adopted the negative declaration on the transfer of territory between the cities of Huntington Beach and Westminster and directed the Executive Officer to trans- mit their action to the Board of Supervisors . RECOMMENDATION Attach the Local Agency Formation Commission' s adopted reso- lution of a negative declaration to the `aending eeyuect by the cities of Huntington Belch and Westminster to transfer territory from one city to a contiguous city.
