In February, the Ituntin,gton Beach City Counci ' approved in principle a part of the reco,=endations . It is now proposed that: a. Coon street boundaries , (except Bench Boulevard) be establish=d along the ultimate centerline &f boundary streets , and b. That four vacant and uninhabited parcels be transferred with Huntington Beach to annex one parcel and Westminster to annex three parcels . It is proposed that these two matters be sub- mitted to LAFCO separately for the purpose of simplifying the transfers . 1. Transfer of vacant and uninhabited parcels: It is proposed that Westminster detach and Huntington Beach annex Parcel "C" shown on the attached map to the centerline of the freeway, a lotal aTCU of 5.06 acre3 . It is proposed that Huntington Beach detach and 4+esteinster annex Parcels "A", "B", and "D" shown on the attached map., Parcel "i," to existing centerline of McFadden and centerline of freeway, a total area of 3.66 acres. Parcel "B" to property lines only, a total area of .33 acres. Parcel "D" to centerline of freeway, a total area of 2.41 acres. Box 190 Huntington Beach, California 9216-15 Subject_: Boundary Line Charreges Dear Puul : As requested attached is a copy of our City Attorney 's opinion with respect to the procedure for transfer of t-errltor�• between c,it.).es . I have also attached the report I wf11 present, to the City Council on February 25th, recommending the transfer in two parts - ( 1) the adjustment of street boundaries, and (3) the transfer of vacant parcels. Our City Attorney has indicated that the application to LAFCO can be started by minute order of the City Councils. Of course, legal descriptions and maps should accompany the application to IAFCO, and both of our Ungl- neering Departments are working on the descriptions . Also n `ustification of the proposal is required as part of the appli- cation to 1.AFCO and we in Westminster arc working on this . After both City Councils have approved by minute order the request for approval of 1.AFC0, we should get all information together and ■inke a-'joist submittal . Ro eiC W-At I ey ., City Administrator MIiM:jii aL ;august 20, 1968 TO: CITY ADMINISTRATOR August 20, 1968 FROM; CITY ATTORNEY RE : TRANSFER OF UNINHABITED TERRITORY BETiZEN W&STMINSTER AND HUNTINGTON BEACH In 1967 , the legibiature provided a simple method for the transfer of territory from one city to a contiguou.6 city in the same county . Following is a summary of that procedure : A. APPROVAL OF LAFCO The first step is to obtain approval of the Local Agency rormation Commission . (Govt. Code 535002) B . CITIE£ 'AFFECTED MAY INITIATE ACTION BY RESOLUTION . Con'%Aguous cities may init ate proceedings by f iling with the Board of Supervisors of the County: j 1. A resolution of the legislative body of the city in which the territory is situated consenting to the transfer. 2 . A resolution of consent to the transfer adopted by the I.-gislative body of the city to which it is proposed to transfer t::e territory. The resolution s::all contain: (a) A description of the territory proposed to be t.:ans ferreO (b) The :amc of the city in which the territory is prose tly included. (r.) The name of the city to which it-, is propossd twat the territory will be annexed . (Govt. Code 535271) C. 140TICE OF PROPOSED Tt'L NSFER AND HEARING. The clerk of the Board of Supervisors shall cauac notice of the proposed transfer to be published in each of the affeCLed cities pursuant to Section 6061.. The notice shall contain a general description of,,- the , territory to be transferred, the city in which the territory is _Y_ presently situated and th.'; city to which it iu proposed to be anne4ad, and "announco the time and place written protests wily he heard which shall be not less than forty (40) nor more than sixty (60) days after the date of the f ixst publication. The clerks shall mail a copy of such notice to the legislative body of the c).ty from which territory is proposed to be transferred and to the legislative I body of the city to which the territory is proposed to be annexed at least thirty (30) days prior to the date set for hearing. (Govt. Code 535272) D. BOARD OF SUPERVISOp.S SHALL GRANT OR DENY THE REOS(IEST. iAfter hearing, the Board of Supervisors shall grant ov deny the request by resolution . If the Board grunts the request, 1-1- shall determine whether all or only a part of tho territory shall .'. ' transferred. If the Board desires to change the boundaries of the territory to be transferred, it shall first sucurn the approval of the local agency formation commission pursuant to Section 5799. 1 and the cities affected by the proposed transfer. (Govt_ Code 535273) E. WHO MAY PROTVST AND DETERMINATrON OF VA.JUE. Any owner of property within the terryt0 .1 may file a written protest against the trans:er at any time prier to final adjournment of the hearing. (Govt,. Code S35274 ) If protest is made by private owners of 'one-half of the valt:e of the territory proposed to be transferred, if privately owned , further proceedings shall not be taken. The value given such -property for protest purposes shall be that shown on the last equalized assessment roll unless the property is exempt from taxativn:`:�� If exempt from taxation, its value shall be determined by the county assessor. if privately awned And publicly owned property are proposed to be transferred in the same proceedings, further proceed- ings shall not be taken if protest is made by public and private owners of once-half of the wale of the territory. (Govt. Code S35275) F. ' FINDINGS OF BOARD OP SUPERVISORS. By resolution, the Board of Supervisors shall find Whether or not a majority protest has been made . If it does not adopt such a resoluti.cn within. thirty (30) days after the closing of the hearing, it shall be deemed to have adopted a resolution that a majority protest has been made . If a resolution finding that a majority protest is made is adopted, no further proceedings for the transfer of any of the same territory to the city shall be taken for one year after the date of the adoption of the resolution except upon petition or consent of all property owners of the territory proposed to be f transferred. (Govt. Code 535276 ) G. CLERK TO FILE AFFIDAVIT OF C044PLETXON. a If the Board of Supervisors grants the request: to . t transfer, the clerk shall enter upon the minutes , certify and transmit to the Secretary of. Spate and to the legislative bodies of the cities affected, copies of t:he resolution approving;; the • transfer. The clerk shell also file the affidavit of completion and statement of boundary change required by Section 34080 and 54900. (Govt. Code 535278 ) The Board of Supervisors may fix the data the transferred territor.1 is a part of the city in its resolution approving the transfer. If no date is fixed, the territory is a part, of the city for all purposes from the date-of filing by the Secretary of State. +r3w
