Any other comment which you wish to make: Assessed valuation of right-of-way property owned by the Bolas-Pacific Company is set by the State Board of Equalization Utilities Division, and the figure was not immediately available to the City. No assessed valuation has ever been placed on the property owned and controlled by the State Department of Beaches and Parka. Hcwever this property was 'acquired by the State for a public park in 1961, at a co et of $076,106. No improvements have been placed on this property to-date. Market value and assessed value on this property would no doubt have increased in ratio to private land in the im- mediatb vicinity. State Highway 101 which is included iatth• proposed annexation, would carry no assessed valuation. The tidelands included in the proposed annexation, which are owned and controlled by the State Lands Commission and include the three mile area covered by water, directly south-west from the shoreline of the area, have had an assessed value fixed by the Lands Commission at $5,550,aXj. The Commission, by minute action, in their meeting of December 17th, 1964 at Sacramento, approved the a.-inexation when setting said assessed valuation. State tidelands included in this proposed annexation are presently under leas* to certain Oil Companies who mine the oil as leaseholders. The City of Hunting- ton Beach contends that, under the Annexation of Uninhabited Territory Act of 1939, said leaseholders - not beinE ownere of the property - have no legal right of protest against the accomplishment of this annexation. It should be further noted by the Commission that proceedings for this proposed annexation were instituted by the City to comply with a request from the Dept. of Beaches and Parks, in order that the park could be served with City sewer and water. However this property was acquired by the State for a public park in 1961, at a cost of t976,106. No improvements have been placed on this property to-date. Hortig Executive Officer Gentlemen: Transmitted herewith is a certified copy of Resolution No. 2067 of the City Council of Huntington Beach declaring its intention to initiate on its own motion, proceedings to annex certain uninhabited territory to the City. Said Resolution was passed by the City Council of Huntington Beach on the 16th day of November, 1964. In accordance with Section 25014. of the Government Code of California, it is respectfully requested that yyour Honorable Body consent to this proposed annexation, as there are tide or submerged lands encompassed within the seaward extension of the proposed annexation. Copies of the map and legal description covering the area proposed to be annexed, which has been designated "Bolsa Chica State Park Annexation", were submitted to t1w Com- mission on October 13, 1964, by our City Administrator, Mr. Doyle Miller. Jones City Clerk PCJ:tr Enc: (1) ,I F, Y O December 17, 1964 State Lands Commission State of California Sacramento, California Gentlemen: In July of 1964 the California State Division of Beaches and Parks petitioned the City of Huntington Beach for water service at the Bolsa Chica State Beach. The Division of Beaches and Parks announced that they were proposing development of the property in the spring of 1965. Section 3546 of the Huntington Beach Ordinance Code prohibits the extension of water service outside the corporate limits of the City. In order to facilitate the proposed beach development it was suggested that the area annex to the City of Huntington Beach thereby making water service available. In order to accomplish this annexation in an orderly manner the City Council felt it necessary to include all the area from the landward side of Coast Highway to a point coinciding with our existing boundary three miles seaward. With this in mind and in compliance with State Code Sections 35014, 35311-C, 35313-B, and 35313.1, on October 13, 1964 we forwarded two copies of a map and, legal description, along with a certified copy of the City Council 's minute action initiating the study to the Los Angeles office of the State Lands Commission. State Lands Commission -2- December 17, 1964 On November 2, 1964 we received a letter from Executive Officer F. J. Hortig stating "Please be advised that the description of the area proposed to be annexed has been reviewed and found to comply with Section 35014 of the Government Code." On November 18, 1964, the Huntington Beach City Clerk Paul C. Jones transmitted to the State Lands Commission a copy of City Resolution 2067, "RESOLUTION DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO INITIATE ON ITS OWN MOTION PROCEEDINGS TO ANNEX CERTAIN UNINHABITED TERRITORY." In the cover letter it was stated "In accordance with Section 35014 of the Government Code of California, it is respectfully requested that your Honorable Body consent to this proposed annexation, as there are tide or submerged lands encompassed within the seaward extension of the proposed annexation. " Present here today are Councilman Ernest H. Gisler, Councilman Jake R. Stewart, City Clerk Paul C. Jones, Assistant City Attorney George Shibata, and Public Works Director James R. Wheeler who will be happy to answer any questions the Commission might have.
