JONES, being first duly sworn, deposes and says: That he is now and at all times herein mentioned, was the duly appointed, qualified, and acting City Clerk of the City of Huntington Beach, a municipal corporation, and ex-officio Clerk of the City Council of said City. That pursuant to Section 54797.1 of the Government Code, annex- ation proceedings were completed by the City Council of the City of Huntington Beach on the 5th day of June, 1972, by final adoption of its Resolution No. 3489, said Resolution becoming effective on June 5, 1972. That by said proceedings said City annexed the territory referred to in that certain certified copy of said Resolution No. 3489 and a map delineating said annexed area as set forth in Resolution No. 3489. That all requirements of the laws relating to such proceedings have been complied with. That on the 6th day of June, 1972, a certified copy of Reso- lution No. 3489 and a map of territory described therein designated as "Huntington Harbour. #4 Annexation" , was transmitted to the Secretary of State and was received and filed by the Secretary of State on June 8, 1972 . WHEREAS, pursuant to Section 54797.1 of the Government Code, the owners of all the land within the territory proposed to be detached have signed and filed with the Local Agency Formation Com- mission of Orange County, California, a letter requesting detachment from the Sunset Beach Sanitary District, all of that uninhabited territory situated in the County of Orange, State of California, which is part of said Sanitary District, and hereby designated as "Huntington Harbour Detachment", as shown on the map attached here- to, marked Exhibit "A" and made a part hereof; and Pursuant to Section 54797.1 of the Government Code, hearing was had on November 24, 1971, before the Local Agency Formation Com- mission of Orange County on the proposed detachment; and The Local Agency Formation Commission, finding that the appli- cation for detachment is proper, has approved such detachment and authorized this Board of Directors to detach the territory designated as "Huntington Harbour Detachment. " NOW, THEREFORE, the Board of Directors of the Sunset Beach Sanitary District does resolve as follows: That it does detach the uninhabited territory designated as "Huntington Harbour Detachment, " as shown on the map attached hereto, marked Exhibit "A" and made a part hereof, all of said territory detached is described as follows: Beginning at the intersection of the centerline of Warner Avenue with the Northeast right of way line of Pacific Coast Highway as shown on a map recorded in Book 26, Page 15 of Parcel Maps, records of Orange County, California; thence North 890 51' 53" East 280.30 feet along the centerline of Warner Avenue to its intersection with the existing boundary line of the Sunset Beach Sanitary District; as described in Resolution No. 62-501 of Orange County said inter- section being the TRUE POINT OF BEGINNING, said point also being the Southwest corner of that certain 1.354 acre parcel of land shown on a map recorded in Book 7, Page 20 Records of Surveys, Records of Orange County; thence North 380 06 ' 22" West 418.61 feet along the existing boundary line of the Sunset Beach Sanitary District, also being the Southwesterly line said 1.354 acre parcel; thence North 890 51' 53" East 307.55 feet along said boundary line, also being the Northerly line of said parcel of land; thence south 00 08' 07" East 330.00 feet along said boundary line, also being the Easterly line of said parcel, to its intersection with the centerline of Warner Avenue; thence South 890 51' 53" West 50.00 feet along said boundary line, also being the Southerly line of said parcel and the centerline of Warner Avenue to the TRUE POINT OF BEGINNING. The City holds a Grant Deed for this property which was acquired for certain considerations established between the District and the City. Said. property is in the County of Orange bit is adjacent on three sides to the City of Huntington Beach. The City Council has requested that this property be detached from the Sunset Beach Sanitary District because the territory is presently assessed real property taxes by the County of. Orange which must be paid by the City of Huntington Beach as owners thereof. It is further requested that such detachment. be made in accordance with the provisions of Section 56261 of the Government Code of the State of California which provides for- such action without notice and hearing. We are submitting herewith a certified copy of Resolution No. 3376 of the City Council of the Cityy of Huntington Beach, adopted at their regular meeting held. Castle , Subject : Annexation of Property Acting City Administrator in Sunset Beach Gentlemen : Your Honorable Body has directed me to proceed with the annexation of a parcel of property now owned by the City which was previously occupied by the Sunset Beach Sanitation District Sewage Plant . In exploring the proposed annexation I have found that , if we pro- ceed with the subject annexation prior to our getting it detached from the Sunset Beach Sanitation District, Orange County Sanitation District Board No . 11 would be required to accept a member from the Sunset Beach District . It is my opinion that your Honorable Body does not want this to happen since it would possibly change control of said District No. 11. For this reason, I am submitting to you Resolution No. 3376 requesting detachment of subject property from the Sunset Beach Sanitation Dis- trict by the Local Agency Formation Commission. I would recommend that you direct that no further steps be taken in the proposed annex- ation of subject territory to the City until such detachment has been approved by the Local Agency Formation Commission and is in effect. Sincerely yours , Paul C . nes City Clerk PCJ :cb attach: 1 i M RESOLUTION NO. 3376 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH PROPOSING A CHANGE OF ORGANI- ZATION IN THAT DISTRICT KNOWN AS THE SUNSET BEACH SANITARY DISTRICT BY THE DETACHMENT OF CERTAIN DESCRIBED REAL PROPERTY LOCATED WITHIN SAID DISTRICT WHICH REAL PROPERTY IS ALSO LO- CATED IN A COUNTY AREA IMMEDIATELY ADJACENT TO THE BOUNDARIES OF THE CITY OF HUNTINGTON BEACH WHEREAS, the District Reorganization Act of 1965 (Sections 56000 through 56550 of the Government Code of the State of Cali- fornia) provides for the change of organization of certain dis- tricts , such as . the Sunset Beach Sanitary District, through the approval by the Local Agency Formation Commission of Orange County of detachment of certain hereinafter described real property from y said district, when said territory is completely owned by the City of Huntington Beach; and The City of Huntington Beach desires that said real property be detached from the Sunset Beach Sanitary District because said territory is presently assessed real property taxes by the County of Orange which must be paid by the City of Huntington Beach as owners thereof; and The County of Orange, the Sunset Beach Sanitary District, and the City of Huntington Beach would be affected by this change of organization requested herein; and The present request of the City of Huntington Beach is for detachment of certain territory constituting uninhabited territory and described in Exhibit "A" attached hereto and made a part hereof as though fully set forth herein; and The City of Huntington Beach (landowner of the territory des- cribed in Exhibit "A") desires to construct a fire station eventually which will provide fire protection for both land and water areas, 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that it hereby requests that a change of organization of Sunset Beach Sanitary District be approved by the Local Agency Formation Commission of Orange County through a detachment of certain real property, described in Exhibit "A, " characterized as uninhabited property , in order that said City of Huntington Beach may eventually annex said territory to said city and proceed with the construction of the aforementioned fire facility .
