A City Attorney's memorandum explaining annexation procedures has been,. attached. Signal Bolsa 'Corpofation has requested the City to proceed .with. step l giv'ing tentative approval to the proposed annexation and-' to authorize the City Clerk to file same with the Local Agency Formation Commission. They have also filed a request to pre. nne.tths -)property R2-PD10 to• permit 10 units per gross acre of land. Before the prezone request may be considered by the Planning Commission, an Environmental Impact ' Report must be prepared. It appears that the City Council was concerned that the annexation would proceed without .the .benefit of an Environmental Impact Report. As pointed out in the memorandum from the City Attorney, the City may require an Environmental Impact Report prior to annexation. This requitement may be made any time prior to the City .Council adopting a°:.resolution to .annex the property which is step ,5 under City Attorney's memorandum. Recommendation I would like to recommend that the City Council proceed with step 1 to adopt the resolution of intent adopting . tentative approval of the . proposed annexation .and authorize the City Clerk. to file same with the Local Agency Formation Commission.. This is done with the understanding that an Environmental impact Report and zone change will be processed concurrently and a determination made prior to the final resolution annexing the -property. BONFA City Administrator City Attorney Subject Bolsa Chica Annexation Date February 1, 1973 It is my understanding that the Bolsa Chica Annexation is being conducted under the provisions of Government Code Section 54797 .1 . The application of this section is limited to situations wherein ALL real property owners consent in writing to the annexation. 1. A resolution of intention to annex is adopted by the City Council. 2 . An application signed by all landowners or with proof of the landowners ' consent is filed with LAFCO . 3. LAFCO may approve the annexation with or without a hearing, by resolution. 4. In such cases . LAFCO may also authorize the legislative body of the city to annex such territory (a) Without notice and hearing by the legislative body; (b) Without an election; (c) Or both. 5 . The Council annexes the property by resolution. NOTE: In the light of the decision in Weber v. Thousand Oaks , 104 CR 338, and Curtiss v. Los Angeles , 104 CR 297, it is doubtful that an election may be waived. If there are no in- habitants in the Bolsa Chica area, this waiver should present no problem. Property may be prezoned prior to annexation pursuant to HBOC 982.3 and Government Code Section 65859 • Property not prezoned becomes R-1 upon annexation. (HBOC 9823 .1) The city may require an EIR or exemption declaration prior to pre- zoning before annexation or prior to rezoning after annexation. There does not seem to be any reason why the city cannot require an EIR or exemption declaration prior to annexation in the event the property is to be annexed without prezoning. The Signal Bolas Corporation had requested annexation of 263.536 acres of land located in the northeasterly section of the Signal Bolas Corporation property which is entirely owned by them except for a 15 acre school site presently owned by the Ocean View School District, from which a communication had been received stating that they have no objections to annexation of their 15 acre parcel. Mayor Coen stated thatthe representatives of Signal Bolas Corporation. had contacted Administration indicating their desire to withdraw their previously submitted request for annexation, pending completion of the Environmental Impact Report and other matters which were of concern to the City Council and Planning Department. Box 190 Huntington Beach, California 92648 Dear Mayor Coen and City Council Members, I_ am grateful for the privilege of going to Sacramento Friday, January 26 .to the State Lands Commission hearing and discussion on the land exchange in Bolsa Bay. Commissioners present were Chairman Mr. Flournoy, Mr. Reinecke, and Mrs Fryer, alternate for Mr. Orr. Many executives of Signal Oil and Signal Properties, their lagers and engineers, most of . the members of the Resources Agency Environmental Task Force (who developed this ,proposal .for the State), Richard .Ruiz from David Baker's office, and a number of unidentified people attended the. meeting for this issue. The background of this proposal was presented briefly by Mr. Hortig, . Executive Director of the State Lands Division, with the aid of three slides and. some maps of 1) the State easement rights, 2) the proposed land exchange, and 3) the proposed development of the saltwater marsh and marina. Mr. Flournoy asked if I wished to speak, which I did briefly, indicating the two primary benefits to the public with this proposed development are 1) providing a larger well-defined area In which a natural ecological balance of fish, bird, invertebrate and plant life could be' re-established without disturbance by curious or destrUe tive public and 2) making the public land more visibly accessible and enjoyable, which, being. adjacent to Bolsa Chica State Beaoh, could enhance that area and its recreational facilities. I also stated that, while this property is presently under county jurisdiction, the city of Huntington Beach staff asked me to convey their interest in and approval of the concept of this proposal. A letter of January 23 from Secretary of the Resources Agency Mr. Livermore was read, indicating his interest 'in this exciting project", .and stating that money for detailed planning would be budgetted for- 1973-74• "The. execution of Boundary and Exorange Agreement No. 137 between the Commission, certain specified ignal Companies, and .those other parties which execute said agreement concerning Bolsa Bay, ' Orange County" was approved as indicated. Another item of intere• st was a lengthy discussion of requests from the South' Coastal Regional Coastline Commision for legal opinion from the State Lands Division and the Attorney General's office on oilfield. permits. The issues are summarized below. After February to any permit requested requires Regional Commission permit. The State Commission must establish the. guidelines for : permitsa so the Regional Commissions cannot grant permits until. after that has been done, probably sometime before mid-February. (Formal opinion will be published from the Attorney- General's Resources Group., headed by Carl Barenque 0) and :four deputies. The `issues mentioned here indicate . the trend of present thinking. ) Any oilfields within. an :area after February 1 may continue oper- ations through existing facilities without a special permit. Any substantial- change in the use of the oil reservoir or surface reservoir--such as new drilling, production, injection, redrilling, conversion from,production .to injection- or the reverse, change in infection substance, plugging or deepening a well--will require a permit. No permit would be necessary for survey,. testing, changing tubingo changing pump heac16 if operation is for same use. 'In generalo permit is needed for .development,. not for maintenance. "Repairs" involving complete reconstruction would need a permit. It may be possible to request approval of a. permit for° all oper- ations of a given type on a given lease (or a given defined area) if or a given timer Related to this issue was State Lands Commission approval of the +Environmental Impact Statement .developed for all operations with existing facilities in the Long Beach Oilfield.. This has been approved by Long Beach City Council, and has been forwarded to the Regional Coastal Commission for their approval.
