LOS ANGELES 31,CALIFORNIA V r October 20, 195 City Council Hunt,Beach California Gentlemen: It is hard to understand how a, body of men who presumably because of their election to the city's highest office are persons of high characters can act so deviously and unfairly as was done in Ordinance 541 in which my property was added to the city without my knowledge and with no opportunity to be heard. Do not cite the fact of publication since you well know that none of the owners whose property was annexed„I might say surreptitiously, are readers of the Huntington Beach Newt and were therefore not put on notice. In Pasadena where I live a post card is mailed to all property owners affected when any action is proposed. Surely it would have been fair and honest to give all property owners affected by this annexation an opportunity to be heard and also to be informed why such an unusual annexation was proposed, my property being three or four miles distant from any inhabited part of your city. I shall be glad to have justification of this act if there be such. I now consider your act unfair to an uncomprehensible degree and entirely unworthy of any public servants in authority. I learned of this action only a few days ago when I received your tax bill. In order to annex uninhabited territory the consent of the legislative body of the city must be secured before commencing any proceedings whatever. That is , the proponents would be required to secure the consent of the City Council before initiating proceedings under the provisions of the act. t If the territory sought to be annexed is already sub- divided, and if the design of the subdivision, and the construction of buildings do not comply with the standards , that is the ord- inances of this city, consent must be secured from the City Council after a report and recommendation from the planning commission. Therefore, the first step would be for the Improvement. Associat- ion to request consent of the City Council of the City of Hun- tington Beach. .After receiving the request the city council is re- quired to submit the request to the planning commission, who must make a report within forty days thereafter, or the city council may act without the report. After consent has been obtained the proponents must publish a notice of intention to circulation a petition for annexation. This notice shall contain the names of the propon- ents intending to circulate the petition and a description of the specific boundaries sought to be annexed. Also a statement not exceeding 500 words in length of the reasons for the proposed annexation. Mayor and' City Council - 2 8-5-49 Apparently the notice must be published- in the city to which the territory would be annexed. Within ten days after the publication of the notice the proponents shall file a copy of the notice, together with an affidavit of publication, with the city clerk. Twenty-one days after publication the proponents circulate the petition with- in the area sought to be annexed. The petition, to qualify, shall be signed by not less than one-fourth in number of the qualified electors residing within the territory described within the petition, as shown by the registration of voters in the county in which the terri- tory is situated. After the petition is presented the city must pass a resolution of intention to call a special election, describing the territory and at the same time giving notice of a hearing thereon. The hearing shall be held not less than fifteen nor more than forty days from date of passage of the resolution. The resolution must be •published once a week for two successive weeks in the territory proposed to be annexed, if there is a newspaper in such area, if not, then within the city to which said area seeks to be annexed. If the -owners of more than- fifty per cent of the par- cels involved protest, the proceedings then must abate. However, if the protest is not sufficient the legislative body must, with- out delay, call a special election in the territory proposed to be annexed. If the election carries the city council may either by ordinance approve of the annexation, or if they fail to so do , then they must submit the proposed annexation to the electors residing in the city. The ordinance or report of the election must be filed in the office of the Secretary of State which completes the annexation.
