City of Huntington Beach, which would include two parcels owned by
our company. These are 'listed in the book of maps for the Assessor
of Orange County as follows:

to the City of Huntington Beach, and will not register any objections

There do not appear to be any acceptable alternates.
G. WHAT REVENUE WILL YOUR PROPOSAL REQUIRE FOR THE ACCOMPLISH-
MENT OF ITS GOALS AND WHAT ARE THE PROSPECTIVE SOURCES OF
SUCH REVENUE?
Services will be paid for through regular taxes based on
assessed valuation. Any necessary street improvements would
be financed through a 1911 Act Assessment District or by
individual developments.

Adjacent sewer facilities n the City havp hppn developed._to
accomodate the area of Sunset Beach Sanitation District. The
water system for this area is presently owned by the City
of Huntington Beach but operated independently from the
system within the City. If the area should annex, the
system in Sunset Beach . could be more readily upgraded.

order that the community of Sunset Beach may have a more
influential voice in a government closer to Sunset Beach,
also to complete and maintain the geographical integrity
of the area, and, to secure better municipal services .
Problems common to Sunset Beach and the surrounding area
of Huntington Beach would be more readily solved under a
common jurisdiction. "

Beginning at an--angle point in the Present city .boundary line of the city. of
-Huntington Beach,4County.,of Orange, State of California, said boundary having
been, established by "Huntington Harbour Corporation Annexation, Parcel No. 241
in Ordinance No. 920 of said city., said -angle point being at the intersection
of the centerline of Earner Avenue, (formerly Los Patos Avenue) 60 feet in
width, with the northeasterly right of way of Pacific Coast Highway, (California
State Highway 1) 100 feet in :width as per deed recorded in Book 410, Page 165
of Official Records, Records of ,said„ County, ,said ,point lies -on ,a curve in
said right of way concave to the southwest having a radius of .3,050 feet. A
radial line through said point bears south 49*1112511 test; thence northwesterly
along said curve 144.32 feet .through a central angle_of 2*4214011 to a point ,
on a tangent line, said curve and tangent line being the northeasterly right
of my of said Pacific Coast Highway and ,the .boundary of .the city of Huntington

OF PROPOSED. ANNEXATION TO THE CITY, OF
HUNTINGTON ,BEACH OF THAT CERTAIN UNINHAB-
ITED TERRITORY DESCRIBED HEREIN AND DES-
IGNATED AS "SUNSET BEACH NO. 5 ANNEXATION"
AND GIVING NOTICE OF TIME AND PLACE FOR
HEARING OF PROTESTS THERETO. '
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTON
BEACH: --
Section 1. That pursuant to the provisions of the "Annexation
of Uninhabited Territory Act of 1939," the City Council of the City
of Huntington Beach, by minute action taken at a regular meeting
of said body on January 13, 1969, gave notice of its intention to
annex to the City of Huntington Beach that certain territory describ-
ed herein, and designated as "Sunset Beach No. 5 Annexation," and
further gave reasons for proceeding with -said annexation; that said
territory which said City and its Council proposes to annex to the
City of Huntington Beach is situated in the County of Orange, State
of California, and is hereby des-MI described as follows:

Section 2. That the Local Agency Formation Commission of the
County of Orange, California, did - in session duly assembled on
March 12, 1969, hold a public hearing on said "Sunset Beach No. 5
Annexation" and after hearing any and all parties who were for or
against such annexation, did approve said annexation as submitted
to said Commission by the proponents.
Section 3. That May 5, 1969, at the hour of 7:30 P.M. or as
soon thereafter as possible on said day, in the Council Chambers
in the City Hall in the City of Huntington Beach, County of Orange,
California, is hereby fixed as the time and place when and where
any person owning property within the uninhabited territory above .
described and proposed to be annexed to the City of Huntington
Beach .a_nd -having any objection to the proposed annexation may
appear before the Council of the City of Huntington Beach and show
cause why such uninhabited territory should not be so annexed to
said City of Huntington Beach. Such protest must be in writing,
may be filed at any time before the hour set for hearing objections
to the proposed annexation, and shall state the name or names of
the owner or owners of property affected and the description and
area of such property in general terms.
Section 4. The City Clerk of the City of Huntington Beach is
.hereby authorized and directed to cause a copy of this resolution
to be published at -least twice, but not oftener than once a week
in the "Huntington Beach News", a newspaper of general circulation
published in said City of Huntington Beach, the City to which it
is proposed to annex the aforesaid territory, and also in the
"Orange County Evening News", a newspaper of general circulation
published outside the City of Huntington Beach, but in the County
of Orange, California, the County in which is' located the territory
proposed to be annexed to the City of Huntington Beach, said publi-
cation to be completed at least twenty (20) days prior to the date
set for hearing.
Section 5. And the said City Clerk is further (suthorized and
directed to cause written notice of such proposed annexation to be
mailed to each person to whom land within the territory proposed
to be annexed is assessed in the last equalized county assessment
roll available on the date the above proceedings were initiated,
at the addresses shown on said assessment roll or -as known to said
Clerk, and to any person who has filed his name and address and the
designation of the lands in which he has any interes , either legal
ar eauitable_with said Clerk. such notice to be given not less than
twenty (20) days before the first public hearing on the proposed
annexation.
Section 6. In the event any land within the territory proposed
to be annexed is owned by a county, the said City Clerk is directed
to cause written notice of such proposed annexation to be mailed
to the Board of Supervisors of such County, such notice to be given
not less than twenty (20) days before the first public hearing on
the proposed annexation.
Section 7. The said City Clerk is directed to cause written
notice to be given to such other persons as may be legally entitled
thereto in the manner required by law.
PASSED AND ADOPTED by the City Council of the City of Huntington
Beach, California, at a regular meeting thereof held on the 17th
day of March, 1969.

SUBJECT: Proposed Annexation to the City of Huntington Beach Designated
Sunset Beach No. 5 Annexation
Gentlemen:
This is in reply to your request that this office submit a report on the
proposal cited above.
We wish to ,call to your attention the fact that this proposed annexation
involves only a small portion of the unincorporated community of Sunset
Beach. The City _of Huntington Beach makes no reference to this inhabited
unincorporated area in its Justification of Proposal,- nor is any consider-
ation given to the affect that this proposed annexation may have on the
remaining Sunset Beach unincorporated area.
Although the Sunset Beach area is now, for all practical purposes, an
island of -unincorporated territory, approval of this proposed annexation
will make it an island in fact, surrounded on the west by the ocean, on the
northwest by the City of Seal Beach, and on the east and south by the City
of Huntington Beach.
The County presently.operates a fire station at Sunset Beach and serves the
area with police protection through the Sheriff's .patrol. The high costs to
the County resulting from inefficiencies involved in providing these and
other governmental services to a small island of inhabited unincorporated
territory such as Sunset Beach are of great concern to us. This concern
coupled with the fact that residents of Sunset Beach have recently petitioned
both the City of Huntington Beach and the City of Seal Beach for annexation
would appear to dictate the necessity for further study of this proposed
annexation in terms of future annexation plans prior to your taking action.

We would- recommend that no action be taken on this proposal at this time
and that the matter be referred to your Executive Officer for further.
study and coordination with the Cities of Huntington Beach and Seal Beach
in order to ascertain their future annexation plans in the area and to
possibly establish a boundary agreement between these Cities. If this
office can be of any assistance in this matter, staff will be available
upon your request.

This proposal is an uninhabited annexation containing approxi-
I mately 3. 57 acres and is the most southerly portion of the
C.M. FEATHERLY community of Sunset Beach adjoining the city boundary of
Supervisor Huntington Beach to the east and south.

In 1966, the Orange County Planning Department embarked on a
FRANK P. NOE study of the Sunset Beach-Surfside area. In order to crystalize

City of Cypress change and resolution of problems of their environment in

activated as a part of the study. Over a period of several

Plan "C" — "desired change". This plan is the "middle
ground" between the minimum change and the maximum change
plans. The basic philosophy of this plan is to follow
the goals of the people of :the community while, at. the
same time, encouraging the resolution of some of the
key problems of the area.
The Citizens Project Committee endorsed Plan "C" and recommended
the adoption of this. plan by the County Planning Commission. as a
guide for decisions affecting .the community.
On March 15, 1967, the Orange County Planning Commission
recommended Plan "C" to the Board of Supervisors. On July 6,
1967, the Board of Supervisors adopted Plan "C" as the plan to
follow for resolving some of the problems of the area.
On February 5, 1969, the City of Huntington Beach submitted
another proposal termed Sunset Beach No. 6 Annexation consisting
of approximately 85.7 acres, taking in the remainder of the
community of Sunset Beach.
Based on the. most recent filing of Annexation No. 6 by Huntington.
Beach and the results of the study, as prepared by the County
Planning Department with the citizens in the area, it is felt
that any annexation request for Sunset Beach should include the
entire community. Therefore, it is suggested the Commission.
continue Sunset Beach No. 5 Annexation until the meeting of
.March 12, 1969, when Sunset Beach No. 6 Annexation is scheduled
for hearing and hear both applications at the same time.

The undersigned, Southern Pacific Company, hereinafter
referred to as petitioner, is the owner of property situated in
the County of Orange, State of California, within the boundaries
of the proposed Sunset Beach No. 5 Annexation to' the City of
Huntington Beach, together with all .hereditamentsi improvements,
etc., appertaining to said property and would be adversely
affected by such proposed annexation.
The property within the proposed Annexation No. 5 is des-
cribed on the assessment roll of Orange County in SBE Tax Code
Area 64004 under State. Board .of Equalization Land Identification
Map 856-30-54-Parcel l and Parcel 2. The total assessed valuation
of the above-described property is t18370.
In accordance With the proposed Sunset. Beach No. 5 Annexation.,
petitioner contends that such. annexation will result in additional

.taxes which will act as an additional expense and burden in the
operation of its railroad. Petitioner further contends that such
annexation will cut in half approximately four acres of petitioner's
property, which property is under consideration for development
as a unit, thereby resulting in a tremendous reduction in the
value of petitioner's property to the irreparable damage of
petitioner.
Petitioner hereby indicates its opposition to such annexation
and requests your Honorable Body to exclude petitioner's property
from the proposed Sunset Beach No. 5 Annexation.

Proposed Annexation to the Cit of Huntington Beach
(Sunset Beach No. 5 Annexations
The Orange County Planning Department has reviewed the proposed
annexation and offers the following comments for your consideration.
The property considered for annexation is zoned to allow C2
"General Business" and R4 "Suburban Residential" District uses.
The land area is 3.5 acres in size with a population of two residents.
This annexation is part of a 104 acre unincorporated community of
1200 residents known as Sunset Beach.
The community of Sunset Beach is an area with many developmental
problems. Since 1904, Sunset Beach along with the community of
Surfside adjoining to the north have developed on a lot by lot basis.
Most of the lots are below existing standards in size and many of the
structures were built decades ago.
There are no sidewalks, curbs, or gutters and local streets are far
below desirable widths. Public utility facilities are near peak
operational capacities and are in need of rehabilitation, recon-
struction or replacement. In addition, the poor condition of existing
structures and bulkheads, beach erosion, circulation inadequacies
and off-street parking, all illustrate the need for establishing a
program to define the problems of the area and develop alternative
solutions, plans and programs.

Toward this end, the Planning Department with the cooperation
of other county departments and residents of the area prepared
a study for the community which culminated in the adoption of a
General Plan of Land Use by the Board of Supervisors on July 6,
1967.
The basic philosophy of the plan was to follow the goals of the
people of the community, while, at the same time, encourage the
resolution of some of the key problems of the area. The plan
includes such other suggestions as common off-street parking and
vista areas, confined shopping areas, and a community facility
center.
In March, 1968, a petition was received by the Local Agency
Formation Commission requesting the formation of the Sunset Blvd.
District. This proposal was a citizen-led attempt to correct some
of the problems in the area related to streets, highways, vehicular
circulation and off-street parking. Your Honorable Commission
denied the request for district formation on July 10, 1968.
At the present, the County Administrative Office in conjunction
with the Harbor District and the Planning Department is studying
possible alternatives to the parking situation at Sunset Beach.
A recommended course of action has not been decided upon nor have
the alternative plans been presented officially to the Board of
Supervisors.
The department believes that the annexation of Sunset Beach should
be approached on the basis of all 104 acres of the community. This
would provide the city of Huntington Beach with the opportunity for
guiding future land development and correcting deficiencies on a
community basis rather than dividing the problems along jurisdiction
boundaries.

Pursuant to Section 54778 of the Government Code, the Road Commissioner
and County Surveyor has reviewed the map and description of the boundaries
of proposed Sunset Beach No. 5 Annexation to the City of Huntington Beach
and finds them to be not definite and certain. We have dispatched a
correction list to the proponents and will inform you when we receive a
corrected map and description.
The Highway Division of the County Road Department has reviewed this
pro posed annexation and offers no comment.

Beginning at an angle point in the present city boiuldary line of the city of
Huntington Beach, County of Orange, State of California, said boundary having
been established by "Huntington Harbour Corporation Annexation, Parcel No. 211
in Ordinance No. 920 of said city, said angle point being at the intersection
of the centerline of Warner Avenue, (formerly Los Patos Avenue) 60 feet in
width, with the northeasterly right of way of Pacific Coast Highway, (California
State Highway 1) 100 feet in width as per deed recorded in Book 410, Page 165
of Official Records, Records of said County, said point lies on a curve in
said right of way concave to the southwest having a radius of 3,050 feet. A
radial line through said point bears south 49*11125" west; thence northwesterly
along said curve 144.32 feet through a central. angle of 2*42140" to a point
on a tangent line, said curve and tangent line being the northeasterly right
of way of said Pacific Coast Highway and the boundary of the city of Huntington
Beach as described in said Ordinance No. 920; thence north 43'31'15" west along
said line, said line being described as bearing south 43*22134" east in said
Ordinance No. 920, 368.49 feet to a point; thence leaving said northeasterly

1. The proposed annexation cuts property as presently assessed.
2. In our opinion , the proposed annexation will not result
In double taxation unless the city will be furnishing a
public service already provided by a district within the
area of the proposed annexation.
3. The proposed annexation will not meet the approval of the
Assessor' s Office as it does not conform to deed recorded

Mayor. Coen called the regular adjourned meeting of the
City Council of the City of Huntington Beach to order at 4:30
o'clock P.M.
Councilmen Present: Bartlett, McCracken Kaufman Matney, Green Coen
Councilmen Absent : Shipley (arrived 7: 5 P.M.
SUNSET BEACH NO I ANNEXATION
The Assistant City Administrator informed the Council that the
Clerk had a map and legal description prepared for .filing on
Sunset Beach No. 5 Annexation, and recommended that the Council
authorize the filing of same with the Local Agency Formation
Commission at the discretion of the City Administrator and City
Clerk.
On motion by Green, Council authorized the City Administrator
and City Clerk to proceed with the filing of Sunset Beach No. 5
Annexation with the Local Agency Formation Commission when they
deemed such filing advisable. Motion carried.
On motion by Matney -the regular adjourned meeting of
the City Council of the City of Huntington Beach adjourned.
Motion carried.
