4 On motion of Supervisor Baker, duly seconded and carried , the
5 ' following Resolution was adopted :
6 WHEREAS , the City of Huntington Beach has transmitted its Resolu-
7 tion No . 3107 describing certain territory annexed to the City of
8 Huntington Beach which also lies within the territory of the Sunset
Teach Lighting District ;
10 NOW, THEREFORE, BE IT RESOLVED that , pursuant to the provisions
11 of Streets and Highways Code Section 19290, in order to avoid double
12 taxation, the territory described in said petition, a legal description
13 of which is attached hereto, is withdrawn from the Sunset Beach Lighting
14 District and Resolution No . 3107 of the City Council of the City of

PAUL C. JONES, being first duly sworn, deposes and says:
That he is now and at all times herein mentioned was the duly ap-.
pointed, qualified, and acting City Clerk of the City of Huntington
Beach, a municipal corporation, and ex-officio Clerk of the City
Council of said City.
That pursuant to the provisions of the "Annexation of
Uninhabited Territory Act of 1939," and amendments thereof and
additions thereto, the City Council did on the 3rd day of August,
1964, pass and adopt Resolution No. 2023 giving notice of the
proposal to annex certain uninhabited territory being designated 8,13
"Sunset Beach #3 Annexation," and said action being taken pursuant
to a written petition therefor. That annexation proceedings were
completed by said City Council on the 5th day of October, 1964,
by final adoption of its Ordinance No. 1089, said Ordinance becoming
effective on November 5, 1964. That by said proceedings said City
annexed the territory referred to in that certain certified copy
of said Ordinance No. 1089 and a map delineating said boundary,
which Ordinance and map are annexed hereto and by this reference
incorporated herein. The boundary description of said annexed
area is set forth in Ordinance No. 1089.
That all requirements of the laws relating to such pro-
ceedings have been complied with.
That on the 5th day of November, 1964, a certified copy
of Ordinance No. 1089 and a map of territory described therein
designated as "Sunset Beach 0 Annexation," was transmitted to the
Secretary of State and was received and filed by the Secretary of
State on November 6 , 1964.

Gentlemen:
Transmitted herewith is a letter from Mr. Nevin R. Shade,
President of the Sunset Beach Sanitary District Board of
Directors, relative to Sunset Beach No. 3 Annexation. May I
point out the following facts in connection with his letter
to your Honorable Body.
1. He states that the area is an inhabited area. However,
he evidently is not aware of the technical definition
of an inhabited area as set forth in the Government Code,
which states that an area is inhabited when twelve or
more registered voters live within it.
2. To the best of our knowledge the proponents of the annex-
ation and majority of the people residing in the area
proposed to be annexed, understand that they will recikve
free trash and garbage collection following said annex-
ation. They are also aware that they must continue to—
pay taxes to the Sunset Beach Sanitary District until
such time as that district is dissolved and merged with
County Sanitation District No, 11.
3. Your action in regard to this letter is discretionary
wit)[ your Honorable Body. However, the hearing has been
set and I believe must be held in compliance with the

Government Code for it is my understanding that the writer
of the letter, Mr. Shade, does not reside in the area pro-
posed to be annexed, and is therefore not entitled to pre-

Gentlemen:
The subject of this letter is in regards to your
Resolution No. 2023 relative to an annexation of part
of Sunset Beach to the City of Huntington Beach.
This is a personal letter. I am President of the
Sunset Beach Sani ary District Boar: of Directors but
the Sunset 3each Sanitary District Board of Directors All
not meet in time to discuss t'-is p ro;)osed annexation.
First, I want to call your atte»tion to the fact
that the area which is oroposed to be annexed is now and has
been inhabited for the last forty years. The title of the
Resolution states that it is an uninhabited_ area, which
may be misleading to some people.
SECOND, that there are now nine dwellings in this
area connected to the Sunset Beach Sanitary District sewer
system and from which the Sunset Beach Sanitary District
also collects trash and garbage. That is, this area is
now part of the Sunset 3each Sanitary District and the
owners of these properties are taxed now and will be in
the future in order to pay their share of the cost of the
operation of the Sunset Beach Sanitary District,
Third, I suggest that this resolution be tabled until
an agreement is rfuched between the city of Huntington
Beach and the Sunset Beach Sanitary District regarding the
handling of the sewage and trash and garbage from the area
which is being proposed for annexation.
Fourth, Cn ny Orange County tax bill there are other
districts which may be effected by this proposed annexation.

I have checked this matter since, and have found the
following to be true:
(a) The records of the Orange County Assessor 's Office
show your property in Sunset Beach as being owned

California.

Transmitted herewith is a letter from Mr. Nevin R. Shade ,
President of the Sunset Beach Sanitary District Board of
Directors , relative to Sunset Beach No. 3 Annexation. May I
point out the following facts in connection with his letter
to your Honorable Body.
1. He states that the area is an inhabited area. However ,
he evidently is not aware of the technical definition
of an inhabited area as set forth in the Government Code ,
which states that an area is inhabited when twelve or
more registered voters live within it.
2. To the best of our knowledge the proponents of the annex-
ation and majority of the people residing in the area
proposed to be annexed, understand that they will receive
free trash and garbage collection following said annex-
ation. They are also aware that they must continue to
pay taxes to the Sunset Beach Sanitary District until
such time as that district is dissolved and merged with
County Sanitation District No. 11.
3. Your action in regard to this letter is discretionary
with your Honorable Body. However, the hearing has been
set and I believe must be held in compliance with the
Honorable Mayor Page 2 September 14, 1964
and City Council
Government Code for it is my understanding that the writer
of the letter, Mr. Shade, does not reside in the area pro-
posed to be annexed, and is therefore not entitled to pre-
sent a protest to the proposed annexation.
These facts are presented for your consideration in taking action
and further proceedings on said Sunset Beach No. 3 Annexation.

The meeting of the Local Agency Formation Commission of Orange County,
California, was held July 8; 1964 at 2:00 P.M. Members of the Commission
present were : William D. Martin, Chairman; C.M. 'Featherly, Chas. A.
Pearson, William J. Phillips, Paul J. Wishek and George B. Honold.

On Mption o;f, Commissioner Featherly, duly seconded and
unanimously carried, 'the hearing on the proposed annexation de.signated
as "Sunset Beach No.' 3 Annexation" to the City +of, Huntington Beach,
the boundaries of which were found definite and certain by the Boundary
Commission, is `closed and the proposed- annexation is approved.

Justification of Proposal
(Bylaw No. 31)
Chapters 6.5 and 6.6 of Part 1, Division 2, Title 5 of the Government
Code charge the Local Agency Formation Commission with responsibility for
the review and evaluation of proposals for the formation of, or annexation
to, local agencies. As provided in the sections of the code referred to
above, the factors to be considered by the Commission in reviewing such
proposals shall include but not be limited to:
(1) Population; population density; land area and land uses; per
capita assessed valuation; topography, natural boundaries,
and drainage basins; proximity to other populated areas; the
likelihood of significant growth in the area, and in adjacent
incorporated and unincorporated areas, during the next 10
years.
(2) Need for organized community services; and present cost and
adequacy of governmental services and controls in the area;
probable future needs for such services and controls;
probable effect of the proposed formation and of alternative
oourses of action on the cost and adequacy of services and
controls in the area and adjacent areas.
(3) The effect of the proposal, and of alternative actions, on
adjacent areas, on mutual social and economic interests and
on the local governmental structurd of the county.
In order to facilitate the Commission's review of your proposal,
Bylaw No. 31 requires proponents of certain formations or annexations to
file the following questionnaire along with a map, at least one week
before the hearing. All blanks must be filled in, but only questions which
you deem relevant need be answered. Where the question is not relevant to
the type of action you propose, write in "NA" .

Gentlemen:
On April 21, 1964, the Planning Commission
considered the proposed annexation of a
small area south of Broadway in Sunset Beach
which you referred to the Commission for a
report.
After considerable discussion, it is the
unanimous recommendation of the Planning
Commission that the area not be annexed
because all lots involved are extremely sub-
standard and there would be no advantage to
the City resulting from the annexation.
