Discussion followed. It was noted that the City of Huntington Beach had filers their Annexations 5 -and 6 with the Local- Agency Formation Commission. Hamilton moved, second by Fuhrman, . that we support the residents of Sunset Beach in their efforts to be considered as a. total- community, that LAFCO was created for the purpose of the orderly growth of cities to eliminate "piece meal" annexations and not to create county islands, and therefore request that Annexations 5 and 6 be considered as one annexation. They state the SECOND DISTRICT reason for annexation is that a representative group of Sunset Beach residents have requested annexation proceedings be FRANK P. HOE initiated. COUNCILMAN CITY OF CYPRESS At the Commission meeting of February loth, the Sunset Beach No. 5 .Annexation, containing approximately 3.57 acres, located at the southerly end of Sunset Beach was continued to the ALTERNATE meeting of March 12, 1969. Sunset Beach No. 6 Annexation ROBERT W. BATTIN SUPERVISOR along with Sunset Beach No. 5 Annexation comprise the entire FIRST DISTRICT community of Sunset Beach between Warner Avenue and Anderson Street. Therefore, it is felt these two annexations should be considered at the same time. ALTERNATE WREPRESE DAMAE MARTIN Police protection for the community of Sunset Beach is presently GENERAL PUBLIC provided by the County Sheriff's Department, upon annexation this responsibility will be assumed by the City of Huntington Beach which presently patrols the incorporated area easterly ALTERNATE of Coast Highway. TURNER EXECUTIVE OFFICER Page 2 In Re : Proposed annexation to the City of Huntington Beach designated Sunset Beach No. 6 Annexation Fire protection is presently provided by a County Volunteer Fire Station in the community. The City 's Capital Program proposes a land and water facility at the intersection of Warner Avenue and Pacific Coast Highway which will provide increased fire protection in the area. Sewer service and refuse collection is presently provided by the Sunset Beach . Sanitary District . The present treatment facilities are inadequate and have caused local problems in the area. Increased sewer service can be offered by annex- ation to Huntington Beach by connection to existing city lines along Pacific Coast Highway. Water service is presently provided by the City of Huntington Beach. Upon annexation the system in the area would be upgraded. The community of Sunset Beach is an area with many develop- mental problems. Several efforts by County Departments and property owners have been made to resolve these problems : On February 8, 1967, a proposal for a formation of the Sunset Beach Water District was denied without prejudice by the Commission. This proposal was filed after the assets of a privately owned water company in the area was transferred to the City of Huntington Beach. The boundaries of the proposed district were drawn the same as the Sunset Beach Sanitary District so that at a future date the two districts could consolidate if the residents of the area so desired. The Commission's denial on this proposal was their dissatisfaction with the Sunset Beach plan for a supplemental water supply from the City of Seal Beach. On July 6, 1967, the Board of Supervisors adopted a general plan of land use for the community of Sunset Beach. This plan was prepared by the County Planning Department with the cooperation of other County Departments and residents of the area. i Page 3 In Re : Proposed annexation to the City of Huntington Beach designated . Sunset Beach No. 6 Annexation In March, 1968, a petition was filed with the Local Agency Formation Commission requesting formation of the Sunset Beach Boulevard District. This proposal was a citizen-led attempt to correct some of the problems related to streets, vehicular circulation and off-street parking. This Commission denied that request on July 10, 1968. The denial action by the Commission was after the Board. of Supervisorb Resolution of July 9, 1968, whereby, the Director of Real Property. Services was instructed to investigate and report on the steps necessary for the proposed acquisition of real property required for the further development of Sunset. Beach as a Regional Public Beach facility. On January 14, 1969, the Sunset Beach Parking Study was presented to the Orange County Harbor Commission. This study contained four study plans for parking in the community. The Commission requested that the report and their comments be forwarded to the County Administrative Officer and the County . Planning Commission for additional study and consideration. The City of Huntington Beach is completing the details of. how a total master plan of Sunset Beach, including an action program of implementation, will be developed. The City of Huntington Beach states a coordinating council of Sunset Beach residents will assist the City in outlining the community's involvement in this process. They further state the master plan will require six to nine months to complete and will be developed on three basic criteria which are as follows : 1. Good planning principles are not violated 2. Total communication with the community and regular opportunity for input are maintained 3. The resulting plan must deal with the total scope of problems as they exist in Sunset Beach This master plan .will. be reviewed in whole or in part and approved by the Planning-Commission and the City Council prior to an annexation election. By following this process the citizens of Sunset Beach will have a clear understanding of the rami- fications of annexation prior to making their decision. Beach designated Sunset Beach No. 6 Annexation These two proposals for annexation (No. 5 and No. 6) are a logical extension of city boundaries and it is felt the annex- ing city can adequately provide increased municipal services needed in this area. The program by the City of Huntington Beach regarding their master plan for the area is felt to be a logical approach in working with the citizens and, therefore, it is recommended Annexation Nos. 5 and 6 be approved and the Commission waive the restriction of Subdivision (2) of Section 35002.3 of the California Government Code, whereby unincorporated land territory is completely surrounded by the annexing city, (this unincorporated island located southerly of Warner Avenue and inland from Pacific Coast Highway) and approve this annex- ation subject to any conditions the Commission deems necessary. Residents are claiming that the State and/or the County owns the bulkhead and, therefore, should maintain same . In a meeting of island resident I attended on March 3, 1969 , it was indicated that a lawyer had agreed with this position and would take the matter to court. The residents have begun collecting donations to hire the lawyer. Presuming an annexation is successful, the City should investigate this legal question before accepting public land from the County. Properties included within this request are zoned to allow C2 "General Business" and R4 "Suburban Residential" District uses. The annexation area together with the properties. included within the proposed Sunset Beach No. 5 Annexation (City of Huntington Beach) , comprises the entire unincorporated community of Sunset Beach. In reference to the proposed Sunset Beach No. 5 Annexation , the Planning Department pointed out that the community of Sunset Beach is an area with many developmental problems, and that a comprehensive planning approach would be required in order to solve these problems. This Department believes that annexation of the whole community by a single municipal jurisdiction is a proper approach toward a solution t1 these problems. Several efforts by County Staff and property owners to resolve these problems have already transpired. Chronologically, these attempts were: 1. July 6, 1967, the Board of Supervisors adopted a General Plan of Land Use for the communities of Sunset Beach and Surfside. This plan was prepared by the Planning Department with the cooperation of other County departments and residents of the area. The basic philosophy of the plan was to follow the goals of the people of the community, while, at the same time, encourage the resolution of some of the key problems of the area. The plan includes such other suggestions as common off-street parking and vista areas , confined shopping areas , and a community facility center. Local Agency Formation Commission Re Sunset Beach No. 6 Annexation February 21, 1969 Page 2 2. March, 1968, a petition was received by the Local Agency Formation Commission requesting the formation of the Sunset Beach Boulevard District. This proposal was a citizen-led attempt to correct some of the problems in the area related to streets , highways , vehicular circulation and off-street parking. Your Honorable Commission denied the request for district formation on July 10, 1968. 3. October 2, 1968, the first public hearing on Zone Change ZC 68-1 of Carlton Builders was held. This zone change applied to the properties within the Pacific Electric Railroad right of way (between Anderson Street and Fourth Street) and called for R3 "Apartment" , R2 "Group Dwelling" and B1 "Buffer" District uses. The plan provided for 150 dwelling units and several public parking areas. After a number of lengthy public hearings, the Orange County Planning Commission recommended denial on the requested change of zone on February 13, 1969. 4. At the present, the County Administrative Office in conjunction with the Harbor District and the Planning Department is studying possible alternatives to the parking situation at Sunset Beach. A recommended course of action has not been decided upon nor have the alternative plans been presented officially to the Board of Supervisors. The proposed annexation, when combined with Sunset Beach No . 5 Annexation, is a logical extension of the city' s boundaries. This proposal will provide the city of Huntington Beach with 'the opportunity for guiding future land development and correcting deficiencies on a community basis rather than dividing the problems along jurisdiction boundaries.
