JONES, being first duly sworn, deposes and says: That he is now and at all times herein mentioned was the duly appointed, qualified and acting City Clerk of the City of Huntington Beach, a municipal corporation, and ex-officio Clerk of the City Council of said City. That pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939" , and amendments thereof and additions thereto,, the City Council did on the 25th day of July, 1960, pass and adopt Resolution No. 1429 giving notice of the proposal to annex certain uninhabited territory to the City of Huntington Beach, said territory being designated as "Sunset Harbour Annexation" and said action being taken pursuant to a written petition therefor. That annexation proceedings were completed by said City (7our_cil on the 7th day of November, 1960 by final adoption of its Ordinance No. 800, said Ordinance becoming effective thirty days thereafter. That by said pro- ceedings said City annexed the territory referred to in that certain certified copy of said Ordinance No . 800 and a map delineating said boundary, which Ordinance and Flap are annexed hereto and by this reference incorporated herein. The boundary description of said annexed area is set forth in Ordinance No. 800. That all requirements of the laws relating to such proceedings have been complied with. Our engineers report that there are approximately 27.7 acres of State sovereign lands in the proposed annexation. These lands must be appraised by the staff of this Division and a report submitted to the State Lands Commission which will fix the value in accordance with Section 35313.1 of the Government Code. Due to the staff work involved this matter cannot be presented to the Commission at its meeting scheduled for next week but will be submitted for the September meeting. This meeting is not yet scheduled but will probably be set for a day during the last week of September. Therefore, the City Council of the City of Huntington Beach is respectfully requested to defer final action on the "Sunset Harbour Annexation" until after the first of October. Jones Clerk of the City Council City Hall Huntington Beach, California Dear Sir: My client, Sunset Land. & Water Company, hereby protests the proposed annexation of certain uninhabited territory as set out in a resolution adopted by the City Council on July 25, 1-960, the territory being referred to as the "Sunset Harbor Annexation" . This protest relates only to the inclusion within the territory to be annexed of a small parcel of land belonging to Sunset Land & Water Company, and request is hereby made that the City Council take appropriate action to exclude that parcel, which is hereinafter more particularly described . Sunset Land & Water Company is a public utility which provides water to the residents of Sunset Beach and Surfside Colony. The portion of its property involved in this problem is shown on the enclosed map. The Sunset Harbor Annexation, as you will note, is outlined in blue on the map, and the property in question of Sunset Land & Water Company is outlined in red, at the southwest corner. As you will see from the map, the property to be annexed excludes part and Mr_.- Paul C . Jones -2- September 7, 1960 includes part of Sunset Land & Water Company property. The part excluded, which :is at the corner of Las Patos Avenue and. Algonquin Street, is the parcel on which the company' s wells, tanks and pumping equipment are located. The included portion, connected by a small strip with the excluded portion, is land from which the company may desire to produce water in the future, and while not presently being used, is, a part of its plant . The company does not desire to have its water property subject to different ,jurisdictions, and it is submitted that its entire plant should be excluded in the same manner as the sewage treatment plant of Sunset Beach Sanitary District was excluded, as indicated on the enclosed map in the southeast corner of the property to be annexed. The three parcels of land comprising the water plant, both within and without the area proposed to be annexed, are described as follows: Parcel 1 Commencing at a point 30 feet North and 20 feet West of the Southeast corner of the Northeast quarter of the Northwest quarter of Section 29, Town- ship 5 South, Range 11 West, S .B.B. & M. ; thence North 200 feet; thence West 200 feet; thence South 200 feet and thence East 200 feet to the place of beginning. Parcel 2 Commencing at a point 612.6 feet North and 9 feet West of the Southeast corner of the Northeast quarter of the Northwest quarter of Section 29, Town- ship 5 South, Range 11 West, S .B.B. & M. ; thence North 200 feet; thence West 200 feet; thence South 200 feet, and thence East 200 feet to the place of beginning. E. Robinson and Minnie A. Robinson to Sunset Beach Company, and recorded in the office of the County Recorder of the County of Orange, California, in Book 108, page 46 of Deeds . Parcel 1 is not within the proposed territory to be annexed. Its description is given because parcel 3, which is the strip connecting the two small squares of property, is described by reference to parcel 1 . It is suggested that an amending ordinance excluding all three parcels from the terri- tory to be annexed would be the easiest way to handle the matter, even though it would be superfluous as to Parcel 1 .
