The study indicates there will be less children in the Sunset Heights quartersection than anticipated in the 1974 report therefore they feel the neighborhood park site could be reduced from 6 acres to between 3. 5 and 5 . 7 acres . You have recommended that only Tract #185 of Sunset Heights be acquired (184 ,973 sq. ft. or 4. 25 acres) and allow the 1. 75 acres , previously earmarked as part of the park in Tract #184 to be excluded and allowed to develop privately because of the money problems related to acquiring the land, a major one that of purchasing two houses reportedly worth over $60 , 000 and relocating the families . A subdivision map has been filed on over half the property and a decision on that will have to be made soon. The Recreation and Parks Commission studied staff reports that they had investigated the possibility of acquiring an additional acre (99 ' x 440) of vacant property north and adjacent to Tract #185 -which would allow further flexibility for acquiring additional park property through dedication from the Janes Company who contemplate building apar.t.mentson the former Eds Daisy site . RECOMMENDATION: The Recreation and Parks Commission unanimously recommended the City Council authorize a change in the proposed boundary of the Sunset Heights neighborhood park by eliminating all of Tract #184 (1 . 75 acres) from the plan, substituting the Evelyn Miller property (1 acre) on the north side of Tract #185 and the potential of adding up to 3/4 acre to the park through dedication from the Janes Company. The analysis has _been conducted in 'three separate ways : (1) Applying the City' s neighborhood park standards (Figure 1-1, attached) to the Sunset IIeights quarter section alone, resulting in a projected park need of 5. 611 gross acres . (2) Applying the City standards to a multi-neighborhood study area (the Sunset Heights quarter section and three surrounding quarter sections, Figure 1-3 attached) , resulting in a pro- . jected park need for the Sunset IIeights quarter section of 3. 68 gross acres. (3) Applying modified neighborhood Dark standards to the Sunset IIeights quarter section, based on the presence of fewer children in Sunset IIeights within the target age group (13%) as compared to the citywide average (21%) , resulting in a projected park need of 3 .5 gross acres. Consequently, park demand in the Sunset heights quarter section ranges from 3.5 acres to 5. 6 acres , depending on the park standards used and the boundaries of the area under study. EDS:EJ: ja Attachment �y SUNSET HEIGHTS PARKS ANALYSIS Fes. Provision of adequate park facilities in Sunset Heights and vicinity has long been a concern because of the population generating capacity of the area. Prior to March, 1975 , no neighborhood parks were planned within the Sunset Heights quarter section. In March, 1975, however, an amendment to the Phase I Land Use Element was adopted which designated a 6-acre park site for the small lot area at the intersection of Pearce and Lynn Streets . Park size was based on a parks analysis for Sunset Heights and vicinity conducted by Planning Department Staff employing population projections to estimate park need (as included in the Sunset Heights Study , June , 1974) . Population projections were based on land use d sie gnation averages rather than actual demographic data . With over two years having passed since the original parks analysis was performed, the need for a more recent analysis is recognized, this time using actual demographic data as a base to reflect actual ,park need. The adequacy of a 6-acre park site can then be determined. The City currently uses the neighborhood park standards reco.(uaended by the American Public Health Association Committee on the Hygiene of Housing (Figure 1-1) . Treating the Sunset Heights quarter section in isolation, a park need of 5 . 61 gr. acs . at ultimate development is anticipated. With this in mind, a 6-acre park site is justified in this location to satisfy ultimate park demand . l,;ven though park need vs . demand is customarily evaluated on a quarter section by quarter section basis , it seem; appropriate to expand the study area to include three surrounding quarter sections and perform a multi-neighborhood analysis (Figure 1-3) . The reasoning for this is simple . Each of the three surrounding quarter sections will contain an elementary school with adjoining park, 2. 5-3. 5 acres in size. Because no school site is planned for the Sunset Heights quarter section, children will have to travel to one of these quarter sections for school and most likely will visit the park nearby . Based on the multi-neighborhood analysis , a park site totaling 3. 7 gr. acs. would be adequate for the Sunset Heights quarter section . (A half acre beach in Huntington Harbour , not quantified by this analysis , also helps to satisfy park demand in the area. ) This reduction in necessary park size is due to an excess in park land of 1 . 78 acres in the three quarter sections surrounding Sunset Heights . A park site of 3 . 7 acres, however, would provide only 290 of the total ;dark land in Sunset Heights and vicinity . (Projected population .in Sunset heights accounts for 380 of the estimated total population for the four quarter sections. ) In contrast, a park site of 5. 6 acres (as required by the Sunset Heights quarter section alone) would provide 38% of the park land in the area, approximating Sunset heights ' share of the area ' s population. One additional factor to consider is the share of the population of Sunset Heights and vicinity that is between five and fourteen years old, the age group for which neighborhood park facilities are primarily planned. Current neighborhood park standards do not consider variations in population composition. On a Citywide basis , the five to fourteen age group constitutes approximately 21 percent of the total population . In the Sunset Heights quarter section, however, only 13% of the popula- tion is in this age category. By making adjustments in the neighborhood parks standards to reflect the presence of fewer children in Sunset Heights within the target age group, the neighborhood park demand is somewhat _less or 3. 5 gr. acs . Belsito , City Council Members City Administrator Subject SUNSET HEIGHTS PARK/ Date December 1, 1976 GALLO PROPERTY Attached is a communication from Norm Worthy, Director of Recreation, Parks and Human Services , in which he recommends the City Council apply eminent domain proceedings on the 9 small lots on the NE corner of Lynn and Pearce Streets in Sunset Heights owned by Mr . and Mrs . Francis Gallo. This property is within the 6 acres of lots which were originally desig- nated for neighborhood park purposes on March 22 , 1976 , by the City Council . Also attached is a recommendation from the Recreation and Parks Commission that City Council authorize a change in the approved boundary of the Sun- set Heights Park site due to the Planning Department Study update which relates to the projected park needs in Sunset Hieghts . Soon after the moratorium was lifted on Tract #185 in Sunset Heights, Mr. Gallo was issued a building permit on his buildable parcel and proceed- ed with plans and ultimately construction of a single family house and two rental units . In the meantime, the paperwork was being processed for acquisition of all the lots within the 6 acre designation. Mr. Gallo ar- ranged financing and proceeded with construction about the same time he was given a notice of "Intention to File Eminent Domain. " Even though he was temporarily stopped by failure to observe the boundary of an easement he has since corrected his plan and continued construction. In my opin- ion, it would be costly for the City to acquire his property including the current on-going improvements . Since the Planning Department has recom- mended we reduce the size of the park site to between 3 . 5 to 5 . 7 acres , I would suggest we eliminate 1- 3/4 acres of title problem lots in Tract #184, Mr. Gallo ' s 1/4 acre and acquire Mrs. Evelyn Miller ' s 1 acre of vacant property north and adjacent to Tract #185 . This would make the total park site 5 acres . RECOMMENDATION That the City Council adjust the boundary of the Sunset Heights neighborhood park site by excluding the previously approved 1 . 75 acres of small lots in Tract #184, 9 lots (#130-136, #155 and 156) in Tract #185 and acquiring, by eminent domain if necessary, the remaining 9 property parcels (32 lots or . 92 acres) and the Evelyn Miller parcels (1 acre) north and adjacent to Tract #185 . Gersh ' s pro- perty (cross hatched area) previously acquired. The lots requested for purchase constitute 19 , 929 sq . ft . or . 458 acres . The agreed upon price is $25 , 506 or $55 , 690 per acre for R- 2 land plus escrow and closing costs . RECOMMENDATION: That the City Council of Huntington Beach approve the purchase of 16 lots .from 11 owners within the area designated as a neighborhood park in Sunset Heights , Huntington Beach , for the sum of $25 , 506 (19 , 929 sq . ft . ) . Mr. Gallo had previously been issued a permit to build on his property by our Department of Building and Community Develop- ment as he .owned a buildable parcel and the. moratorium on construction had been lifted in that area of Sunset Heights . Even though he had received notice of the City ' s intent to acquire his property he continued with his building plans with- out communication with me . The total purchase involves 114, 060 square feet, or 2 . 6 acres. Acquisition of this property will be a significant step toward providing a much needed parksite in this area. The purchase price, slightly more than one dollar per square foot, is consistent with the estimated value of property in the area.
