Hopkins, PE, Director of Public Works SUBJECT: Accept the Public Improvements and Guarantee &Warranty Bond for the Wardlow Park Little League Parking Lot, dedicated as Lots "F" and "G" of the Truewind Subdivision, Tract 17239 located at 9191 Pioneer Drive Statement of Issue: TRI Pointe Homes, a Limited Liability Company, the subdivider of the Truewind Subdivision Tract No. 17239 (9191 Pioneer Drive — Attachment 1), has completed all of the required public subdivision improvements on Lots "F" and "G" as dedicated for public parking lot and drainage purposes on Final Tract Map 17239. Financial Impact: Not Applicable Recommended Action: A) Accept the improvements constructed and dedicated for public parking lot and drainage with Tract 17239 (Attachment 2); B) Accept Guarantee and Warranty Bond No. P1303010401995, the security furnished for guarantee and warranty of improvements, and instruct the City Clerk to file the bond with the City Treasurer (Attachment 4); and C) Instruct the City Clerk to record the "Notice of Acceptance of Public Improvements" (Attachment 3) with the Orange County Recorder. Alternative Action(s): Deny the recommended action. This action may violate the Subdivision Map Act which requires a public agency to accept the public improvements conditioned on the Final Map, once satisfactorily completed. Analysis: On October 9, 2012, the Planning Commission approved Tentative Tract Map 17239, Conditional Use Permit 08-25, General Plan Amendment 08-04 and Zoning Map Amendment 08-04, to allow subdivision of the subject 8.35-acres site into a 49 numbered and 7 lettered lots for development of detached residential dwellings as a Planned Unit Development. On April 21, 2014, the City Council approved Final Tract Map No. 17239. In addition to the abovementioned 49 single-family residential lots, the developer satisfied the park and recreation dedication requirement by dedicating approximately 0.82 acres of the land to the Item 3. - 1 HB -36- Dept. ID PW 15-019 Page 2 of 2 Meeting Date:6/1/2015 City in fee as a public parking lot (Lots "F" and "G" — see attachment 3). The 0.82 acre parkland consists of a new 80-space parking lot and associated drainage and landscape improvements, and is incorporated into the adjacent (existing) Wardlow Park to provide parking for those utilizing the park and associated baseball fields. The subdivider, TRI Pointe Homes, LLC, has completed the construction of all required public improvements for the parking lot, and is now requesting the City's formal acceptance of these improvements, pursuant to California Government Code Section 66499.7(a). These public improvements consist of curb, gutter, asphalt paving, sidewalk, storm drain pipeline line, water quality features, landscape and irrigation, and domestic water and sewer services for the new snack shack. The City Engineer has determined that the improvements have been constructed in substantial compliance with the approved plans and specifications, and recommends City's acceptance of the improvements. TRI Pointe Homes, LLC, the subdivider of Tract No. 17239 has provided a Guarantee and Warranty Bond as security for the one-year warranty period (Attachment 4).
