Mayor Winchell called the regular meetings of the City Council and the Redevelopment Agency of the City of Huntington Beach to order at 7 p.m. PRESENT: Robitaille, Bauer, Moulton-Patterson, Winchell , Leipzig, Silva ABSENT: Sullivan (City Council) PUBLIC HEARING - APPEAL OF CONDITIONS OF APPROVAL IMPOSED BY THE PLANNING COMMISSION - PLANNED SIGN PROGRAM NO. 93-1 - SPECIAL SIGN PERMIT NO. 93-24 FOR OCEAN VIEW PROMENADE - NW CORNER PCH/MAIN - APPROVED AS AMENDED (420.35) The Mayor announced that this was the day and hour set for a public hearing to consider the following: SUBJECT: Planned Sign Program No. 93-1/Special Sign Permit No. 93-24 APPLICANT/APPELLANT: Kevin McConnell LOCATION: 101 Main Street (northwest corner of Pacific Coast Highway & Main Street) ZONE: Downtown Specific Plan, District 3 (Visitor-Serving Commercial) REQUEST: Appeal of condition of approval requiring maximum 19 inch high letters in lieu of requested 24 inch high letters for Jack's Surfboards: This condition was imposed by. the Planning Commission in their approval of a Planned Sign Program and Special Sign Permit for Ocean View Promenade. ENVIRONMENTAL STATUS: Categorically exempt pursuant to Section 15303, Class 3 of the California Environmental Quality Act. COASTAL STATUS: The project site is located in the Coastal Zone, however, the proposal is exempt from the Coastal Development Permit Processing pursuant to the Huntington Beach Ordinance Code. A motion was made by Silva , seconded by Robitaille, to overrule the Planning Commission decision, grant the appeal and approve Planned Sign Program No. 93-1 and Special Sign Permit No. 93-24 the following with findings and as amended: s ' . Page 2 - Statement of Action - 9/7/93 1 . The proposed signs reflect a common design element in terms of color, materials, letter style and type. 2. The proposed signs are compatible with the architecture of the building. 3. The proposed signs are consistent with surrounding developments in terms of design, materials and colors. Findings for Approval - Special Sign Permit No. 93-24 1 . The- proposed signs up to 24 inches in height and 83 square feet in area will not adversely affect other signs in the area because they are similar in size, design and location, and are properly scaled to the building. 2. The proposed wall signs will not obstruct pedestrian or vehicular traffic vision. Conditions of Approval - Planned Sign Program No. 93-1 - Special Sign Permit No. 93-24 1 . The site plan, floor plans, and elevations received and dated July 1 , 1993 shall be the conceptually approved layout with the following modification: a. Revise elevations to reflect maximum 19 inch letters for all tenant signs, excluding Jack's Surfboards on Main Street which may be no larger than 24 inches. 2. The written sign criteria dated July 1 , 1993, shall be the approved sign program, with the following modification: a. Section 3.e. shall be modified to read as follows: "No tenant signage shall be permitted above the first floor or on the rear of the building, except one (1) , six (6) square foot tenant directory located next to the elevation. The "Oceanview Promenade" sign shall be permitted on the clock tower as noted on the plans dated July 1 , 1993." b. The following items shall be added: 4.a.(7) Returns shall match building color. 4.a.(8) Trim caps shall be compatible with sign and building color. c. Section 4.b.(3) shall be modified to read as follows: "Maximum upper case letter height shall be 24 inches for 'Oceanview Promenade'". d. Delete reference to Jack's Surfboard's in Section 4.b.(4). The Planning Commission reserves the right to rescind this special sign permit approval in the event of any violation of the terms of the applicable zoning laws. Any such decision shall be preceded by notice to the applicant and a public hearing and shall be based on specific findings. 5. At the time of conversion of multi-tenant suites into single tenant uses, any new signage shall be limited to 19 inches in height. As used in this subdivision, "party" means an officer or em- ployee who has been suspended, demoted or dismissed; a person whose permit or license has been revoked or whose application for a permit or license has been denied; or a person whose application for a retirement benefit or allowance has been denied. (g) This section shall be applicable in a local agency only if the governing board thereof adopts an ordinance or resolution making this section applicable. If such ordinance or resolution is adopted, the provisions of this section shall prevail over any conflicting provision in any otherwise applicable law relating to the subject matter. ANALYSIS Background Planned Sign Program No. 93-1 is a request for a planned sign program for Oceanview Promenade, a new mixed use commercial building at the corner of Pacific Coast Highway and Main Street. Special Sign Permit No. 93-24 is a request to allow signs for the center identification("Oceanview Promenade") and the 2 major tenants, Jack's Surfboards and Burger King, to exceed the maximum 18 inch letter height specified in the Downtown Design Guidelines. The special sign permit would also allow 83 square feet of signage on Main Street for Jack's Surfboards in lieu of 77 square feet. The remainder of the proposed tenant signs would follw the maximum limits specified by the Downtown Design Guidelines. A copy of the applicant's proposed standards is included in the attached Planning Commission staff report(Attachment No. 4). Issues The Planning Commission felt that all tenants within the center should be required to have the same letter height, and that no tenant should be given a special advantage. They did not feel that Jack's larger area within the building (4 suites) or location at the corner warranted a larger sign size. Nor did they find that provision of a comprehensive sign program for the building was adequate trade-off to allow a special privilege to one tenant. Staff supports the applicant's proposed planned sign program and the requested special sign permits. Staff feels that the 24 inch high letters for Jack's Surfboards, while at the first story level, are proportional with the building facade, compatible with other signs across Main Street at Pierside Pavilion, and appropreate for identifying the major building tenant at a prominent intersection. Although the proposed sign height is taller than 18 inches, the overall width of the signs for Jack's Surfboards across the leasehold width will be approximately 34% of the frontage, as opposed to the maximum of 75% permitted by code. Jack's will also occupy approximately 8,000 square feet of the 14,500 square feet of available retail space, making it the major tenant in the building. Staff feels that it is appropriate for an anchor tenant to have more prominant signage than other leasees. The appellant also notes that Jack's has been located at the corner of PCH and Main Street in Huntington Beach since 1961, and requests special consideration for this local landmark. Signs shall not be permitted on'•-the exterior of the building, except within Tenant designated storefront or building signage area unless specifically approved by the Project Architect and Owner and as permitted by the appropriate local authorities. b. Tenant will be permitted to install one (1) (or more, depending upon Tenant lease) illuminated sign on the building exterior. If there are to be Blade signs, they are to conform to "Downtown Design Guidelines" . 4 . DESIGN REQUIREMENTS a . Occupant Signs on Building Exterior: ( 1) All Tenant entrance/store identification designs shall be subject to the approval of the Owner and or the Project Architect. Designs will be uniform and complimentary to the building standard. ( 2 ) Wording of signs shall not include the product sold except as part of Tenant' s trade name or insignia. ( 3 ) Tenant signs shall be designed in manner that is of a high graphic quality. In addition, Tenant signs should be compatible with and complementary to adjacent and facing storefronts. ( 4 ) the design of all Tenant identification signs inc- luding style and placement cif lettering, size, color, materials and method of illumination shall be subject to the Owner' s and/or Project Arch- tect' s approval. ( 5 ) All signs shall be designed as an integral part of the building sign band area with letter size and location appropriately scaled and proportioned to the overall storefront or building design. ( 6 ) No simulated materials ( i .e. , wood grained plastic laminates, etc. ) or wall covering may be used in the sign area. b. Design Parameters : ( 1 ) Individual letters shall be used. No can assem- blies will be allowed. (Exception, Burger King Logo and Jacks Logo) The maximum square footage of signage allowed is 1 S.F. per lineal foot of tenant frontage. • ( 2 ) Letters shall be 5" deep aluminum channel letters. (6) Color of neon can vary. ( 7 ) Tenant logos can be incorporated into the maximum area of allowable sign. ( 9) Wall signs shall be centered on Leasehold frontage and limited in overall length to 75% of the tenant' s business frontage. (10 ) All signs shall be located'."in substantial compliance with plans submitted by Owner at time of application for approval of the Planned Sign Program herein, and which may be amended from time to time by Owner. (11) Colors of various Tenant signs shall be limited to five colors or less. C. City Approval: (1) Variations to City signage standard will require ' a special sign permit. U. All exterior signs, bolts, fastenings and clips shall be of enameling iron with porcelain enamel finish, stainless steel, aluminum, brass or bronze. No black iron materials of any type will be permitted. b. All aluminum letters shall be fabricated using full- welded construction. C. location of all openings for conduit and sleeves in sign panels of exterior storefront shall be indicated by the sign contractor on drawings submitted to the Owner and/or the Project Architect. d. All penetrations of the exterior storefronts or Build- ings required for sign installation shall be neatly sealed in a water tight manner. e. No labels will be permitted on the exposed surface of signs except those required by local ordinance which shall be applied in an inconspicuous location. f. Sign Contractor shall repair .any damage to any work caused by his work. g. Tenant shall be fully responsible for the operations of Tenant' s sign contractors. h. All signs shall conform to Uniform Building Code standards. i .
