Pearce Drive Is already overtaxed with traffic since it is not s thru street. There are approximately 85 dwellings served by this street only, with the ma.lorlti of these horses i having 3-car garages, and many having 3 or 4 vehicles. The addition of approximately 44 units with an average of 2 cars per unit, not including guest parking, Alone is unthlokable. 2. Traffic noise generated by this many units opening directly onto Pearce Drive would b;. unacceptable in any P-1 area, let Alone to one that Is already subj& :t to a noise level above average dut to Ktadowlark Airport on one side, and Holsa Chic& on the other. 3. 4t&dllght glare will be directly in line with homts on Ptarc♦ Drive front the single 44-foot width driveway propose.!. 4. This also creates a direct traffic hazzard due to the short distance from Salsa Chica Strect to a single entrance/exit for so many cars. 5. This is an unbelievable change and Completely unacceptable to any 4amlly-uriented living to which R-1 properties should be entitled. d. There will be additional j exhaust fumes and also exposure to many more potential accidents since the children must use Pearce Drive twice daily as the only route to and from school . This Is not true. The Huntington Riviera Condos, which are directly across Balsa Chica from this proposed development, f have access off Balsa Chica, as does an apartment complex bitwern Pearce and Hell . Also, the crrnmcrcial proparty mentioniJ, even though It is zoned commercial , currently his 3 individual residences opening directly onto Balsa Chica between Wara2r and Pearce. The Huntingtor Beach Develcpment Services Staff Report of September 5, 1984 states in section 4.0 under "North of Subject Property" that the North side of Fcarc. Street is zoned R2 Medium Density Residential. The area is actually zoned Rl as indicated on the map following page 3 of that report. Furtner, the staff report indicate3 in the second paragraph of Item F, "The existing two family homes which front onto the north side of Pearce Street....". There are no two family homes on the north side of Pearce, but rather a series of single family homes appraised in excess of $225,000 each. 2. The same staff report indicates that the proposed location of A Street is not in line with any driveways or garages. While this is correct, the proposed alignment will place the hi.ad1 ;1hts of the more than 50 auto- mobiles exiting A Street directly ;#,Lo the living and family room windows of two homes on Pearce Street. 3. Pearce Street is already congested as a mid block Bolsa Chica single entry and exit to Pearce Street, Roosevelt Street, Gelding Circle, Stallion Circle, Graz Circle and Parla% Circle. This single entry/exit point services the approximately 85 homes on these Streets. 4. The children of the families on the above mentioned street; transit Pearce Street twice daily to the bus stop on the Northeast corner of Pearce Street and Bolsa Chica. The addition of more than 50 vehicles exiting onto Pearce Street only 115 feet from this corner and then queuing at the corner for entry onto Bolsa Chica is frightening to the parents .%f these children. 5. The proposed 40 foot access and street side parking indicated in the Tract description will almost certainly cause overflow parking on Peirce Street and disrupt the rights of the Pearce Street residents to enjoy the peace and use of their property. For these reasons, I request the City Council overturn Tentative Tract 12206, Conditional Exception No. 84-05 or amend approval j to provide entry and exit to the Tract from Bolsa Chica. }I t i D. D. Conditional Exception No. 84-05 allows two flag lots with a frontage width of 20+ fee•z rather than the required 45 feet. The project would permit 43 apartment units. On September 18, 19840 the Planning Commission appt.,ved Tentative Tract No. 12206 / Conditional Exception No. , 94-OS with conditions. The planning Commissiot's approval was then appealed by residents in tie neighborhood adjacent to the project who opposed vehicle Access to ff the project off of Pearce Drive. The City Council continued consideration of the appeal to November S, 1984 , and then to November ` 199 1984 in order to allow the applicant additional time to prepare an alternative tract reap showing access off of Holsa Chica Street. The ' applicant has prepared an alternative conceptual design which is attached for the Council 's consideration. RECOMMENDATION: The Department of Development Services and Public Works staff recommend that the City Coutt,.�il uphold the Planning Commission's approval of the original Tentative Tract No. 12206 and Conditional Exception No 84-OS with the find-; bg and conditions attached in the Notice of Action. ANALYSIS: Applicant : I:en Moody Locatior : South/ east corner of Bole. Chica Street and Pearce Street. Request: To create u,-, Pearce Street lot residential subdivision. .r no ant I ' DISCUSSION: The proposed 11-lot subdivision contains ten 8,000 square foot lots and one 6,000 square foot lot. Each 8,000 square foot lot would 1 accommodate four apartment units and the 6, 000 square foot lot would accommodate a triplex. A total of 43 units could be built in the subdivision. Approval of use permits will be required for the five lots which abut Bolsa Chica Street which is a major arterial. Acce_s to the subdivision is taken via a cul-de-sac extending south from Pearce Street. The cul-de-sac is necessary because access will not be permitted from Bolsa Chica Street. The existing two family homes which front onto the north side of Pearce Street have driveways and garages which front onto Pearce. However, the proposed cul-de-sac is not positioned directly in front of any of the driveways. The cul-de-sac is a public street with a standard curb-to-curb width cf 40 feet. Unlike a normal public street, however, there is no proposed public right-of-wa7 for sidewalks and parkway. Rather, a alx-foot driveway, public utility anu sidewalk easement for both sides of the street is proposed. The private easement permits the applicant to obtain 8,000 square foot lots by counting lot area to the back of the curb rather than the back of the sidei,alk. The 40 foot curb-to-curb width will permit on-street parking. Building setbacks will be measured from the back of the sidewalk. Reciprocal driveway easements will service each pair of lots. Nine of the eleven lots are legal lots. Lots 5 and 7 , however, are flag lots which do not meet the minimum 45 foot lot frontage requirements as contained in the ordinance code. Conditional Excepticn No. 84-OS was filed by the applicant to permit the flag lots. The applicant has submitted an alternative conceptual layout showing access to the project off of Bolsa Chica Street. Due to the high s traffic volumns projected for Bolsa Chica Street and the existing number of curbs and access presently along this arterial, the Planning Commission, Development Service! and Public Works staff cars not support this alternative. I ! 1 In order for the staff to adequately analyze alternative layouts, the applicant would need to submit proper tentative map engineering drawings, not just conceptual drawings. FECOMMENDATION: The Planning staff recommends that the City Council uphold the P.C. ' s approval of Tentative Tract No. 12206/Conditional. Exception No. 84-05 with the findings and conditions contained in the Planning Commiosion staff report dated September 18, 1964. ANALYSIS: The project anal}sis is contained in the Planning Commission Staff Report dated September le, 1964 and September 5, 1984 . The appellant submitted two letters (Attachments 1 and 2) which identify concerns with the project. Staff' s responses to the concerns in each letter are as follow: ATTACHM£!i' 1 s 1 . Pearce Street is a local street with a maximum capacity of 7500 averag-- daily trips. The proposes: project, when combined with existing traffic, will result in approximately 2,000 average daily trips . This volume Wee; not exceed the street capacity. Ye'hen Meadowlark Urport is (3eveloped, Pearce Street will likely be extended and will cart) amounts of traffic !:.uch closer to maximum capacity. 2. Traffic noise generated by the project will fall within acceptable levels for resice:ntial property. 3. It is very likely true that some homes on the north aide of Pearce Street will be ssubiact to headlight glare from traffic exiting "A" street. This is an unavoidable impact if Pearce Street in to be used and is a common impact in many residurstial subdivisions. 4. The Department of Public Works has, indicated that the 160 foot distance from Uoisa Chico Street to "A" Street will not ' constitute a traffic hazard. � 5, The property up,-)n r.hich the project is proposed has been zoned R2 (Me:diur. Density Residential ) since 1971 . Any construction in accordance with current zoning in the area will have the effect of rendering the streets undesirable for play. 7. There in no reason for the proposed project to eliminate on-street parking for any residences on the north aide of Pearce Street. 8. The Department of Public Works is purrai ng the policy of, prohibiting direct access of new residential projects onto major arterials . The nature of F evious development entitlements should not serve to eliminate present development policies. ATTACHMENT 2: 1. The staff report description of property "North of Subject Property" was in error. The attached zoning map, however, clearly indicated the R1 zoning north of Pearce Street. 2. As indicated in response 3 to Attachment 1, headlight glare from traffic exiting "A" street is a likely impact upon homes directly across Pearce Street. 3. As indicated in response 1 to Attachment 1, Pearce Street is presently operating below capacity. i 4 . As indicated in response 6 to Attachment 1, the proposed project will create additional hazards to children playing in the street. 5. The proposed project is designed to accommodate on-street parking on "A" Street. All apartment projects constructed within the tract will be required to provide off--street puking as required by the zoning coc:e. ALTERNATIVE ACTIONS: The City Council may overturn the Planning Commission' s approval of Tentative Tract 12206/Conditional Lxception 84-05 and deny the project with the following findings: Tentative T_k�ct No. 12206: 1 . The existing two family homes which front onto the north side of Pearce Street have driveways and garages which front .,nto Pea,.ce. however, the proposed cul-de-sac is not positioned directly in front of any of the driveways. The cul-de-sac is a public street with a standard curb-to-curb width of 40 feet. Unlii;e a r -rmal Public street, however, there is 110 proposed public Light-or-way for sidewalks and parkway. She also mentioned that a previous application was before the Planning Commission in which the property owner, Mr. Herio, requested commercial for the Meadowlark Fairport area and that, if this should Occur , Pearce Street could possibly be widened. She emphasized that she felt the general public would not favor a "strip" center where the clothes stores may cyo out of business, in a week, but felt that if a mini shopping center which included a major department mini store dent in, that the residents in that area may not be as objectionable. 14r .
