HomeMy WebLinkAboutCity Council Study Session - Suggested Changes to Resolution 4/3/2017 CITY COUNCIL STUDY SESSION Suggested Changes to Resolution No. 2013-24 (Downtown Alcohol and Live Entertainment) Conditions of Approval April 3, 2017 BACKGROUND ❖ CC Ad Hoc Downtown Image Committee Resolution 2010-05 ❖Standard list of conditions for eating and drinking establishments with alcohol or live entertainment ❖Hours of operation limited ❖New CUP requests in DTSP Dist -� COMMUNICATION McWft Date. q - 3 5s" 1 bmft• 4/3/2017 LOCATION o Downtown Specific Plan r ;/ District 1 AV E ' MW E / oy/ y BACKGROUND **.* CC Requested Clarification of Conditions ❖ Resolution 2011-16 ❖Specified new hours limitations only applied to alcohol sales, not food sales after hours ❖New CUP requests 2 4/3/2017 BACKGROUND ❖ CC Directed Further Modifications of Conditions ❖ Resolution 2013-24 ❖Reverts back to hours of operation limitations ❖New requests and expansion/modification requests ❖Only CC may approve amendments to conditions ------------ BACKGROUND ❖ Existing DTSP Dist. 1 ❖CUP to ZA ❖Mon-Thurs: up to 11:00 pm ❖Fri-Sun: up to 12:00 AM ❖CUP to PC ❖Mon-Thurs: past 11:00 pm ❖Fri-Sun: past 12:00 AM 3 4/3/2017 RESOLUTION 2013-24 Overview ❖ Conditions to minimize nightclub atmosphere include: ❖Hours 7:00 AM to 12:00 AM daily (w/ location exceptions) ❖Full menu ❖Illumination, monitoring, training, management of service, video surveillance ❖Discourage games, contests, alcohol purchases, signage, etc. RESOLUTION 2013-24 Overview ❖ Conditions apply to: ❖ New CUP requests ❖ Requests to modify existing CUPs ❖ Process: ❖ PC reviews CUP request and recommends to CC if applicant proposes amendments to standard conditions ❖ CC acts on proposed amendments ❖ Existing establishments with CUP are not effected by any new regulations 4 4/3/2017 COUNCIL DIRECTION ❖ March 6, 2014 - Council directed review of Resolution 2013-24 with general discussion to explore: ■ Flexibility for later hours ■ Strengthen tools for enforcing conditions NEWPORT BEACH OPERATOR'S LICENS == ❖ Applies to: ■ Bar, lounge, nightclub (no minors), with ■ alcohol sales and consumption, combined with ■ late night hours (after 11:00 PM), or ■ entertainment (act, play, show, music), or ■ cafe dance (no admission fee) -= ❖ PD Chief authorized to approve ❖ Similar to HB Entertainment Permit 5 4/3/2017 REVOCATION OF CUP Revocation - Upon non-compliance with conditions of approval: ■ Request PC to schedule potential CUP revocation hearing =_ ■ Report from Code Enforcement and Police ■ Public hearing for input ■ Revoke CUP and add new conditions LIVE ENTERTAINMENT PERMITS ❖ Additional layer of enforcement :• Approx half of alcohol CUPs downtown also have live entertainment ❖ Runs with operator - Annual review by Police Chief ❖ May add or amend conditions of EP 6 4/3/2017 STAFF'S RECOMMENDATIONS ❖ Amend Resolution No. 2013-24: ❖Allow reviewing body (ZA/PC) to amend conditions (including closing hours) with a public hearing ❖Create criteria for modifying conditions: ❖ Goal = vibrant, safe downtown commercial area ❖ Location and characteristics of business, existing operational practices, surrounding uses, proximity to residential, available on-site parking, security established alcohol and noise control STAFF'S RECOMMENDATIONS ❖ Strengthen Live Entertainment Permit tools ❖ Utilize CUP Revocation process when frequent violations occur spis 4/3/2017 UPCOMING PROJECTS ❖ April 17, 2017 CC Meeting ❖ 1 new business replacing previous business ❖Requests hours change ❖ 1 existing business with remodel/expansion request ❖Requests hours change 8
