FINDINGS FOR DENIAL
1. The revised single-family residence addition does not conform
with the plans, policies, requirements and standares of the
Coastal Element of the General Plan. The residence is within
an existing subdivision with single—family residence.

2.• The three-story residence is inconsistent with other
development in the area. The majority of, existing residences
are- two stories and the addition of a three story dwelling
will change the character of the nei.ghborhoou.
3. The elimination of view opportunities for existing residences
is not consistent with coastal element requirements.

use, that; provic]as the _greatest degree of light, air
ventilation -and open space on each lot and this proposal will
preclude that.

On November .l9, 1985, the Planning Commission 'reviTewed the revised
plans and upheld :the Board of . 2oning Adjustment's denial of Coastal
Development Permit No. .85-28 with the added findings that: 1) the

Coastal Development Permit No. 85-28 is a request to allow 'a 2408
sq.:.: ft. addition to an existing residence. Because the proposed
project is creating a third floor, a coastal development permit; is
required (989.5. 3.b3)
On; October 16,.,.1985, the Brard .of Zoning Adjustments denied Coastal
Development Permit No. 85-28 and Use Permit No. 85-65, a request to
construct. 3,000 sq. fr. of building,-area to an existing
single-family residence with non-conforming setback for .fi:ont entry
garage..,(20 feet in lieu of 22' ) . Subsequently, the.•applicant
appealsd the denial and revised the site- plan by ieducing the
addition from 3,000 to 2,406 and adjusting the addition setback so
as to comply with the code thereby eliminating the need for a use
permit.

Coastal Development Permit No. 85-65 is a request to, construct 2,408
sq. ft. of building area to an existing single-=family, residence
within the coastal zone. The additional building area consists of
538 sq. ft. on the first floor, 503 sq. ft. on the 2nd floor, and a
new 1,367 sq. ft 3r.d floor; total square footage of the residence
will be 4,924.

Applicant: Ron Montgomery
A request to add 3,000 Square Feet of building area to an existing
single family residence with nonconforming setback for front entry
garage - twenty feet (20 ') instead of twenty-two feet (221) - in an
Rl-CZ Zone. Subjent property is located at 16386 Ards'_ey Circle
(East side of Ardsley ^Ircle approximately 250 feet South of:
Humboldt Drive) .
These requests are covered by Categorical Exemption, Class 1 (e) ,
California Environmental Quality Act, 1984.
Scott Hess said the request for the Coastal Development Permit was
necessary because the applicant wants to build a 3,000. aquare Foot
addition which includes a third floor to a single family residence
within the Coastal Zone. The Coastal, Development Permit is to
i determine compliance with the provisions of the Coastal Element and
Zoning Code. The Use Permit is to permit un'.,'addition to the garage
which. maintains the same setback as the. garage (twenty feet) in lieu
of a twenty-two foot (22' ) setback . The project entails adding a
portion to the garage) a second story addition over this portion,
acid a third story, with an outside stairway to both the Second and
Third Floors. Staff conducted a survey of three (3) story homes in
the area and found two in the general vicinity and several slang
Carousel Lane (abutting . the main channel) .. The majocity . of homes
are two (2) story. To date, no written or verbal response to the
request has been received. Staff has reviewed the request and is
recommending approval of this project subject to specific findings
and conditions, including a "signed letter" from the property owners
indicating the residence would remain a single family unit.
Daryl Smith opened the Public Hearing and the applicant' s
representative,- Gilbert E. Fraide, was present. Mr. Fraide stated
he was representing the Architect, Ron Montgomery, on behalf of the
property owners, William and Norma Marshall and he presented a small
rendering of the proposed residence to the•Board. hr. Fraide
i explained that the plans had been changed Lack to the original
setback line of twenty feet (20' ) . Scott Hess reminded Mr. Fraide
the addition would have to be back to the twenty-two foot (22 ' ) lire
to conform with the Code and Mr. Fraide explained the original plan.i
had shown fifteen feet and six inches (15 '-6") .
Mrs. W. Dalessi, 16365 Ardsley Circle, stated she objected to a
three-story residence being located across the street from her home
and further stated that every home on the street is either a single
or two-story unit . She felt the structure looked more like an
ll apartment building or hotel than a residence.

The ner.t door neighbor to the NorLh, Mike Thomas , 16382 Ardsley
Circle, said he was concerned that the proposed building would not
conform with the rest of. the area, that the three-story imposing
structure would block sunlight from his home, would affect privacy j
of both homes, and that the Marshalls would further object tc noisi>
and activities of his children.
Kgthlyn Richards , 16375 Ardsley Circle, reiterated the objections
expressed by M.rs. Dalessi and felt the imposing structure would be
an aggravation to the entire neighborhood .
There was no one else present to speak for or against the project so
the Public Hearing was closed.
A discussion followed between Daryl Smith and Scott Hess to clarify
the need for, the_ Use Permit;.,. i. e. , that the Use Permit. would still
be required for the First and Second Floor additions because of the
nonconforming: setback even if a third story was not built. A
further discussion. ensued relative to the Board ' s possible action on

Development Periait. Mr. Hess explained no precedent had
been set by the City for denial of such a permit based solely on a
Third Floor addition, and that the applicant/property owner and/or
otber residents could appeal the Bnard' s decision on this Coastal ;--
Development Permit and Use P^rmit to the Planning Commission.
After a statement by Mr. Thomas that there would be a big difference
f b'etween a three-story building .on a wide channel instead of on a
small street , Mr. Fraide said his clients would be willing to
"re-think" the configuration of the resident . The owners had wanted
j , the glass materials, etc. , since they needed the light in the house
i because of family problems.

Les Evans said he would move for denial of the Coastal Development
Permit because the imposing single family residence does not conform
to the" General Plan of the City , is not consistent with the
surrounding residential area, looks more like a harel than a
residence, and is inconsistent with the R-1 Zoning District .

Surfside Colony, Ltd . is in receipt of the notice
frota your office regarding the appeal to the Planning
Commission 's denial of Conditional Use Permit P85--58/
Conditional Exception 185-67 and Coastal Development
Permit #85-31 . We respectfully request that this letter
be read into the record at the Huntington Beach City
Council 's public hearing on January 21 , 1986, and become
an official part of the applicant ' s file.
Surfside Colony is compcsed of approximately 250
homes that are in the City of Seel Beach but, directly
across PCH from the proposed development. As duly
elected representatives of the Colony , we would like to
respond to your public notice hearing with the following
comments:
The development is projected to build a 29 (mini
suite) motel with manager 's quarters , to permit one
parking space per suite in lieu of the two required and
an Excess of 25% of the suites to have a kitchen .
(a) We would like to request that a maximum
stay per guest in the suites be included
in the conditional application to protect
against this becoming a apartment complex.

(b) We feel that the narking is inadequate
for what is projected.
(c) The City of Seal Beach and Cal Trags have
recently completed :studies of the number of
serious accidents that have occurred over a
period of years on PCH. This development
will understandably create an additional
traffic hazard, if left turns in and left
turns out are permitted .
(d) We have noticed recently more and more
illuminated neon signs are being placed on
developments on PCH behind Surfside Colony .
We respectfully request that the minimum
amount of signs be permitted on this and
future developments .

(e) We respectfully request that landscaping
installed be? of a size to create a feeling
of maturity at an early stage.
