STATEMENT OF ISSUE:
Transmitted for your consideration is Code Amendment No. 93-7, a request to amend the
Huntington Beach Municipal Code pertaining to cantilever decks along waterfront lots in
Huntington Harbor. The amendment includes the deletion of the maximum fifty foot
(50') segment length of a deck and the addition of a provision referencing the Huntington
Beach Ordinance Code (zoning).

Findings for Approval
1. Code Amendment No. 93-7 provides an opportunity for a property owner to construct
a continuous deck beyond the bulkhead resulting in a more pleasing waterway scene.
2. Code Amendment No. 93-7 contains provisions to regulate the design of projecting
decks to ensure that these decks do not create undue weight on the bulkhead nor
threat of damage to public and private waterways.
3. Code Amendment No. 93-7 contains reference to comply with the zoning provisions
contained in the Huntington Beach Ordinance Code.
4. Code Amendment No. 93-7 will not impact the aesthetic value of surrounding.
properties.
ANALYSIS:
Request for Amendment
During the summer of 1993,the City received a request for variance to the Municipal
Code restriction which limits the total length of a projecting deck. The property owner
proposed to construct a deck longer than 50 feet in conflict with Section 17.24.010 of the
Huntington Beach Municipal Code which limits the deck to 80% of the property width
and with no segment longer than 50 feet. The City Attorney's office however, advised
staff that a variance is not the correct procedure; an amendment to the Municipal Code
was required. Subsequently,the code amendment was initiated as a result of the original
variance request. If adopted, a variance would not be necessary.
History
In the early 1960's the City Council granted permission to the Huntington Harbour
Corporation to build decks and windscreens over public waterways within the harbor. To
control the manner in which this may be done,the City Council adopted Ordinance No.
1114 establishing provisions regulating the design and construction of the project deck,
railing, and windscreen. Later in 1977,the City Council amended the sundeck and
windscreen provisions. One of the changes at that time was the limitation of 50 foot long
deck segments with a minimum 10 foot separation between adjacent deck segments
except where the combined total deck segments and intervening space do not exceed 50
feet.
It is unclear as to the reason for the separation between deck segments. It is possible that
the intent was to ensure an expansion joint would occur in 50 foot intervals to reduce the
weight on the bulkhead. It may also have been placed in the code as a way to state that

the deck must observe the sideyard setbacks, thereby creating a 10 foot separation
between decks on adjacent properties. However, there are other provisions regulating the
weight of the deck and bulkhead and there are minimum side yard setback requirements
that assure a minimum 10 foot separation between decks on adjacent properties.
Therefore deletion of the maximum 50' segment will not conflict with safety provisions
of the code.
The existing ordinance has unnecessary limitations on lots that are greater than 60' in
width. Staff recommends that the maximum deck length provision be deleted and the
code include reference to compliance with provisions of the Huntington Beach Ordinance
Code (zoning). The engineering design provisions included in the existing ordinance will
continue to regulate weight on the bulkhead. Properties that exceed the minimum lot
width of 60 feet will be able to utilize the full 80%of the width with a continuous
projecting deck. The continuous deck will be more usable, and it will create a pleasing
waterway scene.

The proposed project is categorically exempt pursuant to Class 20, Section 15320 of the
California Environmental Quality Act as included in City Council Resolution No. 4501.

AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE
- BY AMENDING CHAPTER 17.24 THEREOF REGARDING
SUN DECKS AND WINDSCREENS
WHEREAS,the City Council of the City of Huntington Beach desires to amend the
Huntington Beach Municipal Code regarding the length of projecting deck segments along
bulkheads,
NOW, THEREFORE,the City Council of the City of Huntington Beach does hereby
ordain as follows:
SECTION 1. That the Huntington Beach Municipal Code is hereby amended by
j- amending Section 17.24.010(d)thereof,to read as follows:
(d) Projecting decks are permitted along the bulkhead
provided the total length of the deck along the bulkhead does not
exceed eighty(80%)percent of the length of the bulkhead
abutting the lot.
SECTION 2. That the Huntington Beach Municipal Code is hereby amended by adding
new Section 17.24.010(f)thereto,to read as follows:
(f) All decks shall be in conformance with the Huntington
Beach Ordinance Code.

17.24.010 Construction. Decks projecting beyond the bulkhead shall meet the following
design requirements:
(a) Decks shall be designed to sustain a minimum live load of one hundred(100)pounds per
square foot.
(b) There shall be no moment connection between the deck and the bulkhead.
(c) Projecting decks shall be designed to sustain all dead loads plus the required live load
within the stresses permitted for the particular materials by the Uniform Building Code.
In no case shall the resultant load on the bulkhead, from dead loading, exceed seven-
hundred and fifty(750)pounds per lineal foot. In addition, a maximum equivalent
uniform live load of fifty(50)pounds per square foot is permitted. This live load shall be
used to account for all ancillary features incorporated into the deck/patio structure
including but not limited to overlayment,windscreens, and planters.
(d) Projecting decks are permitted along the bulkhead provided the total length of the deck
along the bulkhead does not exceed eighty (80%)percent of the length of the bulkhead
abutting the lot. No deck segment shall exceed ffty(cm f et i,, ien,tth. There shall be a

the bulkhead,whichever is less.
(f) All decks shall be in conformance with the Huntington Beach

17.24.020 Railing. Railing, not exceeding forty-two (42) inches in height and capable
of withstanding a horizontal force of twenty (20)pounds per lineal foot applied to the top of the
railing may be constructed completely surrounding the deck area.
17.24.030 Windscreen. The windscreens may enclose the entire deck perimeter within the
following structural limitations:
(a) Windscreens may be supported horizontally by bracing to the main dwelling.
(b) The windscreen shall be designed to withstand a horizontal wind load of ten(10)pounds
per square foot.
(c) Except for necessary framing and overhead windbreaks, all portions of the windscreen
above the allowed forty-two (42) inch railing height shall be open or of clear glass or
other transpartent material.
(d) All glass shall comply with the applicable provisions of Chapter 54 of the Huntington ,
Beach Building Code.
17.24.060 Applicable to waterfront lots. This chapter shall apply only to lots designated as
waterfront lots, and decks projecting beyond the bulkhead line shall be limited to wharfage areas
assigned to said waterfront lots.

Code Amendment No . 93-7 is a request to amend the Huntington Beach
Municipal Code to delete the maximum segment length of a deck that
projects beyond the bulkhead along waterfront lots within the City
of Huntington Beach.
Staff recommends that the Planning Commission approve the request
because the existing ordinance contains design standards to regulate
the weight of a projecting deck on the bulkhead. The concept was
recommended for amendment by the Planning Commission in September,
1993 with direction to staff to formulate a code amendment for
adoption by the City Council .

Code Amendment No . 93-7 is a request to amend Section 17 . 24 . 010 of
the Huntington Beach Municipal Code pertaining to the design and
construction of decks projecting beyond the bulkhead. The request
proposes to delete the maximum 50 foot length of a deck segment .
3 . 0 ENVIRONMENTAL STATUS:
The proposed project is categorically exempt pursuant to Class 20,
Section 15320 of the California Environmental Quality Act .
4 . 0 COASTAL STATUS:
The Coastal Commission has certified zoning provisions applicable to
the construction of decks projecting beyond the bulkhead; however,
each request for construction is subject to separate review and
approval by the Coastal Commission prior to issuance of a building
permit .
5 . 0 REDEVELOPMENT STATUS: Not applicable.
6 . 0 SPECIFIC PLAN: Not applicable.
7 . 0 SUBDIVISION COMMITTEE: Not applicable.
8 . 0 ISSUES AND ANALYSIS:
During the Summer of 1993 , the City received a request for variance
to the Municipal Code restriction limiting the total length of
projecting deck. The property owner proposed to construct a deck
longer than 50 feet in conflict with the referenced code section
which limits the deck to 80% of the property width with no segment
longer than 50 feet without a 10 foot separation between segments .
However, the City Attorney advised staff that the proper procedure
to allow this use required an amendment to the Municipal Code.
Because the City has no procedure to allow the public to apply for
changes to the Municipal Code, the Planning Commission at their
September 21, 1993 meeting directed staff to prepare the code
amendment .

NOTICE IS HEREBY GIVEN that the Huntington Beach City Council will
hold a public hearing in the Council Chamber at the Huntington Beach
Civic Center, 2000 Main Street, Huntington Beach, California, on the
date and at the time indicated below to receive and consider the
statements of all persons who wish to be heard relative to the
application described below.

Environmental Quality Act, as included in
City Council Resolution No. 4501.

public. A copy of the staff report will be available to
