The applicant 's rear yard abuts & '•public walkway adjacent to the public channel. The gear fence is wrought iron thus allowing risibility from the walkway into the applicant ' s rear yard. Additionally, the applicant believes that the subject property' s rear yard configuration discourages a pool in that area . On September 21, 1988r the Zoning Administrator denied Conditional Exception No. 88-29 with findings (see Attachment 4) . RAM - ?.ft/dq -8- (1790d) Y ` I S � i R � I y y The applicant initiated an appeal to the Planning Commission bested on their belief that the lack of privacy in the rear yard dick constitute c lood-related hardship and that other properties in the vicinity had been granted similar conditional exceptions (see Attachment 3) . On November 15, 1988 the Planning Commission concurred with the applicant and overturned the zoning Administrator ' s denial by approving Conditional Exception No. 88-29 with findings and conditions of approval (see Attachment 5) . The neighbor to the southwest, John C .H. Chang, submitted an appeal to the City Council to overturn the Planning Commission' s approval of Conditional Exception No . 88 -29 . His objection is based on the affect the wall will have on his view from within his home and the possible affect the wall will have on his property value (see Attec'-wont 2) . The appellant states on his letter of appeal that six homeowners within the vicinity have signed letters in opposition to the proposed wall . no copy of these letters are cn file, however . A thorough disc~uaeion of the history of the previously approved similar variances in the vicinity and the arguments for and against the request are contained in the attached Planning Commiss-.on Staff Report dated November 15, 1988 ( see Attachment 6) . M., The proposed b3ock wall is exempt pursuant to Class 5, S15305 from the provisions of the California Environmental quality Act . In the appellant 's letter of appeal, Mr . Chang states that the wall requires an Environmental Impact Report (EIH) as no clear categorical ezemption applies . THE PUBLIC HEARING WAS OPENED Robert Goebel, applicant, presented photographs of other tomes in the area that were granted exceptions and spoke in support of the request. He said his family would like to construct a swimming pool and that because of his lack of privacy in his back yard due to the public accema/walkway it is necessary to build in his front yard . He said the extension of the front wall would allow him to have patio furniture and enough room to enter his front entryway without strapping into the, pool . James Sapp, pool contractor representing the applicant, spoke in � support of the request . He said the proposed pool is very small yet has an aesthetically pleasing design. David kakstalis Jr. , representing the appellant , John C. H . Chang, said his client sent letters to the surrounding neighbors and twelve responded by objecting to the proposed extension of the block wall. He distributed photographs to the Commission showing the blockage of Kr. Chang 's ♦ie+s. He also presented photographs of the ether homes in the area that were granted variances that do not block views . It was felt that since the applicant ' s backyard faced onto the channel and a public walkway was required by the Coasted Commission, he was deprived of privacy in the rear yard and that a variance of five feet in the front yard setback should be allowed for privacy.
