The Applicant 's request initially consisted of a use permit for _educed side yard setbacks (3 . 5 feet in lieu of 5 feet) for the dwelling and a conditional exception (variance ) for reduced rear yard setbacks for the dwelling and garage and a zero foot side yard setback for the garage , On August lb; 19891 the Zoning Administrator acted on the applicants request by approving Use i Permit No . 89-•34 to permit reduced side yard setbacks for they dwelling and garage of 3 feet_ in lieu of 5 feet with findings and conditions of approval and denying Conditional Exception (Variance ) No. 89-35 for the reduced rear yard setbacks and a zero foot side yard setback for the garage with findings . In other vrords, the Zoning Administrator approved the Applicant ' s request for the reduced sides yard setbacks for the dwelling with the requirement that the plans be modified to show a minimum 3 foot side yard setback for thf; garage and a minimum 7 foot, 8 inch rear yard setback for the garage and dwelling. on October 3, 1989 , the Planning Commission unanimously denied the Applicant ' s appeal to the Zoning Administrator 's denial of Conditional Exception (Var 3nce) No. 89-35 . Section 9811 . 1. 1 of the Huntington Beach Ordinance Code requires that several findings of fact be made prior to granting a conditional oxceptioo . Both the Zoning Administrator and the Planning i�onmission determined that the circumstances required to grant a conditional exception did not apply to the Appiicani; ' s request for they following reasons . `Irst , the granting of a cohditi )na3 exception for a reduced rear yard setback would grant a special privilege inconsistent faith other properties within the vicinity. The extent of the addition and reconfiguration of the structure requires that the project be antlyzed for planning purposes as new construction. Extensive now construction RCA 22/4/89 (4151d) and remodeling is occurring within the Tuwnlot area, including the properties directly across the alley from the subject property, all adnearing to the 7 . 5 foot rear yard setback. Second, the subject property, after consolidation, is regular in shape and has over twice the required frontage and area. No "land-related" special circumstances that would deprive the subject property of privileges enjoyed by other properties in the vicinity and tinder the same zoning classification appear to be prevent. Third, the subject property can be fully developed within the established development standards ; therefore, a conditional excoption is not required to preserve property rights . Finally, the project as proposed has the potential to be detrimental to the public welfare and injurious to adjacent property. The project as proposed includes a 21 foot high structure three feet from the alley placing excessive building bulk at the public right-of-way and restricting vehicular ingress and egress to the subject garage as well as the adjacent proparty owner ' s garages . The neighbors directly across the alley from the subject property have submitted letters opposing the proposed reducM setbacks . The letters state that the applicant parks his car parallel to the existing garage making it difficult for them to enter or exit their garages . The letters and a � detailed discussion of the project and the above planning issues are contained in the attached planning Commission staff report dated. October 3, 1989 . In the Applicant ' s letter of appeal to the City Council : dated October. 1.3, 1989 (Attachment vo. 3) the basis for the appeal is that the Planning Commission permitted. Saint Mairy' s by the Sea to maintain a 15 toot alley width rather than immediately dedicate and improve the alley. The difference in the case of Saint Mary' s is Viat Saint Marys will meet all required building setbacks, the City merely will not require alley dedication until a later date. The appellant, however is proposing building with the setback area which would continue to irapact the alley even after dedication. Therefore, the alley dedication issue in unrelated to this appeal . This appeal is a request for reduced side and rear yard setbacks . amim . Section 9130.7(b) of the Huntington Beach Ordinance Staff Report - 9/19/89 -2- (3636d) Code Permits reduced side yard setbacks pursuant to a use permit if it is found that : 1; the reduction results in an improved design and utility of the project; 2) the reduced setback is compatible with the surrounding neighborhood; 3 ) the proposed structure w .th the reduced setback does not have a detrimental effect on the general health. welfare , safety, or privacy of the surrounding neighborhood; and I 4) that the proposed structure has a variation in the building setback through offsets and/or other architectural. features . The Zoning I Administrator approved Use Permit No . 89-34 for reduced side yard f setbacks with findings that the proposed development met the mandatory j criteria set forth in the Code. Section 9130 . 7 (s) provides the criteria For permitting zero foot side yard aetbacks . These requirements include that : 1.) the opposite side yard setback be 20 percent of the lot width ( 10 feet) ; 2) the adjacent lot to the zero foot side yard setback be hold under the sane ownership as the subject lot or an agreement: signed by the adjacent lot ' s owner granting consent be recorded; 3) the separation between the proposed structure and any structure on an adjacent lot be zero feet or a minimum of 5 feet; knd 4) that a maintenance easement be obtained from the adjacent lot . The applicant ' s proposed project does not meet these requirements as : 3.) the opposite side yard setback is proposed to be 5 feet in lieu of 10 feet; 2 ,, the Adjacent lot is not currently owned by the applicant , and no letter by the adjacent property owner granting consent was submitted with the application or recorded; 3 ) the W acent property has a structure less than 5 feet from the subject sidle yard property line (4 feet-3 inches) ; and 4) no maintenance easements has boen obtained from the adjacent lot . As a result, a conditi.oi'ial exception to those requirements is necessary fcr the project as proposed. in terms of the applicant ' s request for a veriance to the rear yard setback, no provisions are contained within, the Code for permitting suc:i a reduction . Therefore, the applicant also requested a conditional exception to the development standards for rear yard setbacks contained within the Zoning Code . Section 98 11 . 1 . 1 of the Huntington Beach Ordinance Code requires that several findings of fact be made prior to granting a conditional exception . Ths Zoning Administrator determined that the circumstances required to grant a conditional exception did not apply to the applicant ' s proposal for the following reasons . First, the granting of a conditional exception for a reduced rear yard setback would grant a special privilege inconsistent with other properties w"shin the vicinity. The applicant is proposing to reconstruct and reconfigure the existing home while adding approximately 54 percent more total area , The existing structures (dwelling and garage) contains approximately 2, 034 square feet. The proposed project will have an � area of approximately 31140 square feet (includes duelling, garage and 3 storage area) . The extent of the reconstruction, reconfiguration and addition to the existing structure requires that: the project be analyzed for planning purposes as new construction . Extensive new residential construction is occurring within the Townlot area , all adhering to the 7 . 5 foot rear yard aetbac k. Second, the subject prope►rzy, after being consolidated through the parcel map process , is t6gul.ar in shape and has greater than double Lhe minimum frontage and area. Fojirth, the project as proposed with reduced revaL yard :setbacks has the potential to be detrimental to the public welfare and injurious to adjacent property. The purpose of the rear yard setback is twofold; to reduce the bulk of the structures as seen from the alley and to provide adequate turning area for vehicles to enter and exit garages adjacent to the alloy. The project as proposed would have a rear yard (garage) setback of 3 feet, 3 inches from the alley and be 21 feet in height . Additionally, the neighbors to the rear of the subject property have submitted letters opposing the reduced setbacks . Briefly, the neighbors have stated that the applicant parks cars parallel to the existing garage making it difficult for -them to exit or enter their garage . The granting of Conditional Exception (Variance) No. 89-35 would cleanly Appear to defeat the intent of the rear yard setback requirement by allowing excessive building bulk as seen from the alley and restricting vehicular ingress and egress to the subject garages as well as the adjacent property owners ' garages . The house is now setback 3 ' 6 " from the line . Also , the garage is now on the property line , along the south property line . We are asking thet this remain as is . Many houses in the vicinity are only set back 3 ' O" , which present day laws al.lcw , and some are less than this . 12 . Safety is being able to nagotiate an automobile with prudent attention to all safety factors without the encumbrance of limited space , impaired vision, dodging garbage cans in the alley and generally endangering alley traffic whether vehicular or pedestrian. Safety is not having 11011 feet lot lines so houses do not adjoin one another in such fashion as to impede emergency response to any given calamity such as fire , underground pipe rupture, etc. , not to mention the practical aspect of winter rain run-off being diverted to neighbors on either side . Esthetics, or good community planning is, or should be of interest to all . There is ample evidence in our community that alleys , when uniform cedes rre applied, whale not a picnic area, certainly provide 1 an esthetic appeal where residents pride conceals the clutter of garbage cans, discarded furniture and avoids the blight of garbage strewn and blown down the alley way . Equity. . . . what is the purpose of uniform codes if variances of this magnitude would be granted? What is eq Atable in granting a variance to one but not another? I submit that if the builders and developers of neq Homes in our city ,sought and gained carte-blanche commission consideration of v"riances there would be chaos! on the other side of the coin , if rely garage had 3 . 5 feet set-back, I would enjoy a home with more livable square feet and courtyard open space . I like it the way it is and I }snow that the 7 .5 garage setback provides my neighbors (including *fir. Walden Williams) as well as the community the safety and orderliness they are entitled to.
