TO HONORABLE MAYOR AND CITY COVINCIL
I+RO.11: Planning Commission
SUBJECT: Conditional Exception 'Yu -'±1 - Appeal
ATTIC: Dovle Mill*r, City Adminis1;-a'lr;z2.
Paul Jones , City Clerk
Gentlemen:
Trans.^fitted ixerewith• is the Planning Commis c ion recommendation
for approval of Conditional Exception No. 69-15, which was
appealed.
Applicant: Wm. Lyon Development Co.
P.O. Box 1430
Huntington Beach, California
.Location: West side of ErookhxLrst Streit,
approximately 660 ft. south
Hamilton avenue.
I•iaster Planned: Medium Residential Development
Request : 1) Carports to be constructed on props Ity
line -i,: lieu of the required 5 ft.
setback; and,
2) Allow three story structures to be
located on portions of the parcel, as
permitted under provisions of proposed
Code Amendment No. 6r),-4.
ReasonsEiven by AUt)lic an.t : (In Brief)
Allowable density would be 641 units and oiu requast
is for 448 units with 23- 05% of the total land area
tieing covered,
Staff Recommendation: Approval
planninfi, Commission Action : Approved as modified.
rrw ri rt ■YrW b .wll-.
Reasons &1ven by the Planning Commi.s'Ision for their
action:
1. That , portion of 'the requeot allo%diig carports to be
constructed on. the propert-y line is reQaonable because
car_drts so constructed will. eliminate: a 5 .ft. otri ) of
ettiie n the carport; and ' roper line which en' eraily
and b P P P Y 6
rls.sults in a 'trash collection area to the detriment of
abutting properties ; also, it will provide for a better sep-
aration between uses.
2. That portion of the request for three story buildings is
in accordance with provision of Code Amendment No. 69-4;
also , it appears reasonable because such construction
I will provide more open space within the project. The required
85 ft. setback. •ot-ill conform to the proposed code anendaent ,
which will afford a much better separation between the
requested 3 story construction and adjacent' R- 1 properties.
