Conditional Exception 69-17 - Leon Levitz - Construction of
.A-L- Huntington Beach Planning Commission `s P.O. Box 190 CALIFORNIA 92645 July 7, 1969 TO: HONOT . ALE MAYOR AND CITY COUNCIL FROM: Plarici_ g Commission SUBJECT: ' %1(1i-0 anal. Exception No 69-17 - Appeal • ATTN: ..oyl^ ri,tler, City Admiuistrator Paul -Iorcc,::, City Clerk Gentlemen: Transmitted herewith is the planning; Commission recommendation for approval of Condlition.e.1 Exception No. 69--17, which ::as appealed. AUlicant: Leon Levitz Levitz Furniture Pheonix, Arizona Location: Northeast corner of Gothard. Street and Edinger Avenue. Reauest: To permit the construction of a pole sign 112 ft,.. in height in deviation to the 35 ft. height Limit in the C-4 Highway Commercial District,. Reasons given by the applicar.'t: (In Brier) 1. The height limitation has been exceeded in this immediate area by the Broadway Dep%rtment Stare and Mer.,—uiy Savings and Loan Assoc . 2. Due to the size of parcel and the project this additional height is necessary for proper identification. Staff Recommendation: Approval for a 70 ft. high sign. Planning, Commission Action: Approved for a 212 ft,. high, sign as requested. Reasons riven bX the Plain&Commission for their Action: 1 . 2Trie sign• irill not obstruct view. 2. The area of the proposed sign is less, than the 3000 ag -ft. permitted vtLthin the now sign ordinance. - •t W .• ... .'1 1 •11 Imo' _ _-_ - `• • 3. The size of the development is such that n sign having sub- stantial size and height is rc:luired for proper identification. 4., The proposed sign. will set back approximitely 70 feet from the street. 5. Unique location as to distance from the freeway and being separated by high powered electrical structures is such that ' the request is reasonable. Also, this request small not set a precedent for future requests .for sign height. i ROLL CAM, VOTE. AYES: Miller, Bazil , Bokor, Slates NOES: Porter ASSERT.- Duke , Tom THE POTION CARRIED. Additional information: A representative for the applicant explained his reasons for the request. OMMISSIOT?ER PORTER: Comaissioner Porter gave the following reasons for voting agUnst the requQgfi: 1 . It is felt that the approval of this sign sets a precedent in view of the generally accented height in the HUNTINGTON CE"UT'ER commercial area of 70 to 75 feet. Approval of this variance would result in a local sign height increase of 50 per cent, over 3 times the ordinance limit. 2. The insurance company tenant of the IIercury Savings building was discotL•aiged from filing a variance to construct a roof for sign because of excessive height. Mobil kas denied a request for a 70 £U. high sign. 3. The Planning staff has recommended a 70 foot hig:Y sign whiall., like all high signs in the area, *gill be visible from the freeway and along Edinger Avenue. There are no proposed continuous structurec which would block line of sight for the applicant's sign from either the freeway (which is elevated some 20 feet) or Edinger. The requester) heigb-t, is an excessive intrusion. 4. While the action was approved by a majority of the Commission (4-1) , two members were not present to express their views on this matter of crnsiderable - i.mportande. 5. It is questionable whether the applicant; has MI hardship present, and therefn:^e, cannot claim artiy veriance`, .in ' oYcess of' local height limitations. Po tentiel sales taxravox ue and loclAtion from the freeway to the sign do not ,.n this_: ommi©sioaer' s opinion constitute any hardship that' is ' not shared ter.oughout , the general arl'•a. Levitz Furniture is a new , nationally-active. , busIneas to Huntington Beach which the City and all of its residents can greatly profit fromp ito successful operation . Advertising, they have a $1 Million program pr,aposed , is vary Important to such a business and the reque_ted 112- £coot sign is an important element in such advertising program. The Choubar of Commerce particularly notes that a sign of the desired structure And height is a very expensive investment for the ocher-businessman (eeticrated cost is $140,000) . No busine, sscaan Is going to invest the cost of such a sign unless he is reasonably sure it is necessary to his successful operation. With the r xperience of Levity Furniture dictatiaag tc ' them that such a sign is a reasonable investment and a necessity in their sew Location, we respectfully request the Council'es consideration from thin viL point and their full+.st cooperation in this ratter. The Chamber is continuously interested ir, obtaining for the City, as a mutual. benefit, the la*-est return of sales tax as is possible. kncauraging high volume: businesses , such as Levitz Furniture, to locate here and be as successful as possible is certainly in keeping with this goal and to all of our benefits . 1a addition to file above, this business will provide additional employanent in Huntington Beach for some 250 employees.
