Couditintml Excaptioa No 69-62 - Appeal
Depaertsental staff Report - Planning,
building, Fire and Public Works
Dates September 16, 1969
The staff has raviewed Conditional. Exception No 59.62 and
offers tlw folloviog inf-.:rmation for your considerations
1 . The property is located on the northwest cormi of
Ellis Avenue and Beach Blvd. , and is Booed C-4,,
2. Ve sign is existing pad advertises a Dsnay1.2
Restaurant. The present height is 50 ft. , and the
applicant is vaquesting )mxuLtesion to im%v"e the
height of the sign 8 ft. by adding a 6 ft. diaveUr
f lashl S mphere that will be painted white with
transparent yellow bulbs.
3. This application is befora the Flaming Cwreaission
because of .an appeal to the board of Umaing AdjustaAsta
decision to deny the reTiest.
The reasons for d*niel are as follows t
a) Tba applicant has not downstrated a hardship.
b) Approval of the regtuist could set a pratedaet '
for future bests.
c) The r"uest is not En line with ttia newly adopted
sign ardin we.
d) Appronral will be incousistaat with past decisions
of the board of Zoning Adjust mts, Plaaaing I
Camission and City Council.
4. A niwilar rrgutat w" fil*d by Heath Sign CoaVMV in

extended the height of tho sign an additiunal 10 ft.
That application was first denied by the Board of
Zoning Adjustments and th,3 decision to deny was up-
held by the PlaaQming C.o Lssion and City Council ,
S. It. is -the opinion of the staff that there is no
apparent justification for granting this Ts"Ote
The only obstruction t:o this sign is several tft4s
on the property to the north and these trees ar+e of
a temporary nature. 7t should be noted that the subjeck
eLp is clearer visiblo to .south _ bound traffic. In
fact it in one of the more prominent signs in the area:
The 61ashing bulb is an attractive getting device
which is spocificatly prohibited by the new sign ard-
ir mw,e. Tt should be noted that if this application
is approved, there is nothing to prevent other businesses
in the area from filing similar requests. This t: ne
would reduce the effectiveness of the flashing bulb

properly seen from Beach Boulevard .
It is further requested that because we are members of a
national organization , we must make contact with the Home
