F.Mott, Jr. which is under consideration by the Council for deactivation b=cAuse ofzoning regulations. I as aware that this well has considerable oil potential which has not yet been developed. This tm1l, located In E11ock 21050 East Side Villa Tract was drilled under proper zoning at the time of drilling. The zoning wan subsequently changed. Sustain the Planning Counission 2. Overrule: the Planning Criss ion and allow Mr. Elliott to ties tart his • oil well "Sun" #4. (No activation permit is necessary since this well is non-conform. ing under the Planning Code, but is not or has not been i declared idle under the Oil Code. ) He, also wishes to remind Council. it the event t.h-ey choose the second course of nction, that the finding of n hardship, othe► t:nan financlal, is necessary. May I also suggest that the conditions, cs sugges '.ed by staff, bE imposed, if the second course of action is taker,. Mr. Bona aLso states that the City, has no recourse as far as the Sun Oil Co-mpany (rmklster lease holder) is concerned, since they nre not the ope.atvr and the Oil Code specifically refers to operator in context. 7
