The property is ai.tuated on the northeast corner of Utica Avenue and Dolaware Street and is could Rr-2. 2 . The applicant propoeen to reactivate an idle oil well using existing equipwent. The well if: considered non-conforming, because it hao been inactive for more than nix months. It should be noted that they 40" doeignation wav removed from this property on July 18, 1960 . 3 • Proper ties to tho north and oast are coned H-2 with an apr.-'tmQrit d prelopmont abutting thin property on tho north. The Planning Co=iseion recently oonsidored an application similar to this on property in the 22nd Street area. The conditicus of approval and reasons for approval were as follows : a) The property shall be muintained in a neat, clean and orderly manner. b) All provisions of the Huntington Beach Oil Code and Piro Code shall be %%ompli.ed with. o) A concrete block wail ahall be inatalled to Fire Dept* standards around the existing tanke for aesthetic and 3a-feta reasonso d ) The applicant shall secure all neoeosary permits as requfrad by the Huntington Beach Ordinance Code. ` e ) The conditional exception shall be reviewed by the Planning Commiesion during the month of September 1970, for the purpose of establiehing additional conditiono of approval that are: consistant with city ordinances effective at that time; or, such con- ditionni oxception .11 become null and -void on October ?A. f) The applicant uhall screen the site with 5-gallon myonorum trees arranged in such a manner so an to adequately screen the oil well and tanks from view. Elliott, Jr. which is under consideration by the Council for deactivation because dfzoning regulations. l an aware that this well has considerable oil potential which has not yet been developed. This well , located In Block 2103, East Side Villa Tract was drilled under proper zoning at the time of drilling. The zoning was subsequently changed. Appeal of Denial by the Planning Commissions of Conditional Exception 70-1. According Lo Don PfA lip Bonfa, the City Council has two caurses of action regarding the abova subject &ppeal. 1. Sustain the Planninf :tomission 1. Overrule the Planning Commission and alloy Mr. Elliott tc restart his oil well "Sun" #4. (No activation permit is necessary since this well is non-conforming under the Planning Code. but is not or has not been declared We under the Oil Code. ) He also wishes to remind Council, in the event they choose the second course of action, that the finding of a hardship, other than, financial, is necessary. May L also suggest that the conditions. as suggested L,y staff, be imposed, if the second course of action is taker.. Mr. aonfa also states that the City has no recourse as far as the Sun Oil Company (master lease holder) is concerned, niece they are not the operator and the Oil Code specifically refers to operator in *ntext.
