The applicant proposes to operate an auto dismantling yard with retail sales of auto parts, in the M1 district on a 4 . 8 acre parcel of land which is master planned for light industrial use . 2 . The property is located on the south side of Slater Ave. approximately 1320 ft . west of Beach Blvd. 3 . Automobile dismantling and uned parts storage , when operated and maintained wholly within an enclosed building is permitted in the M1 District. A motor vehicle storage yard is also per- mitted subject to approval of a use permit provided the re- quirements concerning such rise are complied with. In this case, the applicant proposes to conduct the auto dismantling outside the building . 1. The parcel in question is can the fringe of the central indus- trial area . The property to the east, which is zoned R2 Two Family Residence District, has an approved tentative asap for single family honed and itan numbers 13 and 14 on the agenda propose to change the zone to permit a mobilehome park. The property to the north across Slater Ave . is zoned R3 and developed as a multiple family res:.dential area. The Pro- perty to the west is zoned M1 and the property to the south is zoned R3 and M1 . 5. Item no. 11 on the agenda, Precise Plan of Street Alignment 70-1 proposes to precise plan a north-south connection between Speer Ave. and Slater Ave. along the nest: property line of this parcel. Any action taken by the Planning Com- mission on the Precise Plan Aligment should be considered in this request. The proposed street has been shven on the applicant' s plot plan. Irv' 6. The applicant proposes to construct en office acid storage building in the front portion of the property and to cin- struct an 8 it . high decorative ammonry wall parallel to and 59 ft. from Slater Ave . He also proposes to construct an 8 ft. high metal fence alone the east, south and west property lines . 7. An application similar to this was approved by the Planning Commission in March of L969 . The property Was situated on the west side of Gothard St. , 660 ft. north of Ellis Ave . In that the applicant constructed a masonry wall and buildingparallel to Gothard St. with metal fericin Pa S along the side and rear prolmrty lines . `The difference between this request and the request presently being considered by the Planning Co, -isslon is that the metal Fence for tea auto wracking yard on Gothard St. wus only constructed on interior property lines and the material was approved by the Planning Cr mihsion. The applicant, in this case, pro- poses to construct the metal fence on the two local streets, Speer Ave. and the proposed street and has not submitted samples of the type of metal to be used. 8. Although the applicant proposes to construct an 8 ft. high decorative masonry wall along the front property line, this Mall will not .)creen the auto storage &nd dismantling area from the R3 property to the north trcca►use the R3 area is at a higher elevation than the wrecking yard, making it possible for the residents living along Jacquelyn Lane to view the wrecking yard from their front yards and for vehicles traveling south on Jacquelyn Line to also view the Mreckir$ yard . 9. It is the .-onsensum of the Staff that provisions should be wade to porscit uses such as this within the City; havewer, such use tihoulc not be located adjacent to residential areas. The crater, sever aM fire hydrant system shall be approved by the Department: of Public Works and Fire Department. 5 . The property shall participate in local drainage assess- ment district . 6. All utilities shall be installed underground. 7 . Fire alarm system conduit and appurtenances shall bt installed by the developer at locations and to speci- fications provided by the Fire Departwes.t . 8. Access throughout the yard shall be approved by the Fire Department . g. An 8 ft. high decorative masonry wall shall be constructed along the seat, and south property lines. mid wall shall be set back 5 ft. from the Euture right-of-way line of the proposed street and 5 ft . from Speer Ave. The area between the wall and right-of-way line shall be landscaped . Trees shall be planted and maiAtained along the north, mouth and east portion of the property to tacilitste screening the yard from the nearby residential are:as. The location of all gates shall be approved by the Traffic Emgineer. Such gates shall be solid so as to Screen the operation from view and-shall be aonstructatl to the height of the masonry wall . 13. All of the above conditious shall be complied with prior to issuance of a Certificate of Occupancy by the Building Departsent. 20 . Canditioual Exception No. 70-10 shall be subject to an Ada,Anistrative Review before the Board of Zon- ing Adjustments prior to January 1. 1980, to deter- mine whether the conditions existing at present have materially changed so as to require NUI .ttal of a my application to the Flaming Commission. Gentlemen:- We attended a public hearing at the Council Chambers at 7 P.M. on Fab 17th in regard to the "Conditional Exception I Nw-10". This proposal met with much opposition, and justly so. My husband . and I, as well as my sister, Myrtle Tornavacca, were among those who opposed this permit for a wrecking yard. We own our homes here and our property lids adjacent to the proposed site. Valid reasons for opposing 1 70-10 are as follows: 1-- Since we ere forced to stay in the MA zoning without recourse to the better zoning of R. 2 or R. 3 , we can only use the rental of the house and pasturage at ?72 Slater Ave to pay the exhorbitant taxes now imposed on us in Orange County. -2--An added hardship would hi imposed on us as well as o;.. the owners of the lovely apartments across the Street on Slater Ave. -3--Property values would certainly be downgraded. -4-Possibility of rentals :o desirable tenants would be decreased accordingly. --5-Since the building which the applicant proposes would indeed be 'Tory small-401S0' , 1t could act possibly cover or bide the trashy condition that would inevitably, finally exist at an unsightly wrecking yard It would not only be unsightly, but noisy as well. --6--This would be particularly true since the applicant proposes to conduct the auto dismantling outside the buildingo , since this would be the causative factor in creating the noise and unsightliniss, we oppose it . -7-•Me agree wholly pith paragraph 8 of your staff report--that an eight - foot fence could not possibly screen the auto storage or dis- mantling area from the R. 3 property, the very nice apartaeats across the street on Slater, because of the higher elevation, nor could it be ecreersed frog '-rehi.cle s trav_•11 i ng Bou th on J.lquu lane ie.ne .
