Exception 70-33 granted September 21, 1970, and perni.t us to addz,5ss you at the September M, 197 meeting. The reason we request such action is because of the numerous and repetitious violations of various, City ordinances . When you, granted the conditiona;, exception, you specifically conditioned such grant stating that the use shall be tercainated. . . upon viola- tion of any City or County ordinance. g y . We originally oppoued the; granting of the Conditional Exception, but have tried to live with it. Unfortunately, it, is unlivable . The operator, of the stable has been unable to live up to the laws it is impossLble for him to do so. There are nightly violations of the noise ordinance 5541 (f) which ..occur when the horses become restless and kick the sides of their stalls . These stalls are constructed .of metal and wood so .thatt the ,effect on us, the neighbors, i.s 'equivalent to the intermittent banging of the world' s largest tin drum. There are constant violations, at least during the daylight hours, of the dust ordinance 3.132. Thes© violations are caused by the horses moving around in the dirt. The operator has attempted to Alleviate the situation by spreading .manuro over the area and wetting it .down. We are now faced .with, not only dirt and dust, ;- but also,.'vini .ations in our homes and yards of minute specks of horse mar ure, and' we not only have a duet problem- but also' a sanitation and health problem. Whore `tt.ere are horses there is horse manure and, where ro there are - fifty horses, or ao, there Is an , abundance..of hardy manure' Rnd, of - course. where, there. is horse manure there are flies-* and fifty. horses attract a lot of `£lies •R• . 1 : Page Two September S. 1971 City Ordinance 4243 .1b declares it a nuisance to stable more than two horses within 100 Feet of another 's dwelling house. One of the undersigneo ' s home is legs than 100 feet .from the stables that have been constructed on the conditional exception property. We have not mentioned the smell and what more can one say than fifty horses generate a lot of smell. We have not delved so far into more technical violations of the ordinances ouch as the non--maintenance of fences and the numerous I trespasses that occur as a result therefrom. Nor have we spoken j of the economic drawbacks that we have incurred as. a result of this conditional exception (see attached letter from Japan Machin-. ery Corp. which ^speaks for itself) , but we have written from the human aspect. i We have a right to enjoy our homes. lie are i:nable to .exercise that right fully because of the smell, the dirt, the flies, the manure, the noise and the trespassing of these horses. It is interesting to note that the stable Is only operating at about 20% of capacity. What will happen when the stable in full? JCM8 'f City Clark , d September 290 19? 1 City Council Huntington Reach , California I � RE: gill Williams Stables Dear Sirs: I would like to preface this letter by saying that as a hoarder at Bill Williams Stables I do have a vested interest in its continued operation. Also that I am sending the Williams a copy of this letter but am writinn it without their prior knowledge or consent. First, I would like to coirment on the character of the Williams family and t!,e manner in which they have run their business and have conscientiously tried to meet the complaints of the few surrounding Neighbors . I have been a boarder at the stables since March '1971 . Durinq that time I have repeatedly witnessed an attitude of "let 's do more than is required of iis , regardless of cost" to win the accept3ni:e of the neicrhborhood, As examples of this I cite the following actions : After objections were raised about riders on the property across 03 street from the stables Mr. Williams has been diligent shout keeping not only hi, own boarders but horsemen from the surrounding stables off this property, There have never, been any "wild" dons at the stables. However, in an effort to please the neiahbors the Williams have found a new home for one of their dogs, Keep their remaininq Inimal tied, ar:J require all boarders to keep their dons on leashes Wle at the stable. Although the fly inspector has repeatedly assured the Williams that there are no flies breeding on their property, they purchased cor,tly chemicals and spray enuininent to kill flies on the premises. Fly bait has also been placed in all stalls and around the sta:°le area . When the problem of standing water in the wash area arose the Williams had a cesspool installed , again at considerable cost, although the inspectors had only su es;ted, not re uirild. then to do so. On the matter of dust bothering resie;-.,nts of the area (a fact which .is open to debate considering the prevailitin wind conditions and .the resul is of tests Conducted by your own poi Ice department) I ' can only say Mr. Williams has been more than conscientious and fit concerned. For the last, two mrnths , in addition to tloOnq the arena on Mindy days , he has continously soaked the area with water to a point that at least 60% . f it is always under water and unusable to riders . The remaining 40% is always Nret and slippery. heedless to say, relatively little riding has been clone in the arena for safety reasons , causing considerable inconvience to hoarders at times. I know that future plans for the arena call for complete sanding and the installatio!r of a sprinkling system - the pipes for which are already cut and laic) in the arena awaiting time to install them. It is also a standing stable rule that horses must be walked in the stable area , Recently Mr. Williams graveled and oiled the parking area to eliminate dust caused by cars entering and leaving the stables . As for noise generated by the stable I do not believe, considering the area and surrounditiq land uses, that the horses are creatin+r a public nuisance. I have been at the stable late at right on four occasions. I have never heard any prolonged noise frm-n the horses . I have heard traffic noise from Goldentivest, oil dereks pumping , neighbors dogs barking„ and lame trucks entering and ieavinq the nearby truck yard. The Williams accept this noise as part of the price they Faust pay for choosing to live in this type neighborhood as opposed to the standard residential community. Finally, throughout an almost• daily harassment, the Williams family has refrained from any form of counter complaint or even verbal confrontation with the neighbors . 1r. Williams has also asked his boarders to follow this policy. This restraint is comcnP.Mable considering the actions , outright lies , and verhal attacks some of these neighbors have reso►,ted to in an effort to dislodge the Williams from their tone and husinsss. In all I only wish the neighbors around my residence were as friendly and as thoughtful of others as the Williams have been. I consider it a privilege for myself and my children to know and associate with thm.
