Tho reason we request such action is because of the numeroupr and repetitious violation.,. of various City ordinances . when you granted the conditional exception, you specifically conditioned such grant stating that the use shall be terminateed. . . . upon viola- tion of any City or County ordinance. We originally opposed the granting of the Conditional Zxception, but have tried to live with it . Unfortunately, it is unlivable. The operator of the stable has been unable to live up to the laws it is impossible for him to do no. There are nightly violations of the noise ordinance 5541 (f) which occur when the hcree• become restless and kick the sides of their stalls . These stalls are constructed of metal arnJ wood so that the effect on us, they neighbors, is equivalent to the intermittent banging of the world 's largest tin drum. There are constant violations, at least during the daylight hours, of the dust ordinance 3132 . These violations are caused by the horses moving around in the dirt. The operator his attempted to alleviate the situation by spreading manure over the area and . wetting it down. We are now faced with, not only dirt and dust, but also vLaitations in our hones and yards of minute specks of horse manure, and we not only have a dust problem but also a sanitation and health problem. Where there are horses there is horse manure and when that* are fifty harsea, or no, there In an abundance of horse manure . And, of course, where there is horse manure there are flies, and fifty horses attract a lot of flies . r Page Two September B. 1971 City Ordinance! 4243 . 1h declares It a nuisance to stable core than two horses within 100 feet o: another 's dwelling house. One of the undersigned 's home is less than 100 feet from the stables that have been constructed on the conditional exception property. We have not mentioned the smell and what more can one say than fifty horses generate a lot of smell. We have not delved so far into more technical violations of the ordinance$ such as the non-maintenance of fences and the numerous trespasses that occur as a result therefrom. Nor have we bpoken of the economic drawbacks that we have incurred as a result of this conditional exception (see attached Letter from japan Machin- ery Corp. which speaks for itself) , but we have written from the human aspect. We have a right to enjoy our homes. We are unable to exercise that right fully because of the smell, the dirt, the flies, the manure, the noise and the trespassing of these horses . rt is intereeting to note that the stable is only operating at about 20% of capacity. What will happen when they stable is full? Please, gentlemen and lady, help us . Also that I am sending the Williams a copy of thi: letter but am writing it without their prior knowledge or consent . First, I would like to connent on the character of the Williams family and the manner in which they have run their business and halve conscientiously tried to meet the complaints of the few surrounding neighbors. I have been a boarder at the stables since March 1971 . Ourinq that time I have repeatedly witnessed an attitude of "le:'s do more than is requited of us , regardless of cost" to win the acceptance of the neighborhood. As examples of this I cite the following actions : After objections were raised about riders on the property across the street from the stables Mr. Williams has been diligent ahout keeping not only his own boarders but horsemen from the surrounding stables off this property. There have never been any "wild" doss at the stables. However, In an effort to please the neighbors the Williams have found a new home for one of their dons, Keep their remaining animal tied, and require all boarders to keep their dnns an leashes while at the stable. Although the fly inspector has repeatedly assured the Williams that there are no flies breedinq on their property, they purchased costly chemicals and spray enuipment to kill flies on thc. ore+nisr.s . Fly bait has also been placed in all stalls and arnund the stable area. When the problem of standing water in the wash area arose the Wslliams had a cesseool installed, again at considerable cost, although the inspectors had only suggested, not required, them to do so. On the matter of dust bothering residents of the area (a fact which is open to debate cone. iderinq the prevailing wind conditions and the results of tests conducted by your own police department) i I chn only say Rr. C. *rrrare 4 concerned, -for the last, tyre months, in addition to claffhq the arena on windy days, he has contirously soaked the area with water to a point that at least 60% of it is always under water and unusable to riders. '►'he remaining 40% is always wet and slippery. Needless to say, relativa.ly little riding hos been done in the arena for safety reasons , Ca;aing considerable Inconvience to boarders at times . I know that future plans for the arena call for complete sanding and the installation of a sprinkling system - the pipes for which are already cut and laid in the arena awaiting time to install them. It is also a standing stable rule that horses must be walked in the stable area , Recently Mr. Williams graveled and oiled the parking area to eliminate dust caused by cars entering and leaving the stables. As for noise generated by the stable I do not helieve, considering the area and surrounding land uses , that the horses are creatinn a public nuisance, I have been at the stable late at ninht on four occasions . I have never heard any prolonged noise from the horses. I have heard traffic noise from Goldenwest, oil dereks pumpinn, neighbors dogs barking, and large trucks entering and leaving the nearby truck yard. The Williams accept this noise as part of the price they must ray for choosing to live in this type neighborhood as opposed ` r o the standard residential conwnunit . Finally, throughout an almost daily harassment, the Williams family has refrained from any form of counter complaint or even verbal confrontation with the neighhors , Mr. Williams has also asked his boarders to follow this policy. this restraint is can nenrable considering the actions , outright lies , and verhal attacks some of these neighbors have resorted to in an effort to dislodge the Williams from their home and business. In all I only wish the neighbors arouna my residence were as friendly and as thoughtful of others as the Williams have been. I consider it a privilene for myself and my children to know and associate with them. In closing I would like to put forward a few thoughts for your consideration. As horsemen we do constitute a minority of the general population. flowever, I question whether we are any more a minority than golfers, mini bike enthusiasts, or surfers. Yet cities repeatedly provide and maintain facilities for these other sports , often with the tax funds of the malority population. I feel that now you have the ideal opportunity of providinq recreation for horsemen in an area where our sport cannot possibly offend the majority of other residents of Huntington Beach and ,vaa can do so without spending any city funds. I only hope that you do not let the unfounded complaints and harassment of a few families (primarily two) cause you to overlook the recreational needs - of many residents of Huntington Beach and the surrounding communities.
