The density and high rite structure is in- consistent with the R1 neighborhood . 2 . Approval of the request would be a grant of special privilege inconsistent with other R1 property. 3 . Although surrounded by adjacent uses that are or wl11 be high rise n nature , this is not sufficient justification. 4. Granting conditional exceptions for high density or high rise structures will set a precedent for future requests . 5. The appplicant failed to demonstrate a hardship. For the following reasons I feel that this is a satisfactory location: 1 . 17th St . and Adams Ave . are bot:: arterial streets. 2 . The site is well buffered by a drilling island across the street , a .school beti,ieen the site and Palm Ave . and it is over 300 ft. fram residential development . 3. 17th St . is zoned M2 from Palm Ave. to Ocean Ave. , with the probability of commercial tonin as all attempts to zone it multiple residential havo fa led. 4. 0m■atr :1al zoning now exists on the drilling island at the corner of Palm end 17th St . Page 3 5,, Two blocks northeast , our Civic Center is to be located making 17th St. a major connection to the beach area. b. All studies to date indicate office-professional zoning north of the Civic Center. 7 . Property north of the High School is vaned commercial . This , with 17th St . , will provide more: than adequate close-by shopping for the development_. 8. While not a reason for approval of the site , pertinent facts about the project are : a) At 3 public hearings , only one homeowner In the downtown area has voiced hia objection; b) No objections were made by the condominium developer or land owner west of the project; c) It would seem that the City has a responsibility to allow some low cost housing for senior citizens and I believe that this approach is far better than cheap, low level urban sprawl ; and , d) There is a possibility that this develop- ment would satisfy tho Federal Government as proof of providing low cost ho,asing, if our housing element study shows it is needed . Additional Information: This case was originally heard by the fianning Commission on August 18, 1970 , at which time , Mr. Blurock , applicanto stated that they were not expecting a final decision at this time, but would like to present the concept and receive comments from the Commission and the audience. Mr. Rolle West , First Christian Church, spoke on growth of their zimirch ant' the need for housing for the elderly. He stater that they eeti.mate a church attendance o- 1500 within 15 years . Mr. Blurock stated that he feels the high rise tower would be compiatible with the surroundin area because of plans for the civic center , the schools , golf course , etc. Mrs . Lorraine Faber and Mr. Dingwall of the Home Council re- questel continuer-Le to allow time for more public comments because they did not have complete information prior to the meeting. At that time it was the consensus of the Commission to continue Conditlonal Exception No. 70-40 to the September 15 , 1970 meet- ing to allow time for the public to secure additional informa- tion on the proposed project . At the September 15th meeting. Thomas LaMont , nearby resident . stated that he feels the proposal would be more like a place of business and the nearby residents would suffer because this project ma become rundown, being of a low income nature. Mr. Dingwall stated that he feet* there will be inadequate parking and the location should be investigated further, Lorraine Faber requested a continuance for. two weeks, because Page 4 she is {.n the process of making a study of residential high rise developments for the elderly in Loan Angeles and Orange County. It was the consensus of the Commission to continue Conditional Exception No. 70-40 to October 6 , 1470 , for decision only. At the October 6. 1970 meeting, a motion was made by Bazil and seconded by Miller to approve Pj+rt I1 "Tower Type Residential " with a condition that a precise plan shall be approved by the Planning Commission. That motion did not carry . A further motion was made by puke and seconded by Kerins to deny Part II of said request for the following reason: 1 . Said proposal is not in compliance with City Ordinances. That motion did not tarry, thereby , Conditional Exr..eption No. 70-40 Part I1 was automatically continued to October 20 , 1970 for decision only. The subject property is located on the south side of Adams Ave . between 17th and Main Sereets, in the R1.0 Single Family Residence District combined with oil production . i 2 . This application was filled because neither the retirement tawr nor the church facility are permitted in the R1 District . Also, the park- ing requirswnts for both uses are considerably higher than proposed. 3 . A portion of this property Is presently owwd sad used by the First Christtain Church as a sat,��tuary and a religious instruction facility . The existing facility is situated on approximAtely 1 . 899 acres of. lend . 4. Existing and proposed uses in the surrounding area are ns follows : a ) A golf course upon which a 449 unit lour density condominium project is proposed. b) 12 acre cortmunity i.ark site c) High school d) Proposed civic center site e) Low density single family residential homes f) An elementary and junior high school site A map depicting these uses is attached for Your review. 5 . The applicant has indicated that the seve-iteen story retirement tower will be financed under _ the Federal Housing Administration ' s program no. 236 . This program supplements mortgt.ges on rental housing for low income fAmilie; . ' A copy of the program 13 attach,-d for your revlc+w . One Important point for the Commission tcu con- sider is that the program im not specifically designed for a retirement tower, but to sup- plement mortgages on rental housing for low income families . Lately , retirement towers for the elderly have been financed under this progrAra. 6 . Perking for the tower is proposed to be pro- vided at a ratio of 1 parking space for each 3 units resulting in 96 on-site perking spaces. The applicant has also requesttrd chat � of the parkins spaces for the totter be credited to the sanctuary . This ties been requested because the applicant feels that many of the persons living in the toner will be attending the sanctuary; therefore , will not require additional parking. In addition , the applicant has requested credit for 83 on•.street parking spaces and credit for joint use of 54 park- ing spaces situated on the adjacent school property . The applicant has submitted information pertaining to parking requirements for existing senior citizens ' apartments across the country . This information has been enclosed for your review. With regard to parking for the sanctuary , it should be noted that in the past the Planning gi ven Com- mission has iven credit for on- street parking. Also, the parking proposed for joint use by the school and sanctuary is situated in excess of 350 ft. from the sanctuary structure . 7 . With regard to the portion of the request for a drive- in church, the applicant pro- poses to pArk the cars on the grass; thus, preserving the landscaping and eliminating a great amount of paved area. S . The Fire Department has indicated that no special equipment will be required because the personnel end equipment for this type of facility have been included in the Depa rzorent ' s pro j acted growth. i R ir L: . Adequate public transportation is not available; therefore , the ie- veloper should provide a shuttle bus service or similar service to trans- port these people to shopping areas . b) The Department of Housing and Urban Development estimates that. less than 50% of the persons residing in the tower own automobiles . Parking for this facilit;! varied tLor, one park- ing space Cor each two units to one patking space for each five units. An average of one per three seems to prevail . It should be noted, however, that many of the cities having these re- tirement towers nlso have a public transportation system that is more sophisticated than that provided in Huntington Beach . Therefore , it is difficult to compare the towers con- structed in these cities with the one proposed in this application . c) Although FNA Program No. 236 is generally used for financing housing facilitian for persons over 62 , it is possible that the building could be sold and put to another type of resi- dential use . In view of this possi- bility, it hog been suggested that the owners of the building enter into wn agreement with the City speci- fying thAt the building would not be used for any purpose other than a re- tirement tower for the elderly . d ) It has been pointed out that this type of facility is tax exempt , therefore , the cost of supplying services to this facility will be placed on the overall community , rather than the property owner . In view of this , it has been suggested that nn " in lieu" fee be paid to the City for there aprvices . e) With reference to the transportation system, it has been suggested that the applicant submit a plan showing how the PP P 8 people would be transported to various .areas . Also, transportation should be provided on A r«igulcr schedule . c The City of Snnta Monica has two foci- liries such as the one proposed in this application . in both cases , the parking has been provided at a ratio Of one space for each three units . TLe City indicated that there are generally two persons residing in each unit . Tht y also noted n special bus service is not required because locA l service meets this demand . The City of Costa Mesa has indicated :hat they originally required one space for each three units and thAt garages were not required . However, a parking pro- blem resulted and additionAl parking was :•equired, raising the ratio to s l igbt ly nor* than on* p&,rking space for each two units . They also lndichted that there are approximately two per- sons residing in each unit . The facility In Costa Mesa is within close proximity to shopping. It was also the consensus of several city officials the:t the perFons resld • ing in the tower were comminity oriented and were an asset to the community . 10 . There ere sufficient recreation areas in close proximity to the proposed tower, however, shopping facilities Are limited and it will be some years before adequate shoppinb faci- lities Are provided nearby . 11 . It is the cntisent+u.s of the staff that th,.s is not thk, proper location for the proposed retirement tower because it is out of character with the immediate area which is developed r ' as low density residential . This trend is expected to continue with the construction of 449 units on the west side of 17th St . 100 ft . Away . This is not to say that the staff is opposed to the construction of s retirement tower within the city . Only that the location should be such that the 'ower w111 be in keeping with she character of the surrounding area . 12 . With regard to the sanctuary and drive-in church, it is the consensus of the staff that the preliminary plot plan is such that the uses will be compatible with the surrounding neighborhood . 13 . With regard to the portion of the request for the off- street parking, the staff offers the following: Now r - r I a) The ratio of perking to dwelling units (one space for each three units , c(wn- pa ra b le !,o what has been provided in oth � areas) would probably prove to be inadequate in the City of Huntington Beach, because of the lack of public transportation , Just as a problem developed in the City of Costa Mesa , necessitating additional parking , the staff feels that a parking ratio nf one parking space for each three rz:,idential units is inadequate and that a ratio of one space for each two units would prove to be more realistic . The requests for exceptions (. r, park- ing for the sanctuary would probably result to a critical perking problem in the vicinity of the church. The staff feels that some credit should be given to the sanctuary for parking provided tnr the resUontial tower nne that this prirk.ing should not exceed 411 spaces , as requested in the application. With regard to the joint use of 54 park- ing spaces provided on the ad,jAcent school property, the staff feels that this pr rk- ing is too far away and would not sere the purpose for which it is intended . The staff does not feel that credit should be given for on-street parking and that the required spaces should be providti on- site . In the past, the Planning Coven;i ssion has not deviated from the parking requirements for new churches: rind c:htirch facilities and the staff feels that the Commission should continuo with this policy . In view of the above information, the staff recoswtends denial of that portion of the request for a high-rise residential retirement tower and for approval of that portion of the request for a sanctuary on the condition that all required off-street parking be provided on-site and that the final plan be referred to the Board of Toning Adjustments to establish such conditions of approval as doemed necessary. i If the Planning Comnissi.on concludes that the Ugh-rise residential tower is a prover use of this property, the following; conditions of approval are offered foe your consideration : 1 . Miller , Deputy City Attorney QUESTION : Is the granting of Conditional Exception 70-40 legal in view or the case law on the subject , particularly the case of Knox vs . Huntington Beach? ANSWER: No . DISCUSSION : l The recent decision in the case of Knox vs . City of Huntington Beach took Into consideration several cases in California deal- ing with the subject of land use variance (conditional exception) . Considering legal precedent in California , the court held as follows : 1 . The City Council must state Ito reason for affirm- ing ( or overruling) the Planning Commission's granting of a variance . 2 . The stated reasons must be in the form or evidentiary rindsng6 of facts relevant to the standard or hardship . Section 9830 of the Huntington Beach Code sets forth this standard: "When practical difficulties , unnecessary hardships , or results inconsistent with the general purpose and intent ur applicable provisions of Division 9 occur. . . a conditional exception to the provisions of applicable provisions of Division 9 may be granted , provided that no doing will not dereat its general purposes . " Regarding Conditional Exception 70-40 , the Planning Commission In denying the conditional exception specifically !'ound that "the applicant failed to demonstrate a hardship. " (Huntington Beach Planning Commission transmittal to the Mayer and City Council dated November 16 , 1970 . ) Offiot of the City Attorney 17 Pebruary 1972 Opinion No. 72-5 Page 2 In overruling the planning Commission, the City Council never expressly overruled this finding. Moreover, nothing was stated or found by the council to indicate a hardship (Council proceeding re CE 70-40 ) . (Huntington Beach Code Section 9832. 1 . ) In response to this question on the application for 70-40 as to what exceptional circumstances ;y apply to this property , applicant stated "none . " Thus , the applicant stated "no hardship, " the Planning Com- mission found "no hardship" and the City Council made no ' Finding on "hardship . " CONCLUSION: r If the matter of Conditional Exception 70--40 went to a court , it 2s most likely, in view of the case law on this subject Including the recent case of Knox vs . Bonf3 , City Attorney Re : Resolution Setting Aside Conditional Exception 70-40 and Building Permits Issued Thereunder In the recent case of Knox v . City of Huntington Beach , involving the granting of a Conditional Exception to the First Christian Church for the building of a high rise apartment for the elderly , the City as the entity granting said Ccnditional Exception and issuing building permits thereunder , was named as the nominal party in the referred to lawsuit . The First Christian Church intervened in this lawsuit on the real par•`.y in interest . Although the Court sustained the City Attorney ' s position that the City was not responsible for damages , the First Christian Church did not sustain its position that the granting if Conditional :,xception 70-40 was proper and the Court has ordered its nullification . Court has issued a writ of mandate , which pursuant to the requirements of the law is issued against the granting body , that is , the City of Huntington Beach . In accordance with the Judgment in t•hi3 lawsuit , the City must respond to the Court ' s mandate . Accordingly , the attached Resolution Is necessary for us to comply with the writ of mandate .
