AT_TN: Doyle Miller , City Administrator Pahl Jonus , City Clerk Gentlemen : Pursuant to your request , the Planning Cotmnission at their October 20, 1970 meeting reviewed Their action to approve Conditional Exception No. 70-44 fot the purpose of stating findings of.fact relied upon to render such decision. The following is a list of facts the Planning Corrinission Found to exist and they are based upon oral and written evidence submitted for consideration as well as comments from the staff a-nd Commission members . 1 . Because commercial boat slips Bind high rise buildings rre not permitted in any zone, the applicant was advised by the Planning Del+:rtment to submiL a condi- tional, excrpLiun application covering the entire p•ro ject . 2 . The conditional except .inn was accompanied by an application to rezorn the property so as to permit the propa;,od protect . 3 . Tc, avoid speculative zoning, the Planning Commission in the past has withheld action on a zone rase when processed concurrently with a conditional excep- tion . The zone c n se is late. approved whet+ the project is under construction. 4. The conditional exception procedure assures surrounding property owners that the property will be developed in the �Wilrier prescribed by the applicant . A zone change does not provide this guarantee . i 5. Approximately .15 acres of the property :is designated for medium density residential . development . Most new Apartment projects t areas are develo ed at in medium density nee i,,. y pp a density of 23 units per acre. Thia t i 4 . density on the 15 acres in question would result in 375 units . The appli- cnnt proposes to construct :378 units; thus , this proposed density complies with the Master Plan . 6 . Property to the northwest is zoned for commercial and high density develop,r,ent . 7 . The plan provides a transition in density from the single family area along the southeasterly portion of the property to the higheazt density along the northwesterly portion on the property . This transition provides the best protection for residents across the channel 'Co the southeast w•hizlt would not be Provided i . the property were to develop to one: density .as permitted on the Master Plan . 6 . The plan includes n proposal to develop a water oriented co=tercial davelopment . This orientation results in a reduction of land area necc-ssitating the use of high rise buildings . 9 . A transition in building height has been provided . 10 . A development of this nature wi 11 bring substantial tax benefits to the city . 11 . The development will tipgrode the wren and be an asset to the city . 12 . It u-ill serve as a landminrk At the northerly entrance on Pacific Const Highway . Therefore , by reason of the above Findings of Fact , the Corn- mission finds that : A. There are Special circumstances or condi- tions affecting said property , and B. Thr exception is necessary for the preser- vation of enjoyment of it substantial pro- perty right of the petitioners and C. Reynolda , i ,Secretary KAR: dr STAFF REM"T DATE: Augmt 18, 1970 ZONE CASE 110. 70- 13 Applicant: Gulf Oil Corporation And CONDITIONAL EXCEPTION NO. 70-44 Applicant : Real Property Management The staff has reviewed Zone Case No. 70- 13 and Conditional Exception No. 70-44 and, offers the following information for your consjderation: 1. The above referenced zone change and conditional exception pertain to the same parcel of lend, tierefore , one report has been prepared for both items . The conditional exr•eption prcposes a precise development plaai and the zone change pro- -,)oses to rezone the property to confo.L-m to the proposed development plan. 2. The property fa situated on the northeast side of Pacific Coast Highway between Anderson St. and Admiralty Dr . in the R 1 Single Family Residence District and C4 Highway Commercial District . The property consists of 35 . 54 ticres of land . Approximately 2/3 of the land is Master Planned for Office and Retail Commercial u:ie and 1/3 Master. Planned for Medium Density Resi- dential. development . 3 . The applicant proposes the following: a) Approximately 23 single family residences on 60 x 100 ft . lots with frontage on a 54 ft . street and 150 ft . wide channel on a 3 . 88 acre parcel of lend . These residence& are intended to serve as e transition between the existing single fawl.1y residences across the channel and the multi- faoily development w1thin knis p'oject. This portion of the request is to be corsstruc- ted on property toned R1; therefore, the pro- posed use is permitted . b) Approximately 75 town house apartment units with access to a 54 ft . public street ana 20 ft. public alley on a 4 . 15 acre parcel of land . The town houses will be situated directly across the street . rom the single family residences covered under :.subsection a . With regard to this , the applicant proposes to rezone this property R3 to serve an e transition between the R1 property and the commercial and high density residential to be situated to the northwest . The staff feels that the town houses can � be compatible ui.th the ogle family resi- dences across the street if they are designed i by the same erchityct or if the developer exercises architectural control . It should be noted that most of the traffic to the town houses will be by way of a 20 ft. public alley on the perimeter of the comer- cial area . This alley is also intended to serve the commercial aevelopment as well as the comercia 1 boat sups . It is the con- sensus of the staff that if the alley is to serve all three uses , it should be private rather than public. cj Approximately 280one to three bedroom units within four three-story buildings and one eleven-story building with 75 boat. slips on a 5. 79 acre perninsula of land obtaining access from Par-Lf:c Coast Highway by way of a 60 ft . strip of land . she 60 ft . strip of land by which access is to be obtained to the penninsula will be designed to give the appearance: of a bridge . The 260 units will result in a density of slightly over. 48 units per acre . This exceeds the maximum density permitted in the R4 zone which is 43 . 56 units per acre . However, it does conform to the density pro- posed for the R4 zone which is to be based on lend use intensity . The eleven-story apartment building Will be situated approxi- mately 1 , 000 ft. from the closest existing single faanily area ; therefore , it should not have a detrimental effect on the property. The 75 boat slips are to be used by the resi- dents of the development. d) Approximately 260 commercial boat slips and e commercial fuel dock on 7 . 9 acres of land . Access to the commercial boat slips will be through the proposed commercial area ; there- fore, it will not effect the surrounding; residential property to any great exten'_. One point for consideration which was mentioned earlier is that access to the bust slips will be by way of the same 20 ft _ public alley serving the town house apartment units . Another point of consideration is the place- ment of the fuel dock as it relate^ to the town house apartment project . Concern has been * rpressed that this fuel dock should be relocated elsewhere in the project . With reference to the cc ercial boat slips, the staff .feels that the use and location are satisfactory. ` eA'*Ccmmercial buildings as follows : • 1) Single story retail stores and restaurant . 2) Four-story office buildings . 3) Eleven-story 160 room hotel . The retail shops , restaurants , office build- ings and h:otela are all permitted uses in the C4 zone . The eleven-story hotel exceeds the 35 ft . height limit permitted in the C4 zone. This building will be situated approxi- mately 575 ft . from the property line of the nearest existing single family residential development . 4 . Approximately 12 acres or 1/3 of the property in question is proposed for medium density develop- ment which will allow approximately 300 residen- tial units. This plan proposes the construction of 355 units . Because the Master plan for this ps:. txcular parcel is not specific, the staff feels that the density is comparable to that pro- posed e pos d on the Master Plan . 5 . Approximately 8 .4 acres of the 35 . 54 ac-;es will be devoted to waterways . The fact that the: appli- cant proposes to construct conmercia:, boat slips as well as bont slips for the residents being in the project, gives rise to the question as to whether o:: not the waterways should be ded`cated for public use or if a portion should be reserved is private property . This question should be in- % estigated by the Department of Public Works and City Attorney ' s office with City Council considera- tion prior to a final deter-mination as to the status of the waterways. 6. because the plan is general in nature , the staff 1:eels that such matters as access, street and alley widths, curb cuts , ; fire protection equip- wnt, etc . , should be reviewed in greater detail . Therefore , if the Cong ission feels i,hst the pro- 4} ,,,used tise is acceptable , th^- staff recommends that the conditional exception be conditioned ' that the final plans shall be submitted to the Board of 'Zoning Adjustments for review and to establish conditions of approval which shall bo forwarded on to the Planning Coanmission for f lna 1 action. Tne staff feels that the proposed project will ba an asset to the City and will serve as e 13ndmark at the northerly entrance on Pacific C3ast Highway and therefore recommends approval subject to the aforementioned conditions.
